1 REPORT ON APRIL'S CRIMES OF AMERICAN TROOPS IN Fallujah 2004 Presented to Human Rights Council of the United Nations Geniva For the period of March to April 2004 Our center (CCERF) by cooperation with Monitoring net of human rights in Iraq (MHRI) are present this report about the crimes and violations conducted by the American forces against the city of Fallujah, April, The delay of presenting this report about the first military operation was due to the following reasons: 1- Our efforts had failed to submit lawsuits representing the victims of this report and what they faced from violations and crimes conducted by the American siers. These lawsuits were rejected by the American courts. Our network keeps the files and the victims' testimonies. 2- The American government tries to falsify the evidences and lied when they said we will investigate if Israel used Cluster bombs in Lebanon?? We have confirmed official information that the Air force of U.S. has conducted jet shelling throwing more than 63 CBU-87 cluster bombs (releasing over individual bomblets) all over Iraq and Fallujah was one of them, between 1st. May 2003 and 1st. August 2006 ( After the supposed end of the initial invation of Iraq,May 1, 2003).

2 Currently, the city experienced a dangerous increase of assassination of the community and tribal leaders along with the American forces threats using loudspeakers that they will intrude the city for the third time and ignoring all initiatives that they were stating about national reconciliation, accordingly, the policy of violence will increase the blood shed and prevent all international efforts to intervene. Thus, we look for all international efforts to face the occupation criminal policy. We also urge to integrate and reconstruct the Iraqi police and military forces, at the same time, to be monitored and to investigate the Death Groups. In addition, we call for the enforcement of the role of law and question ever criminal who conducted crimes against the Iraqi population. Some testimonies of wounded civilians: 1-07/04/2004, Haneen Zaki Nouri, 7 years, was injured due to the American occupation forces bombardment of the main street of Falluja. She lives at Nazal district. Witness: her father, Zaki Nouri, Tel. No.: /04/2004, Zakiya Ahmad Atiya, 52 years (DOB:1946), was injured due to the fire shooting of the American occupation forces directed against the families who are running away from Al-Shuhada district. She was wounded on her left leg. Witness: the victim herself, Tel. No.: /04/2004, Oday Jasim Mohammad Khalaf Al-Falahy, 25 years, was wounded by several injuries during his trial to escape with his family out of the city. He lives at Al-Joulan district. Witness: victim himself, Tel. No.: /06/2004, Zahir Mahmoud Mohammad Al-Shujairi, 26 years, was wounded during his way for shopping to his family (which is under siege) at Al-Joulan district, near Abu-Ayoub Al-Ansary. The American occupation forces bombed the area by cluster bombs which is forbidden internationally. This caused the cut of the victim s both legs. Witness: Father of the victim. 5- During the American forces intrusion to the area of Saqlawiya at Falluja first crisis on April, the forces conducted some bombardments before entering the city. An American rocket fall close to the house of later Ibrahim Raihan Oday Al-Mohammadi caused a case of paraplegia due to the shock and horror that she experienced. She s now handicapped. The househer passed away since Witness: daughter of the victim, Amal Ibrahim. 6- Ahmad Khalid Naji Saleh (DOB: 1997) was wounded by several splinters during the American shelling on Falluja, April, Witness: Father of the victim.

3 7-07/04/2004, Ibrahim Hussein Allawy was wounded on his leg during his trail to escape out of the city due to the American heavy shelling. Witness: Victim himself. 8-08/04/2004, Ala a Kareem Ahmad Flayeh Al-Janaby (children) was wounded by several wounds on his body due to the American Jet s shelling to Nazzal district close to Abdullah Bin Al-Mubarak by clustered bombs; he was transferred to the hospital for treatment. Witness: Father of the victim. 9-11/04/2004, Khdeir Abbas Oweid Al-Halbousi was wounded on his leg which caused a smash on his leg bone due to the American Jet shelling over Al-Joulan district it was reported that this shelling was the extremist over the city. Witness: victim himself, Tel. No.: /04/2004, Isma el Khalil Ibrahim Al-Shujairi was wounded and had cut wounds on his legs and the back area due to the explosion of clustered bombs during bombardment over six houses conducted by the American jet. Witness: victim himself, Tel. No.: /04/2004, Mou ayyad Fadil Abbas Thabbah Al-Mohammadi has been wounded due to the clustered bombs used by American jets over Al-Joulan District, near the farm of Albu- Erem. Witness: victim himself, Tel. No.: /04/2004, Mohammad Mahmoud Hussein, 30 years, has been wounded by serious injuries due to the bombs splitters which were thrown by American jets over Al-Saray area. He was evacuated to the hospital. Witness: victim himself /04/2004, Adel Mohammad Abboud Hamady, 28 years, was injured due to the random shelling by American over Al-Shohada district. Witness: victim himself /03/2003, Tha er Ali Ibrahim Al-Mohammadi was wounded by serious wounds in different places of his body and had experienced surgical operation at Falluja Hospital. He was wounded during the American shelling over Al- Askary district near Al-Hussein. Witness: brother of the vicitim, Laith Ali Ibrahim, Tel. No.: /04/2004, Ahmad Obeid Armeet, 33 years, was wounded at his head due to the explosion of clustered bombs within American shelling to the city of Falluja. Some of the splitters caused injuries on his head, now he suffers serious pain due to this accident. Witness: victim himself /04/2004, Khudeir Hamad Abid Essa Al-Halbousy (DOB:1950), resident of Al-Joulan district, was injured on his thighs and his first phalange

4 of his right thump. This caused him problems while walking. He was injured during the American jets shelling at the night raid over that area. The victim is a househer of 15 persons. Witness: victim himself /03/2004, Rafa a Ali Ibrahim Turki Al-Muhammadi, was wounded of several wounds due to the American jet shelling over Al-Askary district, near Al-Hussein. She was evacuated to the hospital and had experienced several operations. Witness: brother of the victim, Laith Ali Ibrahim, Tel. No.: /04/2004, Jasim Mohammad Sheehan Jawad Al-Mohammadi, 64 years, was wounded by several injuries on his arms and legs which made it impossible for him to practice any profession. He was wounded due to the American shelling over Al-Joulan district. Witness: victim himself /04/2004, Thamir Kareem Ahmad Al-Janaby (a child), had been wounded of several injuries in different places of his body due to the American jets shelling over Nazzal district. He was evacuated to the hospital. Witness: father of the child /03/2004, Qais Ali Ibrahim Al-Mohammadi had been wounded of serious injuries caused by bombs splitters on his neck, arm and right leg.
