1 FILLMORE CITY COUNCIL MEETING October 2, 2012 Minutes of the regular meeting of the Fillmore City Council held October 2, 2012 in the Council Chambers of the Fillmore City Building. Notice of the time and place of the meeting was posted on the Utah State Public Notice website, the Fillmore City website, the Council Chambers, the City Office bulletin board, and the President Millard Fillmore Library. Notice was also provided to The Chronicle-Progress, KNAK and KMTI radio stations, and to each member of the governing body on September 28, Those present were: Mayor: Eugene R. Morris Burton, Commissioner Bart Whatcott, Larry Peterson, Daniel Rowley 6:30 p.m. Welcome and Pledge of Allegiance - Mayor Larsen ADMINISTRATIVE BUSINESS Minutes MOTION: To approve the minutes of the regular meeting held September 18, 2012 as corrected. By: Councilmember Huntsman Second: Councilmember Jackson Vote: Unanimous. Motion carried. Bills - Payroll MOTION: To approve the September 30, 2012 payroll and payment of the bills listed on the October 2, 2012 invoice register. By: Councilmember Oeppinger Second: Councilmember Jenson Vote: Unanimous. Motion carried. Building Permits Larry Paxton for a RV storage shed at 110 Canyon Road Wayne Jackson for a trailer cover at 45 West 200 North COMMUNICATIONS AND REQUESTS Law Enforcement Report Lt. Morris Burton distributed the law enforcement statistics for August. There was one accident, 5 citations for 8 violations, 121 CAD calls, and 81 incidents resulting in 16 arrests for 35 violations. 10/02/2012 city council minutes Page 1 of 6

2 A door-to-door salesman was cited for doing business in Fillmore without a license. A break-in at Sun Gro triggered a security alarm. Many residential alarms are set off by mistake but it is better to respond to a false alarm than overlook a serious problem. Lt. Burton was unaware of a law enforcement issue at the football field until he read about it in the paper. The case is being handled by a Herriman judge. Fire Department Report Chief Darren Brunson did not attend the meeting. Millard County Commission Report Commissioner Bart Whatcott said that the planning meeting for the new soccer field was productive. He proposed that a seven member volunteer committee be created to oversee the soccer field construction and operations. He suggested there be a representative from the city, the county, and the school board, and the other four members selected from special interest groups that want to be involved. He listed several names for consideration. Once organized, the committee would apply for a C exempt status to operate as a non-profit organization. He wanted council s permission to start leveling the field as soon as the county equipment and personnel are available. Fill dirt will be needed. The school district will donate water shares and some 4 inch PVC pipe. Whenever possible, supplies and materials will be purchased locally. Volunteers can be used for trenching and installing the sprinkler system. Some companies will design the watering system if their products are used. Part of the work could be done through Eagle Scout projects. Initial funding for construction and operations will have to come from Millard County and Fillmore City; maybe the school district would help. In a couple of years tournament revenues would generate enough for maintenance and operations. REAL of Salt Lake (professional soccer team) has expressed an interest in helping but needs a formal plan before pledging any money. Commissioner Whatcott and Councilmember Holt will work together to draft a plan and job descriptions; perhaps Attorney Greathouse would be willing to prepare the C application once the committee is organized. An agreement needs to be drafted to define the expectations and guarantee the contributions of each entity. Commissioner Whatcott wants a unified effort and hopes the three entities will work together and not separately, to provide opportunity for the youth and stimulate the local economy. It was clarified that Fillmore City will retain ownership of the land. Insurance and liability issues were discussed. It was suggested that the restrooms and concession stand could be built with volunteer labor. 10/02/2012 city council minutes Page 2 of 6

3 The Commissioner concluded by saying if we build it they will come. Soccer is the fastest growing sport in the world, building the fields will be good for everyone. BUSINESS Discussion of Proposed Soccer Fields Two regulation soccer fields will require 7.4 acres. Attorney Greathouse said there would be risk to the city if someone were injured; county workers and equipment are covered on the county policy but volunteers are not. Mr. Greathouse advised that once the non-profit group is organized it should secure insurance for volunteers; responsibility for the insurance must be clearly defined. The donated labor won t be utilized until spring; the agreements and insurance issues should be resolved before then. Motion carried COUNCIL REPORTS Councilmember Jenson Airport The contractors will start applying slurry seal on the runway tomorrow. Sewer The lines in the industrial park area have been cleaned. Water Water levels have dropped, fall storms are needed to replenish aquifers. Historic Preservation Peggy Christensen is painting a mural on the side of a Main Street building that will depict historical things pertaining to Fillmore. She would like the city to help pay for the paint. The Utah Natural Hazards Workshop was held in Salt Lake on September Mr. Jenson found it to be interesting and educational. Hillside subdivision development can create serious drainage issues. Councilmember Jackson Mr. Jackson had nothing to report on his assigned departments. He thanked Councilmember Holt for having the city public works crew finish the Ashurst sidewalk after an Eagle Scout Project fell through. 4 Councilmember Huntsman Planning & Zoning The commissioners are concerned that goat head weeds are getting out of control along the city streets and wondered when the city would be spraying again. Councilmember Holt will talk to Ross Cummings about it. TDFI has not met the conditions of the Conditional Use Permit. Following a site inspection and discussion of the unmet conditions, the planning commission tabled the matter until Attorney Greathouse can meet with Zoning Administrator Lisa Crosland to discuss the matter. The Department of Environmental Quality report needs to be reviewed before any decisions are made. The commission reviewed the Residential Development section of the Fillmore City General Plan and agreed it meets the needs of the city as written and does not need to be amended. Emergency evacuation for chemical spills is another concern. It was noted that Forrest Roper is over hazmat operations in Millard County and has certified people throughout the county. Cemetery The order for the pioneer monuments was placed several weeks ago. American Monument has not indicated when the markers will be ready. Mrs. Huntsman would like to have some set before winter. Economic Development According to Dan Davies, Black Dirt has some big contracts for its potent liquid fertilizer. Four thousand gallon jugs of the product were filled manually for Target and Costco. The company has contracts for another 250,000 gallons. For the past five years Black Dirt has been leasing 26 acres in the industrial park. Now it is becoming a viable business and needs a building and equipment. Councilmember Oeppinger Celebrations The American Legion Hall has been reserved for the Christmas lighting celebration. There will be a parade, hay rides, refreshments, and the sixth grade choir will provide entertainment. Activities will be correlated with Ross Cummings. Doug Jolley received an from Denmark. The people just happened to be staying at the Best Western during the Arts Festival and were delighted to find such a wonderful celebration going on. The cancer relays throughout the state raised over $7,000 this year. The Millard County race will be held in Fillmore again next year. Community Events Millard High track coach Cody Moat took first place in the 27 mile obstacle course Spartan race in Vermont. There needs to be more cultural events in the community. Mrs. Oeppinger is still interested in promoting summer concerts for the North Park amphitheater. 10/02/2012 city council minutes Page 4 of 6

5 Animal Control It has been a chaotic few weeks in the animal control department. An injured dog was rescued from an intersection and taken to the vet. It was saved and is now available for adoption. Library The quarterly library board meeting will be held this month. A Halloween spooky story hour is being planned. Councilmember Holt Parks There are still four park benches that could be set as Eagle Scout Projects. They could be put at the Wildlife Park or the Blue Star Park. Attorney Greathouse The non-use water right application for the Christensen farm water right has been approved and will be valid through Attorney Greathouse suggested that the city take the water right out of non-use and prove up on it. An engineering firm will be needed and he suggested Wall Engineering since Wall has worked on this water right in the past. Mr. Greathouse is working on the ordinance for selling city property. He will meet with Lisa Crosland before finalizing the draft. He advised the council to give careful thought to the soccer field. He offered two options: (1) work with the other entities, but have one take charge of running it and the other two pay their share; or (2) have the non-profit organization run it. Fillmore could lease the property to the non-profit group to operate and maintain but the city could help get it going and have priority on scheduling. Millard County has agreed to level the ground and provide some seed money. The council needs to decide what to do. The three entities together should choose the committee members and retain the power to remove them. The deed for part of the east portion of 500 South should be done in about three weeks. Mayor Larsen Rhinehart Oil is buying 32 acres at the south I-15 interchange. Stan Jardine, president of the company, has arranged with Carling and Company for the excavation work. When the sale is finalized he will file for annexation. The expanded hours of operation for Staker Parsons are over and the freeway project is winding down. The company has already swept the roads. The 100 North electric transmission line is finished, there was a short power outage while the new line was put into service. Tree trimming for electric line interference is done every 2 years. It is time to do it again. Penny Tree Service did an excellent job last time and saved the city more than 50%. They work hard and fast. 10/02/2012 city council minutes Page 5 of 6

6 It was noted that a beautiful umbrella tree hangs over the road on at 500 South Canyon Road. Drivers have to veer into the middle of the road to keep the tree from hitting their cars.
