1 Warren, Ohio M I N U T E S REGULAR MEETING WARREN CITY COUNCIL January 11, 2012 CALL TO ORDER The regular meeting of Warren City Council was called to order by President of Council Bob Dean in Warren City Council Chambers at 7:30 PM, 141 South St. SE, Warren, Ohio. INVOCATION/PLEDGE Fiore Dippolito, 1 st Ward Councilman opened the meeting with prayer followed by the Pledge of Allegiance. FRANKLIN: Thank you. And Happy New Year to everybody and we look forward to everything that this new year is going to bring. Just a short report this evening. Back in the back, Paul Makosky was talking about the Parkman Road project. I would also like to expand on another project that just came to my attention. By his hard work in his department the Warren Boulevard Bridge Project is scheduled for this spring. It s a 1.7 million dollar project and the local share is zero. So thanks Paul for all of your help. And I know there will be some re-routing that s going to go with that project and more of those details will be forth coming as we near the project. Also, I would like to commend the Health Department who had a the state performed an audit of our Food Service Program. And that s a pretty intense audit. This project is administered by Mark Roberts; the Food Programs Coordinator and the audit is performed every three years and our Health Department had no violations; which is a real rarity in that business and received an outstanding report. So congratulations Bob. 1

2 Also, I d like for Council and the public if you could to attend the meeting tomorrow night. And it s very important. It s a public hearing on Warren s Waste Water Permit Renewal Application. That s tomorrow night at 6:00 PM at Warren G. Harding. The result of that hearing could have a profound affect on the City of Warren s waste water rates and also job retention and economic development. So it s very important and I would urge all to attend and make statements. And we have some fact reports and some notes and talking points if you need those. Thank you Mr. President. LAW DIRECTOR TREASURER MR. HICKS: Thank you Mrs. President. First let me welcome our new members, our new Director and those of you that have changed seats. I welcome all of you. No report this evening. Looking forward to working with our new Mayor Franklin. We ve been together now for twenty something years. MAYOR FRANKLIN: Twenty-two. MR. HICKS: Yeah. Wow, I was a lot younger then. Thank you. AUDITOR TREASURER DIRECTOR MR. GRIFFING: Thank you Mr. President. I d like to inform everyone; especially the Department Heads that we ll be completing our process of closing 2011 tomorrow. And we should be having the 2012 budget available for you to start encumbering funds the first of the week. Thank you Mr. President. MR. HOMLITAS: Thank you Mr. President just a recap; last years tax collection you ll remember that our budgeted collection amount was sixteen million one hundred thousand dollars. We collected in taxes seventeen million one hundred and seventy-seven thousand dollars; a just under sever percent increase of what we were expected to collect. And that money went into the general fund. If any of the Council folks would like a monthly recap of the collections please me with their address at my city address. We want to make sure that you get a monthly recap. Thank you. MR. CANTALAMESSA: Thank you Mr. President. Just a short report this evening. But before I start with that I d like to publicly and personally thank newly elected Mayor Doug Franklin for his trust and confidence in his recent Safety Service Director appointment. Moving forward I d like to take this opportunity to convey distinction, thanks and appreciation to Chief Bowers in the Police Department. As many of you already know and read in the news paper earlier this week or have seen on various media outlets earlier this week there was a standoff situation where a gentleman locked himself in his residence and Warren Police were first to deal with the situation as it were. Specifically the situation lasted slightly over six hours and the negotiations were handled resulting with no shots fired, no injuries, no harm to the public. And I d like to particularly thank Sgt. Cole and Patrolman Hipple who conducted those negotiations. In addition Patrolman Edwards and Holmes were also in assistance during the situation on the perimeter of the residence making sure that further escalation did not occur. Overall I d like to convey my thanks on behalf of the City of Warren to the entire shift of the Warren Police Department that handled that crisis and resolved it without incident. Thank you Chief. Draft 3169 is now ORD /12. MISCELLANEOUS MR. DIPPOLITO: Thank you Mr. President. No to long ago we spoke about big happenings over in the northwest side. It so happens we had what three shall we say Dollar Stores. Well low and behold it looks like we might have three of those stores within a half a mile of each other. So very shortly; I haven t seen any buildings started yet. But apparently that s what might be happening. Thank you Mr. President. MR. NOVAK: Yes, thank you Mr. President. If you ll bare with me I don t have much of a voice. I picked up this plague. I don t know what it is. My mother use to call it the croup. I don t know where that name every came from. I would just like to at this time welcome the new Mayor. It s been a pleasure serving with you in all of your capacities; through Ward Councilman, to At Large, to President during your terms on Council. And I have the utmost support for you and confidence in you being our Mayor. And I also welcome the new Safety Service Director. I do not know you very well, but I knew your father. And I knew your dad was a man of drive and a person that intended to always be successful in whatever he intended to do. So I m sure you re a chip off the old block. I d also like to congratulate and welcome our new Council President in place here in Warren City Council and I would also like to welcome our new Council Members. And one other small issue. I know that there s a very big issue and it seems to be very big in the news concerning the massage parlors. I think what I would hope that we could see in the near future, knowing what takes place with businesses where there are questionable practices, I would hope that we could 9

10 see that we would have some federal intervention involved in these facilities. I would hope that the possibility of the Rico Act could be enacted or an investigation for this. Because what we must remember everyone of these facilities there s an individual who holds the license that operates this facility. If there isn t someone to hold that license it can t operate. I think there is a trail there a paper trail. There s also a trail of a substantial amount of money. And I would hope that we could have some help from our federal people, our state people and these can be investigated and this can come to a conclusion exactly what takes place. And I understand the many, many peoples concern about the way the public perceives the City of Warren with having these many facilities in the city. But what we must remember, keep this in mind, other cities that do not have massage parlors have gentlemen s clubs. So you must realize this ok that you might not have one but you re going to have the other and neither carry a very good reputation. And I don t think either is what we want any in the City of Warren. So hopefully we may see something from our federal people. I m hoping and praying for it. Thank you Mr. President. MR. BROWN: Thank you Mr. President. First I would just like to welcome all of the new officials of the City of Warren. Secondly I d just like to reiterate Mayor Franklin s remarks about the 6:00 meeting tomorrow at Warren G. Harding. It is very important to the City of Warren and also to many of the businesses that are in the City of Warren and just on our outskirts; Thomas Steel, the Warren Water Treatment Plant, the former WCI Plant. The list goes on and on and on. This meeting has to do with public comments to the EPA on the possible further restrictions of the allowable TDS(total dissolved solids) that go into the river. That number can be very arbitrary; it s all over the map. I think that a lot of the businesses and certainly the city do a very good job at trying to regulate what goes into our river. And you can see a far cleaner river than in the days when we were kids. But it s very important to the city. It could have broad ranging implications. I went down to a public utilities meeting along with Councilman Colbert in Youngstown this evening. It had to do with the injection wells and happen to run into the President of Patriot Water down there; Andy Blocksum. He asked that anyone; especially any members of the city or Council or any public at large attend that meeting and express your opinions to the EPA; because it s very important to the life blood of this city. To the lady from Bristolville I would recommend that you contact your State Senator, you State Representatives. Those are the people that have taken away Home Rule from us in gas and oil. Our hands are pretty much tied anymore. And one thing that was interesting from this public utilities meeting at Youngstown the injection wells as we are also a dumping ground for construction debris from New Jersey, New York and other states on the eastern seaboard. We are now a destination for the salt brine water, the fracking water. Fifty-six percent of the water that goes into the one hundred and sixty-four injection wells in Ohio comes from out of state. More than half of that water is from out of state. So it is a very big issue. And again, I wish we had home rule on that so that we could say no injection wells within our city boundaries. But if you could tomorrow night please come attend that Ohio EPA meeting. Once again at 6:00 at Warren G. Harding. Thank you. 10

11 MR. BARTHOLOMEW: MR. FLASK: Thank you Mr. President. I d just like to say I d like to thank everybody that made this transition for me; it s my first real job in fifteen years very smooth. Some of you I met yet are just on a limited basis and I really look forward to working with everybody in the future. And I ve already answered quite a few phone calls the first week on the job. And I can tell the next two years like Mr. Novak had said previously, I haven t been sworn at yet. I ve been sworn in. But hopefully the swearing doesn t start anytime soon. I ve enjoyed my first week on the job. Thank you Mr. President. Thank you Mr. President. I ll refrain my comments to Mr. Bartholomew so somebody else will have the first pleasure. I too am going to speak real quickly on the meeting tomorrow night. This meeting tomorrow night is more important than I think any of us realize. It is also there s a direct link to this meeting tomorrow night through business, through fracking, through deep well injection, through all of it; and Patriot and the businesses trying to operate within the city limits. There is a link through all of it through the EPA. It is very important that we are all there. As far as the fracking goes I think there is a lot of miscommunication and a lot of misinformation in regards to fracking and deep well injection. They come from the same industry but two totally different things. And I think it s very important that we all; and not just Warren, but in Trumbull County learn the difference between them and what it means for us as property owners and elected officials. At this time there are no permits issued in Trumbull County for a well or a drilling fracking well. There are reasons why things are happening at this injection site that is causing it to happen. It s not happening at other injection sites. And tomorrow night I think we will find out a lot of that information as to why. So again, I will encourage everybody to be there. Thank you. MISS SAFFOLD: Thank you Mr. President. I too am enthused about having out two new members of Council onboard, our new President of Council, our new Safety Service Director and of course our new Mayor. I would like to thank the Operations Department for their wonderful job of snow removal last week. I road around the city and our streets were done impeccably. So I would like to thank them. And also I would like to thank our Fire Department and Chief Nussle. There was a fire around the corner from my house the other day and you all were there and took care of the situation. So thank you. MR. COLBERT: Thank you Mr. President. I just wanted to reiterate. I spoke with Mr. Valesky as well as Mr. Bartholomew. It is a pleasure to be able to serve with you guys. I wish you the best of luck. And to our new Safety Service Director; I had the opportunity to meet with the Safety Service Director as well as the Mayor last week(inaudible) family restaurant in the past and I know him from there. But he s very open minded and he s got ideas, he has a legal background and the city is very luck to have him in that position. 11

12 And obviously our new Mayor (inaudible) but just to say it again, we are very proud the career that he s had and been able to accomplish and look forward to serving with you Mr. Mayor. As well as our new President. I wish you the best of luck and congratulations on your appointment. Thank you. MR. VALESKY: Thank you Mr. President. I would like to continue congratulations. 4 th Ward Councilman; Greg Bartholomew congratulations on your appointment your election. Mr. Dean, President of Councilman congratulations to you. Mr. Cantalamessa congratulations to you. And my friend Mr. Doug Franklin; you will make a great Mayor. I just know you will. So congratulations to all of you. To my colleagues, I want to say to you it s an honor and I m deeply humbled to be in your presence and I look forward to working with all of you. And most important to the citizens of Warren, Ohio. It s a privilege to sit here to represent you. And God willing the next two years I will do the very best I can to make that come true. Thank you very much. MR. SFERRA: MRS. RUCKER: Thank you. I d like to welcome the new members here. And I d just say that I caught myself. I called the Mayor Doug and I know I can t do that anymore. But I met with Mr. Cantalamessa this week and I think you made a wise choice. I think he ll be a good Safety Director. If not he makes the best damn spaghetti. Whatever else happens you re my guy (inaudible). Thank you very much. Thank you Mr. President. I also would like to echo the sentiments of my colleagues and welcome the new Council Members. I feel like you ve already been on board. We ve already had your initiation (inaudible) So I look forward to that. And I wish the best to our President, our new Mayor and our new Safety Service Director. And I d just like to report to this body that Cheryl Saffold and I met with the Civil Service Commission January 4 th and we had a very informative meeting with them. Buy following that meeting we met with the Mayor and Chief Bowers and Jeff Cole and that was so fruitful. The Mayor went back and forth and I believe and I know in his heart that the goal was for us to all leave that room with a win-win. And that s exactly what happened. And I left feeling very good about the future of our Police and our Fire Departments. And so I want to thank you for pulling it all together and coming up with a plan of action to set forth a task force. And so I look forward to that. I would like to ask the Mayor if Council will be meeting with Mr. Tom Angelo. Because while I m looking forward to going to the meeting tomorrow, but I have questions concerning the department in relation to all of this fracking and hauling and all of the other concepts. So I d like for him to possibly meet with us as soon as possible so we can have some dialog on our equipment and what ever concerns that we may have about it. And lastly, I look forward to our new year with the neighborhood groups. I think they were very fruitful in the past and I look forward to the direction that they re going to lead the city this year. And so I 12

13 know they ve probably had elections among themselves also. So we ll probably be meeting new presidents within those groups. Thank you Mr. President. MAYOR FRANKLIN: DIRECTOR CANTALAMESSA: Just a few comments. And I promise I ll be brief. I m glad that you brought that up. I believe Tom Angelo, the Director excuse him. I believe he s out of town. That s correct Mr. Mayor. Director Angelo contacted me this afternoon Councilwoman Rucker and in light of his coarse involvement with the issues surrounding the total dissolved solids issues that are going to be discussed at tomorrows public comment hearing asked to be excused from this meeting this evening; particularly because these are specifically the types of issues that were being discussed this evening at YSU; which I believe Councilman Colbert and Councilman Brown attended briefly if not completely. As is in the case typically the few limited occasions that I ve seen Mr. Angelo speak on the subject most recently yesterday at a free rally if you will for tomorrows hearing he is bombarded with questions as you can imagine following these types of events asking for specific information as well as to away fears in some circumstances. So your request is well founded. I will make absolutely certain I speak with Director Angelo tomorrow and make him available to this body. MAYOR FRANKLIN: Thank you Mr. Cantalamessa. We will try to have fact sheets and talking points available for Council Members. And I can t emphasize enough; and I m glad Councilman Brown and Councilman Flask talked about it how important this is. Councilman Flask talked about the connections in terms of economic development, the job creation, job retention. All of this is hinged upon the outcome of what the EPA decides those limits will be. And I d like to say on another connection that wasn t mentioned our sewer rates. During all of that we ll have to keep an eye on we just right sized our sewer rates. Now we have another issue that regulators are coming in and putting another twist in that; something that we ve already fixed. So I m very concerned about it. I think we need all of our energy at tomorrows hearing. Also, I d like to congratulate Councilman Colbert; new President Pro- Tem. Thank you Mr. President. PRESIDENT DEAN: Thank you Mr. Mayor. Just a quickie. Some of you may have seen a news item last evening that the blind gentleman and his family. There was a Braille machine stolen. Right after that news item at 11:10 I had a phone call saying I have a Braille machine I d like to give the family. Chief Bower in my police training said just don t run to some body whose giving you something. So I met him at the Police Station here last night at 11:30. And as it turned out this is a Vietnam Veteran who had died and left this Braille machine in his will and said to give to another blind person. And it just so happen that we took the Braille machine over to Marie and Matt yesterday and it just happen to be the exact same kind of machine that he had used and was stolen. So thanks. 13

14 MAYOR FRANKLIN: Thank you Mr. President. I believe it s a Mayor s disease to want to talk a lot. Before we close I would like to ask everybody sincerely pray for Chief Mandopoulos and his family.
