Episode 12 of my website is titled The Corruption and Cover-up involving Freeman Exposition Inc., OSHA of Nevada, Worker s Compensation of Nevada and the Teamster Union Local 631. Episode 12 most certainly includes your involvement and your participation of the corruption and cover-up in the crushing injury to my left foot. If you Google Michael P. 3 3 Las Vegas Judge Michael P. Villani First of all, the Order Denying Petitioner s Petition for Judicial Review was conducted covertly behind closed doors by you, there was no hearing whatsoever! I submit that my constitutional rights were severely violated again and again and again in the State of Nevada and most certainly by you as a Judicial Officer in an extremely corrupt court system in the State of Nevada. There is not a jury in this country that would not have supported my claims when they are presented with all the supporting facts that were submitted to this court! As an exhibit with my Petition for Judicial Review was a five-page Affidavit of Plaintiff described as a Combined Statement of Facts, in response to Decision and Order and Sworn Affidavit. In the heading of this affidavit I stated, I will respond to the findings of fact and the Decision and Order by number.

4 4 The Decision and Order submitted by Appeals Officer Gregory A. Krohn, is riddled with fraudulent statements. Did you even bother to look at my Affidavit of Plaintiff? In the Order Denying Petitioner s Petition for Judicial Review you state, If there was any claim that the original determined was incomplete or that the scope of the claim was improper by accepting the settlement/determination he weighed the same. A Claimant in a Workmen s Compensation Injury Case has the right to reopen his case for life! In this Court Order you further state, At no time did the Petitioner file an appeal or request clarification of the scope of his claim to include his ankle. It is absurd to presume that in a crushing injury of a foot that the ankle of the same foot is necessarily not part of the foot! In any event, that issue was addressed numerous times in my Affidavit of Plaintiff that was submitted to you a year and a half earlier. My left ankle was never an issue! The only treatments I ever received were from Doctor Carl Smith, who administered cortisone injections into the talus of my left foot!

5 5 The talus of my left foot is adjacent to the metatarsal bones that were fractured! Two weeks later, Doctor Carl Smith prescribed an MRI with the accompanying radiologist report and 12 weeks of physical therapy for my left foot. Magnetic Resonance Imaging (MRI) may show problems that cannot be seen with other imaging methods, to include x-rays. An MRI is actually done more commonly than other tests to check for bone and joint problems including x-rays. In my first meeting with Doctor Abdi Raissi, I distinctly requested an MRI with the resulting radiologist report. Doctor Abdi Raissi indicated that an MRI is not covered by Workers Compensation. Worker s Compensation does in fact provide for an MRI with the accompanying radiologist report if it is prescribed by the attending physician! The Radiologist s Report as prescribed by Doctor Carl Smith indicated additional injury to the talar region or talus of my left foot! This was supported by both Doctor Carl Smith and Doctor Michael Federico of the Veterans Administration who were both provided with the Radiologist Report.

6 6 In this Court Order you state, Furthermore, the Appeals Officer found that Doctors Smith and Federico s attempts to establish causation were not credible. I find it disgusting and contemptible that a corrupt government official, a corrupt lawyer and a corrupt Judge are labeling two Las Vegas Physicians that I respect and admire as liars. Who the hell do you think you are! Both Doctor Carl Smith and Doctor Michael Federico are dedicated to the health and welfare of their patients unlike what I repeatedly encountered with Doctor Abdi Raissi! For you and your cronies to demean and belittle these physicians is a reprehensible disgrace that is symptomatic of the rampant corruption that is the entire legal system in the state of Nevada! In this Court Order you further state, Additionally, Doctor Raissi who was in the best position to know what injuries were and were not industrially related stated that the Petitioner was medically stable and released from care. There are many fine physicians in the State of Nevada, however there is also no shortage of quacks and Doctor Abdi Raissi is one of them plain and simple!

7 7 I was released from Doctor Raissi s care without the essential benefit of a radiologists report as to the true extent of the injuries to my injured left foot and before my physical therapy was completed! The same can be said of out-of-state Doctor Dickman who submitted a PPD evaluation without the benefit of a radiologists report, in fact during the evaluation Doctor Dickman had no medical records to refer to whatsoever! I submit that Appeals Officer Gregory A. Krohn s Decision and Order was in fact arbitrary, capricious and categorized by an abuse of discretion! Your Court Order concludes with The court finds that the Appeals Officers Decision and Order was based upon substantial evidence and therefore was not arbitrary capricious or an abuse of discretion. Therefore, court ordered, Petition for Judicial Review is denied. This Court Order is not worth the paper that it is written upon! The Respondents Answering Brief submitted by opposing attorney Daniel L. Schwartz, representing my employer Freeman Exposition Inc., is riddled with fraudulent statements and entries! What has been transpiring is that I have been repeatedly confronted with trained and professional tricksters, cheats and liars like yourself!

8 8 The Appeals Officer concludes that the credible evidence in the record supports a denial of reopening since claimant has not met his burden of proof by a preponderance of the credible medical evidence to show a change of circumstances and the need for further care is primarily related to the work injury. I submit that I have in fact more than met any burden of proof of credible medical evidence to show a change of circumstances that were needed for further care and that is in fact related to the crushing injury of my left foot that was caused by the gross negligence of my employer! Mister, have you ever actually upheld an Injured Workers Petition for Judicial Review, that was not a personal friend or relative or represented by a hotshot lawyer? I have repeatedly stated on numerous occasions in court documents and in articles that I have prepared that, Nevada government reeks of corruption and that corruption is rampant and Mister this corruption most certainly extends to you and all of your cronies! 15 15 James R. Aymann (Jim) is a combat veteran of the Vietnam War with a service connected disability and he celebrated his 71 st birthday a few days ago. In August 2014, Jim created the websiteonemansfightagainstcorruption In the past year alone, (July 2015 July 2016) this website has had over 14,000 visits, to include Europe, Asia, Latin America, Australia, New Zealand with a following from China, Ukraine and Brazil. To date, Jim has no accounting for visits by mobile phones and backdoor visits that include phrases and this is without the aid of press releases, networking, advertising etc. Jim has also received hundreds of favorable s in reference to this website from all over the world. What is interesting is that Jim has essentially added nothing to this website in the past year. However, Jim has posted several articles on the Internet under pseudonyms. There is a populist movement that is sweeping across this country! This movement is deeply factionalized with progressive sentiments at one end of the spectrum and reactionary sentiments at the other end but the common theme and the common thread that runs through this movement is the complete and total disgust by the populace involving the corruption in the private sector (big business) and the corresponding corruption of government at all levels that includes all branches.

17 Nevada received a failing grade of F and is fifth from the bottom amongst all 50 states! 17

18 18 Public access to information, political financing, electoral oversight, Legislative accountability, Judicial accountability, procurement, internal auditing, lobbying disclosure, ethical enforcement agencies, ad infinitum received failing grades in the State of Nevada! To be blunt, Nevada industry, to include lawyers, in conjunction with Nevada State Government at all levels is a labyrinthine sewer of corruption and deception draining into a cesspool and that cesspool are the Nevada courts at all levels! Are you getting the picture yet! In theory, if an individual has a collection of supportable facts ad infinitum, then the opposing party in an adversarial setting is lying and cannot prevail. In reality, in the State of Nevada, supportable facts are meaningless unless you are connected (big business, affluence, hotshot lawyers, relatives etc.) you cannot prevail with any state institution in the State of Nevada, end of story!

19 19 Every year tens of thousands of hard-working, taxpaying and law-abiding Nevada residents are victimized in an extremely predatory private sector. When these victims appeal to law enforcement or to virtually any other county and/or state agency and ultimately to the court system at all levels, they will be victimized again and again and again and again ad infinitum! Gallup conducted a poll last year whereby they determined that Three in four Americans (75%) last year perceived corruption as widespread in the country s government!) This poll is an indication that government on the federal level is perceived to be both rampant and pervasive In Nevada however, a more accurate figure would be 95% or 19 out of 20 Nevadans perceiving corruption as widespread in Nevada government! (5% are either corrupt government officials or the individuals that benefit from this corruption)

21 21 Corruption and Deception in Workers Compensation My name is James R. Aymann. I am a 70-year-old disabled combat veteran of the Vietnam War. This 70% service-connected disability award is for posttraumatic stress disorder. This award was in place prior to any of the events and incidents involving the crushing injury to my left foot! By definition I have been an older and vulnerable person throughout the following incidents and events described in this open letter. Donald S. Freeman Jr. is the chairman of the family owned Freeman Exposition Inc. As a result of being a family owned business, Freeman Exposition Inc. has the ability to outbid their competitors. Freeman Exposition Inc. is a multibillion-dollar family-owned business! Freeman Exposition Inc. controls Workmen s Compensation, OSHA of Nevada, the labor unions, and the courts.

22 22 When my left foot was crushed, I filed a complaint with OSHA that same day! Dennis Love, an eyewitness to the crushing injury to my left foot, was laid off the very next day after four hours of work! Dennis love was banned by Freeman Exposition Inc. from returning to work! This illegal act was endorsed by Tommy Blitsch of the Teamsters Union Local 631! Gallagher Bassett was the initial third-party administrator. A Jennifer Milliken initially handled my case. She set up an appointment with a Dr. Abdi Raissi of the Desert Orthopedic Center. Raissi s involvement with my injury, was limited to looking at x-rays! At no time did he come within 3 feet of my person! I informed Raissi that I wanted an MRI with the accompanying Radiologist Report. Raissi informed me that Workmen s Compensation does not cover MRIs. That is a boldfaced lie! Dr. Abdi Raissi is an immoral trickster, cheat and a liar!

23 23 Furthermore, I did not care for his manner whatsoever. When I returned home, I immediately checked this doctor out on the Internet. There were numerous negative reviews, parroting the same experience that I had just had with this doctor I contacted Jennifer Milliken of Gallagher Bassett and informed her that I wanted Dr. Abdi Raissi replaced as far as any further treatment of the crushing injury to my left foot was concerned! Jennifer Milliken of Gallagher Bassett informed me that she would not be able to replace Dr. Abdi Raissi at that early stage. That is a boldfaced lie! Jennifer Milliken of Gallagher Bassett is still another trickster, cheat and liar! Episode 12 of my website goes into greater detail describing her deceptions on behalf of Freeman Exposition Inc., financially I was fine. However, the owner of the townhouse that I was leasing, died a few weeks before the crushing injury to my left foot. The owner s two nieces were co-executors to the townhouse. It was placed on the multiple listing service.

24 24 I was actually served with a fraudulent 30 day eviction notice for nonpayment of rent. All my rent checks were cashed! Approximately nine months earlier my primary care physician with the Veterans Administration scheduled an appointment on my behalf at the mental health clinic. What was transpiring with these two nieces and their real estate agent is described in detail in Episode Two of my website. The solution was actually quite obvious and simple. I needed to go to my bank and apply for a home loan to either buy the place that I had been leasing for 10 years or buy something else and move. The ploy of these two nieces and their unscrupulous real estate agent was to gouge me for $25,000 more than the place was worth on a declining market! In the 10 years that I lived in the townhouse, I accumulated an enormous amount of possessions. The downturn of the economy had already started and it would have been unrealistic to assume that my bank would offer me a home loan when I was in fact unemployed as a result of the injury to my left foot.

25 25 Although I was still in pain and my foot was still swollen, I informed Raissi that I needed to return to work. At that time Raissi assured me that the pain and swelling would be gone within five additional months. Four later months I was offered and $8900 lump-sum settlement. I decided to accept it and moved on. I had already submitted an offer on another townhome that was accepted. August is a busy month for the convention show industry in Las Vegas Nevada. I was working 12 to 14 hours per day with no days off. Apparently the long hours without any days off was too much of a stress and strain on my injured left foot. My decision to prematurely return to this type of work was clearly an error in judgment on my part. My left foot took a severe turn for the worse. The pain in my left foot was excruciating and the swelling worsened!

26 26 I returned to Desert Orthopedic to arrange for an appointment with Doctor Raissi. After waiting in their lobby for some time, I was informed that Dr. Raissi was refusing to see me! I was desperate, I had to do something. I set up an appointment with Dr. Carl Smith, a podiatrist and the co-owner of Eastern Podiatry. For whatever reasons replaced Freeman Exposition Inc. replaced Gallagher Bassett with Specialty Risk Services as their Third-Party Administrator. I contacted Specialty Risk Services and informed them that the swelling and pain in my left foot was much worse than when I accepted the lump-sum! I informed them that Dr. Raissi had refused to see me and that I considered that an abandonment by a doctor of a patient that was still under his care! I informed Specialty Risk Services, that I was willing to refund the $8900 and that my left foot needed immediate attention! Specialty Risk Services refused and I was told I would have to wait one year before I could reopen my claim! That was a boldfaced lie!

27 27 Please note, Workmen s Compensation claims are never closed when an injury worsens! On September 10 I finally had my first appointment with Dr. Smith, who I immediately liked in contrast to Doctor Raissi! Dr. Smith asked me to place my finger where the pain was most severe I place my finger directly over the talus of my left foot which is adjacent to metatarsal bones and approximately 2 inches from where the fractures occurred. He administered several cortisone injections deep into the talus of my left foot and told me to return in two weeks. My experience with Dr. Carl Smith was far superior to that of Raissi. On September 23 I returned to Dr. Smith and he prescribed an MRI and 12 weeks of physical therapy. Magnetic Resonance Imaging (MRI) was performed on my left foot the following day. Magnetic Resonance Imaging (MRI) is a test that uses a magnetic field and pulses of radio wave energy to make pictures of organs and structures inside the body. MRI also may show problems that cannot be seen with other imaging methods.

28 28 An MRI is actually used more commonly than other tests to check for some bone and joint problems. Why did doctor Raissi refuse my request for an MRI? One week later I re-continued physical therapy with Ortho Sport. Doctor Raissi prematurely discontinued my physical therapy less than five months earlier! The physical therapy was three times per week for 12 weeks at my expense! The following week I met with Dr. Michael Federico a podiatrist with the Veterans Administration. I brought the MRI and the Radiologists report with me. He spent 30 minutes manipulating my foot and explaining the problems that I would be facing due to the injury including arthritis. Dr. Federico prescribed medication for my foot and offered physical therapy through the VA. Like Dr. Carl Smith, my experience with Dr. Michael Federico was far superior to what I had experienced with doctor Raissi!

29 29 Also note, unlike Raissi, Dr. Federico went into great detail explaining the problems that I would be facing due to the injury to my left foot to include arthritis to the joints of my left foot! The joints of my left foot would clearly include my left ankle! A few days later I signed the closing documents to the townhome, that same day I voluntarily requested a layoff from Freeman Exposition Inc. and started moving my possessions to the townhouse that I had just purchased. By the end of the year I completed the 12 weeks of physical therapy and finished the arduous task of moving and setting up my new place of residence. Inc. On December 29 I returned to work for Freeman Exposition THE CORRUPTION AND COVER-UP OF SPECIALTY RISK SERVICES (SRI) TO INCLUDE PATRICIA HOEK At this time, I will address the letter on page 2 of this open letter. This letter is from Theresa Mosca Account Consultant for Specialty Risk Services (SRS).

30 30 This letter states the following: After a careful file review, it is the determination of this administrator to deny your reopening request for the following reasons: 1. The original file was accepted for a left foot fracture and the medical reporting was positive for metatarsal fractures of 2, 3, 5 and 4 th toe. All the treatment was for these injuries Response Please note the letter titled claim acceptance on page 3.The entry for body parts is left foot! That means the entire left foot that includes the talus, which is adjacent to the metatarsal bones of my left foot that were crushed! 2. The permanent partial disability evaluation done by Dr. Dickman on August 4, 2008 confirmed injuries to the left metatarsals only. Response This permanent partial disability evaluation was conducted on July without any medical records available and without an MRI and the accompanying radiologist report! My left foot was clearly still swollen and I indicated to Dr. Dickman that as the day progressed at work, the swelling of my left foot would increase along with the level of pain!

31 31 This evaluation was seriously flawed from the onset! 3. Additionally, we have a note dated October 6, 2009 from your previous treating physician, Dr. Raissi that he had no further recommendations for treatment. Response Please note the prescription on page 4 of this open letter. On this date I returned to Desert Orthopedic to obtain written records supporting the fact that Raissi had refused to see me in early September 2008 clearly abandoning me as a patient. Instead of the record that I had requested I was handed a faxed prescription from a remote location. Raissi had not seen me in 17 months and he had in fact abandoned me as a patient over one year earlier! 4. There is note of an intervening injury specifically to your left ankle in February Response After I had completed 12 weeks of physical therapy at my expense I return to work for Freeman Exposition Inc. on December 29.

32 32 Five weeks later I set up a very difficult and undermanned exhibit at Mandalay Bay. The exhibit was 16 feet high and 20 years old. The set up for this type of exhibit requires a minimum of four experienced workers. Two workers on a scissor lift and two workers on the ground. All I was given was one worker with a seriously disfigured hand and no scissor lift! There was a Freeman out-of-towner that sat on his ass throughout the entire set up! This is typical of the way Freeman Exposition Inc. conducts themselves in the set up and tear down of large exhibits. This is the same company that caused the crushing injury to my left foot as a result of their gross negligence! At the end of the first day of set up my left foot was extremely painful again! The months of physical therapy were for naught! I had made no progress.

33 33 The Freeman Show Foreman, named Felicia, was aware of the crushing injury that I had sustained to my left foot a year earlier! I asked to be taken off that exhibit! She refused! My entire left leg became much weaker than my right leg. Once again I had trouble walking downstairs. As I was walking down the stairs in my home I twisted my left foot. I was in extreme pain! 5. Finally, Dr. Smith s October 7, 2009 report fails to provide objective medical findings supporting a worsening of condition related to the original injury to your left metatarsal. Response Please refer to the three letters from Dr. Carl Smith on pages 5, 6 and 7 of this open letter. In the letter on page 5 from Dr. Carl Smith, she conveniently omits the last sentence in the second paragraph! We ordered an MRI of his foot and results was that he had bone marrow edema to the talus, suggestive of bone bruise to the area or possibly early necrosis to the bone!

34 34 In the letter on page 6 from Dr. Carl Smith, written two weeks later, he states, From my examination and with no other history of injury that could have brought about the amount of arthritis and degeneration to his rear foot and ankle it is my belief that the pain and problems with his left foot and ankle can be directly related to his previous injury, even though it was not identified until well after the injury itself. The MRI of my left foot was actually performed only eight months after the crushing injury to my left foot! The letter from Dr. Smith on page 7 clearly states, Patient has been seen multiple times for treatment related to his left foot, particularly his talar area. Patient has had MRI showing edema within the talar bone of his foot. The chief complaint was about his left foot and the treatment was to the left foot. I submit to Patricia Hoek, manager of Specialty Risk Services that whoever Theresa Mosca is or was, she is an immoral trickster, cheat and liar! Freeman Exposition Inc. is an unscrupulous family owned mega-company that hires third-party administrators like Specialty Risk Services to do their dirty work!

35 35 The profits for Specialty Risk Services for last year in Las Vegas was over $28 million. Once again I am a 70-year-old combat veteran of the Vietnam War with a 70% service-connected disability. If you are disabled, or if you are an older person, or if you are a veteran, or if you simply know anyone in these groups, do not patronize Specialty Risk Services.
