5 The Rule of Law A set of principles that, if respected, ensure that laws protect natural rights. In nations with the rule of law, society s workings are predictable, stable, and fair.

6 Natural law Derives from moral law (an inborn sense of right and wrong) Where a natural right exists, there should be a natural law to protect it (natural right to life > law against taking life)

7 Law-making in all societies is a process of discovering natural law Sources of natural law: 1) Biology, common to all animals 2) Jus Gentium (law of nations), or that portion of law that is common to all nations 3) Law derived from reason reflecting on nature 4) God s revealed law

8 Natural law is embodied in many of society s laws Code of Hammurabi Magna Carta Common Law Law of Moses

9 Generality Laws must apply to people in general, not discriminate against individuals or groups

10 Prospectivity Laws cannot be ex post facto: they cannot apply to actions that took place before the law was enacted

11 Publicity Laws must be well known and consistently enforced

12 Consent Those subject to the laws must give their consent to them, either directly, or through elected representatives

13 Due process The legal process must be impartial, regular, and well established to ensure fairness
