5 of the mpact on Town and area growth resdental commercal and ndustral The Dutchess County Department of Plannng recommends that pror to a Town Board decson on the zonng amendment studes be carred out to determne the mpact of ths on proposal roads water resources and sewer servce capactes and the relatonshp of ths proposed use to exstng and potental development n the area After completon of such analyses the decson n ths matter should be based upon local study of the facts The Dutchess County Department of Plannng does not presume to base ts decson on the legaltes or llgaltes of the facts or procedures enumb ated n subject zonng acton Dated January Kenneth R Toole Commssoner Dutchess County Department of Plannng By Rchard Brch Senor planner January 9th 982 Town Board Town of Wappnger Town Hall Mll Street Wappngers Falls NY 2590 RE Cornell Drake Rezonng Request Dear Board Members At the January 8th 982 Plannng Board a meetng moton was made by Mr Fanuele to recommend that the rezonng request be granted subjedt to the provsons that the road known as Four Feldsll n t be used as art access to the ste and that the buldng e be lmted to square feet The moton was sa dnded by Mr by those members present Vote Mr Fanuele aye Mr Mlls aye Mr May aye Mr Brannen term expred Parsons and was carred Mr Keller absent Mr Parsons aye Mr Rubensten aye Respectfully yours s Betty Ann Russ Seer T W Plannng Board Mr Fred Johnston partner of Pzzagall Constructon Company from Vermont was present and asked to speak on the rezonngj he stated that he had met earler that evenng wth resdents of the area of the proposed rezonng He was avalable he stated to answer questons on specfc problems that the resdents felt the rezonng would cause e traffc snorm water runoff esthetcs access land use polluton effluent water control etc f t was not rezoned so be t he sad they were not gong to show up wth New York lawyers

6 3 and try to fght t f t doesn tft the best needs of the communty t won tbe done there are other communtes but there are partcular advantages to ths ste Upon the recommendaton of the Dutchess County Department of Plannng to conduct studes and at the urgng of the Town Board they had conducted a complete Envronmental mpact statement by the engneerng frm of Hayward paknwhch s not normally requred for a rezonng but under these crcumstances he agreed t should be done even though hs frm does not own the property and have no partcular buldng plan n mnd He then explaned what the statement was and what questons t answered and submtted t to the Town Board Ther man concern n accomodatng the resdents of the vcnty of that rezonng was tryng to come up wth somethng to answer objectons to people on the mmedate road whch s FOur Felds and belongs to ths parcel and has sx houses on the road He compared what mght be a housng development of 66 homes whch could be bult up to that road wth perhaps 2 or 3 cars for each home wth a sngle offce buldng ther proposal calls for the elmnaton of that road as a means of access to that property and they would establsh whatever buffer that would be requred to nsure them that the project would not be seen from any of those homes and they arrved at a fgure of 300 of land that would be left as land forever wld they were wllng to lve wth restrctons they plan only offce research not testng or manufacturng They do not have a defnte plan for the buldng he repeated nor do they have a clent the number of cars could range from about 0 to a maxmum of 590 He then told the publc he was avalable for t any questons they mght have a plan was submtted for them to vew Henry Semp All Angels Hll Road asked a clarfcaton of why OR loa s mentoned n the legal notce as offce and research only when n fact accordng to the Zonng Ordnance lght ndustry dstrct should also be ncluded as part of OR Ths rezonng s of great concern to those opposed and ther

7 concerns nclude added traffc snce t has been stated that between 300 and 600 cars n addton to the BM complex wll travel on an already overcrowded bedroom communty road and would create a serous safety hazard especally when school chldren are wthn walkng dstance of ther schools 2 a fear of lower real estate value to surroundng homes 3 excessve nose polluton affectng the bedroom communty 4 a danger of polluton of one of the Town s aqufer recharge area 5 the property contans a wetland whch should be protected he contnued There has been suffcent evdence and concern to warrant a request for an envronmental mpact study conducted n conformty wth the SEQRA law and should be done before any rezonng of the property takes place He asked f the Town Engneer had been contacted to prepare and submt an envronmental assessment form for the state DEC as requested Mr Johnston responded that the zonng classfcaton ght ndustry was not allowed wthout a specal permt f they were granted an OR use that would be a very narrow use f they wsh to buld for ndustry they would have to come back agan and apply for a use specal permt whch he sad was not ther ntenton the buldng that they do have now are strctly for offce use not ndustry As far as traffc goes yes he admtted there wll be more traffc snce there wll be cars n the parkng lot due to addtonal people workng n that buldng the purpose of ther desgn ncludng traffc lghts was to put the burden of watng or havng problems on the guy who s tryng to get out of the lot and on to Myers Corners Road not on the people who are already on the road f they have to stack up and stay n that project untl kngdom come that s ther problem the ntent of havng traffc lghts s to control the flow on Myers Corners Road so that t s a reasonable flow the lghts are adjustable and tj f they so des red ccum ba fve mnute green on Myers Corners Road and a 30 second green comng from the project He compared t wth a basketball game crowd comng out of the school and the fact that t really took a short perod of tme for that

8 amount of traffc to dsperse There would also be the addtonal expendture of by them to try and satsfy the wshes of the Town of Wappnger by not gong along wth the approved access across from Fenmore Drve but rather gong down the road and acqurng land from the Humestons As far as nose there would u usage be no nose assocated wth the buldng t would be dry offce Polluton of the aqufer should cause no problem the fact that a buldng s over the aqufer does not mean necessarly that there should be a problem wth t Ths he sad was on record wth correspondence wth the state and they are dong t on ther present ste e way t has been engneered wll cause no mpact to the envronment ther research has shown that t wll not create a problem aqufer They would have to be rotten neghbors to pollute the A complete Envronmental mpact Study had been done whch does address n detal the queston of the aqufer As far as wetlan s are concerned the extent of the flood plan s actually off of that property t belongs to the DWS property whch s j t Cranberry Hlls l Mr Wllam Rohde Engneer wth the frm of Hayward and pakn then spoke and noted that ths localzed aqufer was not connected to the two man aqufers n Wappnger Sprout Creek and wappnger Creek ths s an solated aqufer located between Myers Corners Road and Wdmer Road A telephone survey of local offcals n Dutchess County ncludng the Plannng Department Health Depart ment New York state Department of Transportaton the Sol Con servaton Dstrct and others to ascertan f there were any cases of aqufer contamnaton n Dutchess County and they were assured that there were no such cases n a complex su as the one planned nda Carman 8 Fenmore Drve presented a petton wth over 00 sgnatures aganst the proposed rezonng of the Cornell Drake J property from resdental to offce research They were opposed because of the ncrease n traffc whch would occur and the fact that the area contans a wet aqufer and a wetland whch s vtal to the Townls water resources She also remnded the Board of Artcle Secton 08 of the zonng Ordnance whch purpose s to prevent the polluton of water sources and wetland and safe guard the water table

9 Mr Johnston then addressed the publc and sad he would be happy to meet wth a group of nterested people at any tme no matter how many 0 or 00 and go nto further detal wth them Ths hearng dd not have to be the only tme they could get nformaton and speak ther pece They wanted to show the people what they ntended to do so that the causes they gave for beng aganst t would not exst Benjamn Kaufman 6 sachson Place heard a lot of talk tonght about mnmzng the nconvenence that they have wth the roads and talk about no problem wth the aqufers but what bothers hm s that they have no usage rght now they want to buld a buldng but do not know what buldng or for whom t would be bult or why He saw no advantage to rezonng t rght now f t s gong tojust st Why not wat to rezone untl you have a plan to show us what you are buldng and who wll be occupyng the buldng Mr else Johnston repled that he could not wat he would go someplace he does have plan but could not tell them all of hs plans t was not n hs best nterests he sad to spend thousands of dollars n acqurng the property gettng t rezoned and flyng from Vermont several tmes f he dd not have a specfc plan n mnd Furthermore he went on he had shown a plan a drawng had been exhbted and they know exactly what t s gong to be the fact that there sn t a bllboard wth a name on the front s mmateral the use s for offces and t wll be used wth all restrctons Mr Dck Bckerton Prmrose Court asked f the Town Board would enforce the codes f ths s passed he then brought up the subject of the trees n hs subdvson whch was supposed to be planted on each lot He was remnded that the TOwn Board attempted to use whatever leverage they could but acceded to what the people wanted and accepted the roads wthout the requrement of the trees beng planted ths however was the wsh of the resdents n that subdvson Next tme they would treat t dfferently Mr ef Jensen 46 Wdmer Road was for the proposal and asked f they had compared the dfference f homes were bult wth drveways and land coverage wth ther complex He felt the Town needed ths type of complex t was no burden to the taxpayers

10 they would not get servces from the Town t would help the water and sewer dstrcts fnancally there are many safeguards under the new Zonng Ordnance n ths Town aganst anythng gong amss and there were many developers who dd not want to buld homes n the Town of Wappnger due to the restrctve Ordnance Jeannette Ftch 4 Rosewood Court dsagreed wth the prevous speaker t would lower the value of ther homes t s a nce resdental area now the buldngs wll smother t out defntely aganst the rezonng Wllam Gndel Town of Poughkeepse one of the abbtte s to Four Felds Road orgnal owner and developer of the road untl t was sold to Cornell and Drake he stll has one acre and wondered what wll become of the road t was ntended to eventu ally become a Town road wll t be a prvate road wll the resdents have to plow the road can hs lot get a buldng permt on a prvate road were some of hs questons Ths he was told was a matter for the zonng Board however the developer has sad u they were wllng to dedcate the road to the homeowners or to the Town f t were dedcated to the Town t would have to be brought up to Town specs and the developer was asked f he was wllng to do ths Mr Johnston then stated that at an earler meetng that evenng wth resdents some of them felt ths was not a good dea when the suggeston was brought up he was wllng to cooperate wth the homeowners on that road The meet g that he spoke of had nothng to do wth the Town Board they dd not call t and had nothng to do wth t Mr Johnston stated that what ever was done concernng ths road had to satsfy all partes concerned The resdents there have to be happy the frst step on the part of the developer s to gve up usage of ths road and they are wllng to do ths beyond that s somethng that wll have to be worked out to the satsfacton of the resdents and the Town offcals There s no lmt on how far they are wllng to go Mr Dehl commented that Mr Johnston had prevously stated that they would do most anythng to satsfy the homeowners of that road Mr Versace ponted out that any restrctons the Town Board wshed

11 g to be put on ths rezonng should be ncluded n the resoluton before t was referred to the Plannng Board and n addton they would put the normal restrctons on ther referral back to the Town Board Mr Johnston would not be bound by anythng that was sad tonght t must be offcally ncluded n all reso lutons and notces Benjamn Kaufman was curous about the sewer system what do they ntend to do Mr Johnston answered that t would not be dsposed of on sght He compared a subdvson versus an offce complex of that sght wth approxmately 700 employees whch would generate gallons per day 50 lot subdvson 400 gallons per day whch whch would total per day for sewage The complex would use the Town sewer system subject to recommendaton and approval of the Engneer f a favorable recommendaton does not corne forth they would own a nce pece of property wth no place to put the sewage Henry Semp All Angels Hll Road then asked Mr Johnston f he ddn t get the rezonng wou he pullout and where would he go would he stay n the area he then suggested Rt 376 whch was under utlzed Why he asked was everythng beng concentrated on Myers Corners Road Mr Johnston answered that when they frst located on Myers Corners Road t was the deal st uaton t was zoned for ther use and had water and sewer facltes and the land n back of the present structure would be deal f they could acqure t as t was contguous to the frst parcel and they felt t would be a success Jonah Sherman Myers Corners Road Four Felds Pzzagall s buldng a 20 mllon dollar structure whch s an asset to the taxpayers of the Town of wappnger and rezonng the addtonal parcel may also be an asset but that s not where t stops He lstened to Mr Jensen talkng about the beautful zonng Ordn ance the Town adopted but he says what for why have one f every tme someone wants to make a buck we change the zonng to sut ther needs n ths case we have unusual crcumstances we have a handsome buldng a well regarded developer wth a mysterous plant who may be nterested n gong nto an offce

12 buldng n a 30 acre parcel and he could see ths favorably as long as there are a number of guarantees and benefts locked n What troubles hm s the Town Councl s atttude about further rezonng t s lke a cancer one lttle spot here and another one there there s Humeston s property and Desng s property and 5 acres at the corner of Myers Corners Road and All Angels Hll Road wth a sgn up for sale Wha twould go there would t be housng or s the Town Board gong to rezone that as well He could easly fnd hs way to endorsng Mr Johnston s request wth restrctons to rezone ths property but he could not easly go along wth the precedence ths mght be settng The area has struggled for 5 years to restrct commercal development but he sees t startng to sway and he doesn t thnk he wants that knd of development to contnue on Myers Corners Road He was thnkng about the ntersecton at All Angels Hll Road wth the traffc problem and the fact that the Engne Company s there and what mpact wll t have on Cranberry Hll a major proposed housng development f they are gong to be drawng over gallons of water a day there should be some knd of guarantee for those who do not have the prvlege of havng Town water that they wll have suffcent water He gave hs support on the present buldng because he felt t was rght for the area but he has questons on the one they are now plannng He concluded by sayng wll Myers Corners Road be another Route 9 Mr Jensen reterated that the wordng of the new Zonng Ordnance put a lot of teeth nto zonng laws and how they effectuate a development You cannot close the door on rezonng each request must be consdered 7 many years ago when the present buldng was u rezoned P everyone was aganst t yet after the XYZ buldng was put there we had no problems and t has helped the tax base The County taxes have now rsen consderably and the Town of Wappnger keeps tryng to hold ther taxes down and ths rezonng would help f the plan was wrong he would not want to see t there that s why he asked f a comparson had been made wth a possble subdvson on that parcel The road wll be wdened

13 p not because of Pzzagall but because t s part of ther long range plan and gradually safeness wll be accomplshed because of ths plan ths s an opportunty for the Town He remnded Mr Sherman that he was n the Economc Development Corp for the County and not that much busness has corne nto the County for the last few years now here s an opportunty to brng a project nto the Town to help offset the taxes Mr Johnston added hs comments to ths reasonng by sayng that he would hate to have the merts of ths project judged solely by the number of dollar blls they contrbute although that s a good pont but long range t has to make sense That wll not do anythng to make people feel happy over what havoc t wll cause wth traffc polluton or what t wll look lke They are wllng to take the tme to make sure that what they buld wll be attractve wth qualty wthout polluton and wll ncdentally contrbute tax dollars Mr Sherman reterated that the EDC of whch he was a member and whch was approved by the varous Town Boards and supported by the Chamber of Commerce brought n some 25 mllon dollars n constructon n the County n the last two years What he was tryng to address was ths was a very unque company dong a very unque job he could remember not too long ago when the Town Board was tryng to put n a roller skatng rnk n the same place when they were so hungry for tax revenue ths must meet the total nterest of the Town not just one very narrow nterest That s hs concern are they gong to get so hungry that they wll keep rezonng and then the atttude wll be negatve on everythng Benjamn Kaufman felt the Town Board has an oblgaton to the people already there he carne up from the cty and thought he was really n the country all green He was afrad t would turn nto an area where hs kds couldn t play on the street would be full of traffc too much densty of populaton t too much ndustry and that s not the reason he moved to wappnger he mght have to sell hs house and move out further and he would hate to do that Renata Ballard Hlltop Drve concerned about the traffc flow

14 at Myers Corners Road and All Angels Hll Road snce all the developments come down through that ntersecton and the traffc now s gettng horrendous and the buldng sn t completed yet referrng to the frst buldng and s not occuped and they yet to see the mpact that wll have on that ntersecton Her queston was why rezone now why not wat to see the mpact of the frst buldng and how t s handled as far as the mpact study wden ng the road traffc lghts mprovng the road makng t a three lane for four lane road or whatever Would the Board consder ths Mr Johnston noted that the frst buldng was to be completed n July and they would see the mpact before they were ready to pro ceed wth the new buldng there were many steps to be taken before they would be ready to go ahead Mrs Ballard argued that they could come to the Board after the frst buldng was occuped and ask for ths rezonng and then could pont out how well the stuaton had been handled problems had been handled they could then llustrate how the She asked hm to consder t and Mr Johnston answered that they already had No one else spoke MRS MS moved to close the Publc Hearng seconded by Mr Johnson and unanmously carred The Hearng closed at 8 24 P M J Elane H Snowden Town Clerk P H Cornell Drake Rezonng
