Arlington Heights, IL Re: Freedom of Information Act ( FOIA or The Act ) Request Dear Mr. Kmitch: This letter contains the response to the FOIA request you submitted on October 13, ñ The attached public record(s) is provided in response to your request. ñ Please note, pursuant to Section 7 of the Act, the following parts of your request are exempt from disclosure pursuant to the following subsections of the Act: (1) When a request is made to inspect or copy a public record that contains information that is exempt from disclosure under this Section, but also contains information that is not exempt from disclosure, the public body may elect to redact the information that is exempt. The public body shall make the remaining information available for inspection and copying. Subject to this requirement, the following shall be exempt from inspection and copying: (b) Private information, unless disclosure is required by another provision of this Act, a State or federal law or a court order. 5 ILCS (140/2) Sec 2. Definitions. As used in this Act: (c-5) Private information means unique identifiers, including a person's social security number, driver's license number, employee identification number, biometric identifiers, personal financial information, passwords or other access codes, medical records, home or personal telephone numbers, and personal addresses. Private information also includes home address and personal license plates, except as otherwise provided by law or when compiled without possibility of attribution to any person. (c) Personal information contained within public records, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy, unless the disclosure is consented to in writing by the individual subjects of the information. Unwarranted invasion of personal privacy means the disclosure of information that is highly personal or objectionable to a reasonable person and in which the subject s right to privacy outweighs any legitimate public interest in obtaining the information. (d) Records in the possession of any public body created in the course of administrative enforcement proceedings, any law enforcement or correctional agency for law enforcement purposes, but only to the extent that disclosure would: (i) interfere with pending or actually and reasonably contemplated law enforcement proceedings conducted by any law enforcement or correctional agency that is the recipient of the request. The case has yet to go to trial. 2 21:18 Retail Theft 145 Yorktown Shopping Center On Tuesday September 21:18 26th, 2017 at 21: hours, Officer Rome and I (2L6 Officer Herrera #819) were dispatched Von Maur then to Von provided Maur (145 me with Yorktown surveillance Shopping footage Center) and for I entered a shoplifter the video holding. into evidence. 720 ILCS 5/16-25-A-1 A Retail Theft: Takes Possession/Carries Away/Transfers DuComm advised that Loss Prevention had 1 female in custody. Commit Officer Rome arrived first and spoke with Loss Prevention Employees Sonia Castaneda and Jean Degner and A/ Sandra M Pihos inside the LP office. Upon arrival, Officer Rome reiterated what LP told him and he related that Jean was monitoring the cameras when she observed Sandra walk into a fitting room carrying multiple items. Sandra then exited the fitting room with only one item. Sandra then selected more items and again walked into the fitting room. Sandra was seen carrying less items at this time again. Sandra then made a purchase and picked up clothing from the alterations department. Sonia then checked the fitting room and did not find the clothing items that Sandra was seen entering the fitting room with or the items she just purchased. Sandra then walked out of the store through the East exit, passing the last point of sale. Arrestee 512 WILLIAMSBURGH RD Sonia Glen Ellyn, and IL Jean 60137stopped Sandra, identified themselves as Loss Prevention, and escorted (630) Sandra to the LP office without incident. While walking back towards the LP office, Sandra verbally told them that 6/11/1946 she had taken 71 items Female from the Wstore. Once inside the LP 5 office, 3 Sandra 135 took out Brown three women's Brown clothing items valued at $ that she did not pay for. P IL -- I asked Sandra what her highest level of education was, if she spoke and understood English, and if she had any learning disabilities. Sandra advised that she received a Masters degree, she spoke and understood English, and had no learning disabilities. I read Sandra Miranda, from a pre printed card, Business at 2136 Victim hours and Sandra advised Von Maur, she understood her rights. I asked Sandra why (630) did she take the items and she advised she made a dumb decision and just took the items. 145 Yorktown Shopping Center LOMBARD, IL I told Sandra that she was under arrest and to turn around and place her hands behind her back. I handcuffed her (double-locked and checked for proper fit) and patted her down with the back of my hand with negative results. I transported Sandra to LPD booking to be processed. Once in booking, L19 searched Sandra with negative results. Due to the dollar amount taken, I contacted Felony Screening and spoke with ASA Mandy M. who denied felony charges at this time. Complainant Sandra 145 YORKTOWN was photographed, fingerprinted, and charged with one misdemeanor charge of retail theft pending LOMBARD, a court IL 60148date of November 3rd, 2017 at 9:00 A.M. at 505 N County Farm Road in Wheaton and released on I-Bond. 8/7/ Female Officer Rome then transported Sandra, non custodial, back to the mall to retrieve her vehicle.
