1 Last Will & Testament and Sale Bill Estate of Harbert King, Sr. ( ) Lincoln County, Kentucky Transcribed and researched by Tad D. Campbell Gilroy, California 2010
2 Lincoln County, Kentucky, Will Book Q, pp [Family History Library Microfilm ] In the name of God Amen, I Harburt[sic] King Sen. of Lincoln County Kentucky, being of sound mind and disposing memory, but calling to mind the uncertain time of this life do make ordain and publish this my last will and Testament. Item 1 st It is my will and desire that my wife Polly King have the use and enjoyment of all my property and estate which in real, personal or mixed for and during her natural life. Second, After the death of my wife Polly King it is my will and desire and I do hereby direct that all my real estate and slaves and such of my personal estate as may remain be divided into seven equal shares and distributed among my children and grand children as follows, to wit: To my daughter Adaline Hobbs and the children of born of her body I give one share or the seventh part of my estate; to my daughter Polly Lanier King, [and sons] William King, John King, Harbert King Jr. and George W. King each one share or seventh part of my estate, and the remaining share or seventh part of my estate to the children of my daughter Sally Gentry, deceased, which last named share I direct to be held in Trust by my sons William King, John King, and Harburt King Jr. whom I hereby appoint Trustees and Testamentary Guardians for the children of my daughter Sally Gentry, deceased, so far as relates to the property herein devised to them. It is expressly my wish and desire that no part of my estate should in any event pass into the hands of John B. Gentry and in case any one of the children of my daughter Sally Gentry should die without issue it is my will and desire that the share of portion herein devised to such child should pass to and be vested in the surviving children of my said daughter Sally Gentry, deceased. Some years ago I loaned to my son in law John B. Gentry a negro girl named Eliza as a nurse and took from him a written obligation to return her when called for; he has returned her to declaring and admitting that she was my lawful property, but I have understood he is asserting same claim to said girl Eliza; now in case he said Gentry should succeed in obtaining said girl or should run my estate to any expense in defending a law suit for her it is my will and desire that the value of said girl Eliza and all cost and expense be deducted and taken from the share or portion herein before devised to the children of my daughter Sally Gentry, my sons who I have named as Trustees and Guardian for the children of my daughter Sally, are required after the said estate comes into their hands, to manage it in all respects as though they were regularly Statutory Guardians. I leave to my daughter Adaline Hobbs during her life time a negro named Julia Ann, and after the death of my daughter Adaline I will and devise said slave Julia Ann and all her increase to be equally divided between the children of my said daughter Adaline, but the value of said slave Julia Ann is to be deducted and taken from the share or portion herein devised to my said daughter Adaline & her children. I wish it further understood and it is my wish and desire that in case the part I have devised to Polly Lanier King and George W. King should prove inadequate to their comfortable support and maintenance that a sufficient part of my estate set Transcribed by Tad D. Campbell, Gilroy, California

And lastly I hereby nominate, constitute and appoint my wife Polly King, Executrix and my sons William King, John King and Harbert King, Executors of this my last Will and Testament, and it is my request that my Executrix and Executors may be permitted to qualify and execute this will without giving any security.
