Thompson Attorney-At-Law Cookeville, TN State Tax $16.00 Probate Fee.15 $16.15 For the consideration of the sum of sixteen thousand dollars, paid and to be paid as follows: $ cash in hand paid, the receipt whereof is hereby acknowledged, and the balance to be paid as follows: $ to be paid January 1 st 1921; $ to be paid January 1 st 1922; and $ to be paid January 1 st 1923, all of which deferred payments are evidenced by notes of even date herewith, and a lien is hereby retained on the property herein conveyed to secure said three notes according to the terms thereof, we, R.F. Maxwell and wife, C.D. Maxwell, have this day bargained and sold and do hereby transfer and convey unto Virgil T. Denny, his heirs and assigns, the following tract or parcel of land, in the 11 th Civil District of Putnam County, Tennessee, and described as follows: Beginning on a stone, formerly a buckeye and white oak, Allen Young s beginning corner, running thence north 54 poles to a sugar tree and lynn, thence west about 108 poles to the buckeye, an agreed corner recently established between us and Virgil Denny, about 40 or 50 yards east of the horn beam corner in the old line, thence north 24 degrees west 20 poles with said agreed line to a stake in Indian Creek with sycamore pointer, thence down the creek, southwestward, with the meanders of said creek to a stake in the mill pond, being the southwest corner of the 25 acre tract sold by J.N. Maddux to J.W. Sutton, and a corner of the tract now owned by E.H. Maxwell s east boundary line, thence north with said line to the beginning, containing 164 1/2 acres, more or less. Including and excluding an old graveyard, known as the Young graveyard, now enclosed by a stone wall, containing about one half acre, also another strip on the north side of said graveyard about 20 ft. wide and the same width of the old graveyard, both of which are here excluded from this conveyance. This being the lands conveyed to us in five different tracts by deeds which are the last conveyances to this tract, and are recorded in the Putnam County, Tennessee, Register s Office, as follows: Book N page 493 et seq; Book N page 491 et seq; Book Z page 61; Book Z page 62-3; Book 11 page 135; and an agreement recently registered, all of which are here referred to for their contents. To have and to hold all the estate, title and interest in and to said tract of land, with the appurtenances thereto belonging, to the said Virgil T. Denny, his heirs and assigns. We covenant with the said Denny that we are lawfully seized and possessed of said tract of land, have a good right to convey it, and that the same is unencumbered. We further agree and bind ourselves, heirs and legal representatives to warrant and forever defend the title to said land to the said Virgil T. Denny, his heirs and assigns, against the lawful claims of all persons whomsoever. But we are to retain the possession, and have the use of said land until January 1 st Witness our signatures, this August 12, 1919.
