2 Notes of a Meeting of the East Sooke Citizens Committee Official Community Plan Review Held November 18, 2013 at East Sooke Fire Hall, 1397 Coppermine Road, East Sooke, BC PRESENT: Roger Beck, Zac Doeding, Layton Engwer, Jane Hutchins, Stacey Scharf, Neil Smith, Rhonda Underwood, Brian White Staff: June Klassen, Local Area Planning Manager, Iain Lawrence, Planner; Wendy Miller, Recorder ABSENT: Blair Cusack, Linda Nehra, Yale Shap PUBLIC: Approximately 11 The meeting was called to order at 7:05 p.m. 1. Welcome June Klassen welcomed everyone to the meeting and read aloud a written statement from Director Hicks thanking the members for coming forward to participate on the Citizens Committee. Statement outlined the available budget (Federal Gas Tax Community Works Fund) and available staff resources. Statement further outlined the process to bring the Official Community Plan (OCP) bylaw to the CRD Board for approval. Statement clarified that there is no support to down zone properties in community. June Klassen clarified that, as it is the OCP bylaw that is being reviewed, zoning will not be an issue addressed by the Committee. 2. Introductions Committee members introduced themselves, providing comment on length of residency and community involvement. June Klassen passed along regrets for Blair Cusack, Linda Nehra, Yale Shap. 3. Citizens Committee Roles and Responsibilities June Klassen stated that the role of the Committee is to act as an advisory group. June Klassen spoke to the work done to date to produce the current OCP, noting that the intent of the review is not to re-write the OCP, but rather to update it. The Committee will help promote opportunities for community feedback and receive feedback to determine current issues and concerns. The Committee will work towards consensus to develop OCP goals and policies. 4. OCP Review Process Iain Lawrence outlined the timeline for Phase I and Phase 2 of the review. Phase 1 will focus on public consultation with a total of twelve meetings currently scheduled from November 2013 to January Four public events are planned with the first event scheduled in January Phase 1 will develop a draft OCP for consideration by the Juan de Fuca Land Use Committee (LUC) and the CRD Board. Phase 2 is the process to bring the draft OCP to the LUC and the CRD Board for approval. The OCP bylaw will be presented to the CRD Board for 1 st and 2 nd reading at which point the bylaw will go to a

At 4 th reading the bylaw will be approved. 5. Background Information June Klassen spoke to the background information provided to the Committee. It was advised that all information provided to the Committee will be made available to the public in hardcopy and on the CRD website. June Klassen spoke to the following points: Regional Districts: - East Sooke is part of the Juan de Fuca Electoral Area which is part of the Capital Regional District - there are three First Nation reserves (Scia'new First Nation, T Sou-ke First Nation, Pacheedaht First Nation) in the Electoral Area with approximately twelve-fourteen Nations with an interest in the area Administration: - services provided out of the current Planning Office include Community Planning, Building Inspection, Parks and the Juan de Fuca Emergency Program - the office will be moving to a new location ( Butler Road) in December - Juan de Fuca Search and Rescue will be joining the services located out of this building Planning Legislation: - planning is governed by provincial legislation including the Community Charter, Local Government Act (LGA), the Strata Property Act, Land Title Act, Transportation Act, Riparian Areas Regulation, and the Agricultural Land Commission Act Regional Growth Strategy: - the Electoral Area is also governed by the Regional Growth Strategy (RGS) - the RGS provides servicing policies for the region - all Electoral Area bylaws mush be consistent with the RGS - consistency with the RGS is determined by the CRD Board - the RGS is under review as the Regional Sustainability Strategy (RSS) - RSS public consultation is anticipated to begin in the summer of 2014 Land Use/Zoning Bylaw: - each property has a zoning designation - the Land Use Bylaw (Bylaw No. 2040) does not apply to Private Managed Forest Land and provincial and federal Crown Land parcels operated under licence by the Province Decision Making Structure: June Klassen outlined the decision making structure of the CRD Board, the Juan de Fuca Land Use Committee and the local committees including the Advisory Planning Commissions. June Klassen spoke to the different development applications and processes. Iain Lawrence spoke to voting on Part 26 of the LGA (Planning and Land Use Management) and Division 2 (Official Community Plans). Iain Lawrence outlined the required content for OCPS (Section 877). Current OCP: June Klassen directed attention to the current OCP, Bylaw No. 3718, speaking the following sections:
4 East Sooke Citizens Committee, Official Community Plan Review Meeting Notes November 18, Physiography of the Area - updated contour information for Steep Slopes is now available (>30% based on 1 m contours) - information will be applied to mapping 1.4 Dominant and Sensitive Ecosystems - Updated information to be provided by the Province 1.5 Potential Heritage Sites - a member of the Otter Point Citizens Committee worked with the Sooke Region Museum and Otter Point residents to collect local history - a local history report was prepared as background to the Otter Point OCP - there may be opportunity for East Sooke to conduct a similar exercise Community Parks - the Juan de Fuca Electoral Area Parks and Recreation Advisory Commission has produced a Community Parks Strategy Plan - information and policies from this plan will be added to the East Sooke OCP - copies of the Community Parks Strategy Plan will be provided to the Committee 1.7 Beach Access Points/Right of Way - section to be retitled to Public Access to Water/Right of Way - these public accesses fall under the Ministry of Transportation and Infrastructure (MOTI) - the CRD can acquire MOTI permits to support recreational access to the right of way 2.4 Greenhouse Gas Reduction Targets - to support reduction of greenhouse gas emissions by 3% by 2020, the community will be asked to consider support for such items as upgraded windows and woodstoves and transit options such as carpooling and bus servicing 2.5 Community and Development Policies - the Committee will review these policies - policies will be reviewed to better align with the OCP goals 3.0 Goals and Objectives of the Plan - goals were last updated in the Committee will review these goals to see if there are any changes wanted by the community 4.0 Development Policies - the Committee will review land use designations to determine parcel size/growth supported by the community - if a rezoning proposal is not supported by a parcel s land use designation, a change in a parcel s land designation must first be considered by the CRD Board prior to consideration of the rezoning proposal A Committee member forwarded support for considering Section 4.0 early in the review process. June Klassen directed attention to Section 4.4 Development Permit Areas, briefly speaking to the six Development Permit Areas (Steep Slopes; Foreshore and Marine Shoreline Areas; Watercourse, Wetlands and Riparian Areas; Sensitive Ecosystems; Commercial Area; Protection of Farming).
5 East Sooke Citizens Committee, Official Community Plan Review Meeting Notes November 18, June Klassen stated that staff proposes reviewing the OCP by theme rather than by section. However, there is opportunity to review the OCP by section if this is the Committee s preference. Heather Phillips, Otter Point - participated in the Otter Point OCP review - should the Committee wish to review the OCP by section, members and the public should read materials in advance of the meeting to ready questions for the Planners Cleo Gardener, Shirley - questioned whether the public is permitted to ask questions/provide feedback - questioned if the Committee will be referencing/reviewing Bylaw No (Juan de Fuca Land Use Bylaw) - Bylaw No is a guiding document, addressing more than zoning - wants OCP review process to be legal, supporting fair public process June Klassen stated that Committee meetings are open to the public and that the public is permitted to ask questions and provide feedback. It was stated that Bylaw No is a land use bylaw that addresses specific land use regulations and parcel zoning. It is anticipated that Bylaw No will be reviewed in a year. The Committee forwarded consensus for reviewing the OCP section by section. June Klassen stated that this review will take approximately two meetings. 6. Issues Committee members and the public forwarded the following community issues for consideration for the review: - community water supply - extension of CRD water - interface/wildfire fire safety - emergency response/emergency access - parks and trails, connectivity - access to water - public boat launch, access to Sooke Basin - Settlement Area designation assignments - Settlement Area inequities - transportation (bus routes) - changing demographics - social/heath service infrastructure - future status of the current fire hall - keeping youth in the community - affordable house - protection of rural character - question if the community is or wants to be a bedroom community - education to support removal of burnable items away from houses/structures - opportunities/options to promote/receive more public input - impact of developments outside of the community (Sooke/Metchosin) - relationship with Sooke/Metchosin - road safety/quality - cellular service/roaming issues - village core - blue listed species/species at risk - invasive species - meeting GHG targets - RGS 7. Committee Feedback A Committee member forwarded support for review of Sooke and Metchosin planning documents. June Klassen advised that there is also a study available for the Sooke Basin and that this document is being revisited. Committee comment was forwarded stating that the current moratorium on wharves has impacted property values/sales.
6 East Sooke Citizens Committee, Official Community Plan Review Meeting Notes November 18, June Klassen asked the Committee to consider opportunities to engage the community (website, notices, coffee sessions, etc.). The following Committee comments were forwarded: - language needs to be simple with planning terms explained - there is opportunity to get input from school aged children - working/commuting families have limited time/opportunity to participate Cleo Gardener - requested confirmation of whether any of the Committee members are members of CRD related committees/commissions or non-related CRD special interest groups - stated that the public is allowed to question the Committee s composition and meeting processes - stated that the public is allowed to question who s interests are being served A Committee member stated that Committee members are permitted freedom of association and are not obligated to divulge association with any other committee/commissions or groups. June Klassen stated that the Committee is not a decision making body. The role of the Committee is to act as an advisory group to help frame the OCP review, providing input and seeking feedback. June Klassen stated that a facilitator is being sought for the review process. Should a facilitator not be secured, June Klassen advised that she can act as facilitator. Committee comment was forwarded stating: - that Dave s Store may be able to help distribute information to the public - that hardcopies of items for review should be sent to the Committee at least one week in advance of a meeting 8. Next Meeting The Committee was asked to read until the end of Section 4.1 for the next meeting. Next meeting will be Monday, December 9 at 7:00 p.m. at the Fire Hall. The meeting adjourned at 9:05 p.m.
