Justice shall be the girdle of his loins, and faithfulness the girdle of his waist. 6. The wolf shall dwell with the lamb, the leopard lie down with the kid; the calf, the beast of prey, and the fatling together, with a little boy to herd them. 7. The cow and the bear shall graze, their young shall lie down together; and the lion, like the ox, shall eat straw. 8. A babe shall play over a viper s hole, and an infant pass his hand over an adder s den. 9. In all of My sacred mount nothing evil or vile shall be done; for the land shall be filled with devotion to the LORD as water covers the sea. 3. When you approach a town to attack it, you shall offer it terms of peace. 11. If it responds peaceably and lets you in, all the people present there shall serve you at forced labor. 12. If it does not surrender to you, but would join battle with you, you shall lay siege to it; 13. And when the LORD your God delivers it into your hand, you shall put all its males to the sword. 14. You may, however, take as your booty the women, the children, the livestock, and everything in the town all its spoil and enjoy the use of the spoil of your enemy, which the LORD your God gives you. 15. Thus you shall deal with all towns that lie very far from you, towns that do not belong to nations hereabout. 16. In the towns of the latter peoples, however, which the LORD your God is giving you as a heritage, you shall not let a soul remain alive. 17. No, you must proscribe them the Hittites and the Amorites, the Canaanites and the Perizzites, the Hivites and the Jebusites as the LORD your God has commanded you, 18. Lest they lead you into doing all the abhorrent things that they have done for their gods and you stand guilty before the LORD your God. 6. And nations shall walk by your light and kings by your shining radiance. 4. Raise your eyes and look about: They have all gathered and come to you. Your sons shall be brought from afar, Your daughters like babes on shoulders. 5. As you behold, you will glow; Your heart will throb and thrill For the wealth of the sea shall pass on to you, The riches of nations shall flow to you. 6. Dust clouds of camels shall cover you, Dromedaries of Midian and Ephah. They all shall come from Sheba; They shall bear gold and frankincense, and shall herald the glories of the LORD. 7. All the flocks of Kedar shall be assembled for you, the rams of Nebaioth shall serve your needs; they shall be welcome offerings on My altar, and I will add glory to My glorious House. 8. Who are these that float like a cloud, like doves to their cotes? 9. Behold, the coastlands await me, with ships of Tarshish in the lead, to bring your sons from afar, and their silver and gold as well for the name of the LORD your God, for the Holy One of Israel, who has glorified you. 10. Aliens shall rebuild your walls, their kings shall wait upon you for in anger I struck you down, but in favor I take you back. 11. Your gates shall always stay open day and night they shall never be shut to let in the wealth of the nations, with their kings in procession. 12. For the nation or the kingdom that does not serve you shall perish; such nations shall be destroyed. 13. The majesty of Lebanon shall come to you Cypress and pine and box to adorn the site of My Sanctuary, to glorify the place where My feet rest. 14. Bowing before you, shall come the children of those who tormented you; prostrate at the soles of your feet shall be all those who reviled you; and you shall be called City of the LORD, Zion of the Holy One of Israel. 15. Whereas you have been forsaken, rejected, with none passing through, I will make you a pride everlasting, a joy for age after age. 16. You shall suck the milk of the nations, suckle at royal breasts. And you shall know that I the LORD am your Savior, I, The Mighty One of Jacob, am your Redeemer.

7 17. Instead of copper I will bring gold, instead of iron I will bring silver; instead of wood, copper; and instead of stone, iron. And I will appoint peace as your government, prosperity as your officials. 18. The cry Violence! Shall no more be heard in your land, nor Wrack and ruin! within your borders. And you shall name your walls Victory and your gates Renown. 7. Maimonides, Hilchot Melachim v'milchamot 6:1, 4, 7 א אין עושין מלחמה עם אדם בעולם, עד שקוראין לו לשלום--אחד מלחמת הרשות, ואחד מלחמת מצוה: שנאמר "כי תקרב אל עיר, להילחם עליה--וקראת אליה, לשלום" )דברים כ,י(. אם השלימו, וקיבלו שבע מצוות שנצטוו בני נוח עליהן--אין הורגין מהן נשמה; והרי הן למס, שנאמר "יהיו לך למס--ועבדוך" )דברים כ,יא(. קיבלו עליהן המס, ולא קיבלו העבדות, או שקיבלו העבדות, ולא קיבלו המס--אין שומעין להם: עד שיקבלו שניהם. War, neither a milchemet hareshut or a milchemet mitzvah, should not be waged against anyone until they are offered the opportunity of peace as Deuteronomy 20:10 states: 'When you approach a city to wage war against it, you should propose a peaceful settlement.' If the enemy accepts the offer of peace and commits itself to the fulfillment of the seven mitzvot that were commanded to Noah's descendants, none of them should be killed. Rather, they should be subjugated as ibid.:11 states: 'They shall be your subjects and serve you.' If they agree to tribute, but do not accept subjugation or if they accept subjugation, but do not agree to tribute, their offer should not be heeded. If they do not agree to a peaceful settlement, or if they agree to a peaceful settlement, but refuse to accept the seven mitzvot, war should be waged against them. All males past majority should be killed. Their money and their children should be taken as spoil, but neither women or children should be killed, as Deuteronomy 20:14 states: 'But the women and the children... take as spoil." 'The children' refer to males below the age of majority. The above applies to a milchemet hareshut fought with other nations. However, if either the seven nations or Amalek refuse to accept a peaceful settlement, not one soul of them may be left alive as ibid. 20:15-16 states: 'Do this to all the cities that...

8 are not the cities of these nations. However, from the cities of these nations... do not leave a soul alive.' Similarly, in regard to Amalek, Deuteronomy 25:19 states: 'Obliterate the memory of Amalek.' ז כשצרין על עיר לתופסה, אין מקיפין אותה מארבע רוחותיה אלא משלוש רוחותיה, ומניחין מקום לבורח, ולמי שרוצה להימלט על נפשו: שנאמר "ויצבאו, על מדיין, כאשר ציווה ה', את משה" )במדבר לא,ז(--מפי השמועה למדו, שבכך ציווהו. When a siege is placed around a city to conquer it, it should not be surrounded on all four sides, only on three. A place should be left for the inhabitants to flee and for all those who desire, to escape with their lives, as it is written Numbers 31:7: 'And they besieged Midian as God commanded Moses.' According to tradition, He commanded them to array the siege as described.

That our ancestors went down to Egypt, that we dwelt in Egypt a long time, and that the Egyptians dealt harshly with us and our ancestors. 16. We cried to the LORD and He heard our plea, and He sent a messenger who freed us from Egypt. Now we are in Kadesh, the town on the border of your territory. 17. Allow us, then, to cross your country. We will not pass through fields or vineyards, and we will not drink water from wells. We will follow the king s highway, turning off neither to the right nor to the left until we have crossed your territory. 18. But Edom answered him, You shall not pass through us, else we will go out against you with the sword. 19. We will keep to the beaten track, the Israelites said to them, and if we or our cattle drink your water, we will pay for it. We ask only for passage on foot it is but a small matter. 20. But they replied, You shall not pass through! And Edom went out against them in heavy force, strongly armed. 21. So Edom would not let Israel cross their territory, and Israel turned away from them.

Up! Set out across the wadi Arnon! See, I give into your power Sihon the Amorite, king of Heshbon, and his land. Begin the occupation: engage him in battle. 25. This day I begin to put the dread and fear of you upon the peoples everywhere under heaven, so that they shall tremble and quake because of you whenever they hear you mentioned. 26. Then I sent messengers from the wilderness of Kedemoth to King Sihon of Heshbon with an offer of peace, as follows, 47. Let me pass through your country. I will keep strictly to the highway, turning off neither to the right nor to the left. 28. What food I eat you will supply for money, and what water I drink you will furnish for money; just let me pass through 29. As the descendants of Esau who dwell in Seir did for me, and the Moabites who dwell in Ar that I may cross the Jordan into the land that the LORD our God is giving us. 30. But King Sihon of Heshbon refused to let us pass through, because the LORD had stiffened his will and hardened his heart in order to deliver him into your power as is now the case. 31. And the LORD said to me: See, I begin by placing Sihon and his land at your disposal. Begin the occupation; take possession of his land. 32. Sihon with all his men took the field against us at Jahaz, 33. And the LORD our God delivered him to us and we defeated him and his sons and all his men. 34. At that time we captured all his towns, and we doomed every town men, women, and children leaving no survivor. 35. We retained as booty only the cattle and the spoil of the cities that we captured.

AND ISRAEL SENT MESSENGERS (XXI, 21). This bears on what Scripture says: Trust in the Lord, and do good; dwell in the land, and cherish faithfulness (Ps. XXXVII, 2). It also says, Depart from evil and do good; seek peace, and pursue it (ib. XXXIV, 15). Now the Torah did not insist that we should actually go in pursuit of the commandments, but said: If a bird's nest chance to be before thee (Deut. XXII 6); If thou meet thine enemy's ox (Ex. XXIII, 4); If thou see the ass of him and that hateth thee (ib. 5); When thou beatest thine olive-tree (Deut. XXIV, 20); When thou gatherest the grapes of thy vineyard (ib. 21), When thou comest into thy neighbor's vineyard (ib. XXIII, 25). In all these cases, if they come your way you are commanded to perform the duties connected with the, but you need not go in pursuit of them. In the case of peace, however, 'seek peace' where you happen to be, 'and pursue it' if it is elsewhere. Israel in fact acted in this way. Although the Holy One, blessed be He, had said to them: Begin to possess it, and contend with in him battle (ib. Another exposition of the text, THEN SANG ISRAEL (XXI, 17). This is one of the three things said by Moses to the Holy One, blessed be He, to which the latter replied: 'You have taught Me something.' The third occasion was when the Holy One, blessed be He, said to him: 'Make war with Sihon. Even though he does not seek to interfere with you, you must open hostilities against him'; as it says, Rise ye up, take your journey, and pass over the valley of Arnon and contend with him [Sihon] in battle (Deut. II, 24). Moses, however, did not do so but, in accordance with what is written lower down, Sent messengers (ib. 26). The Holy One, blessed be He,

12 said to him: 'By your life, I shall cancel My own words and confirm yours'; as it says, When thou drawest nigh unto a city to fight against it, then proclaim peace unto it (ib. XX, 10). So that the land could not support them staying together; for their possessions were so great that they could not remain together. 7. And there was quarreling between the herdsmen of Abram s cattle and those of Lot s cattle. The Canaanites and Perizzites were then dwelling in the land. 8. Abram said to Lot, Let there be no strife between you and me, between my herdsmen and yours, for we are kinsmen. 9Is not the whole land before you? Let us separate: if you go north, I will go south; and if you go south, I will go north. 10. Lot looked about him and saw how well watered was the whole plain of the Jordan, all of it this was before the LORD had destroyed Sodom and Gomorrah all the way to Zoar, like the garden of the LORD, like the land of Egypt.

13 11. So Lot chose for himself the whole plain of the Jordan, and Lot journeyed eastward. Thus they parted from each other; 12. Abram remained in the land of Canaan, while Lot settled in the cities of the Plain, pitching his tents near Sodom. 13. Now the inhabitants of Sodom were very wicked sinners against the LORD. 12. And the LORD said to Abram, after Lot had parted from him, Raise your eyes and look out from where you are, to the north and south, to the east and west, 15. For I give all the land that you see to you and your offspring forever. 16. I will make your offspring as the dust of the earth, so that if one can count the dust of the earth, then your offspring too can be counted. 17. Up, walk about the land, through its length and its breadth, for I give it to you.

This one shall swear that he owns no less than half of it, and this one shall swear that he owns no less than half of it, and they shall divide it [between them.] [If] one says, "all of it is mine" and the other says "half of it is mine." The one who says "all of it is mine" shall swear that he owns no less than three quarters of it; and the one who says "half of it is mine" shall swear that he owns no less than one quarter of it. He [the former] takes three quarters and he [the latter] takes one quarter.
