No (O) SECRETARY Fax No No. 282/POND/2004 Dated: 8 th October, Ashvina, 1926(Saka) NOTIFICATION No. 282/POND/2004- In pursuance of sub-section(2) of Section 9 of the Delimitation Act, 2002 (33 of 2002), the Delimitation Commission hereby publishes its proposals for the delimitation of Parliamentary and Assembly Constituencies in the UT of Pondicherry along with the dissenting proposals of the Associate Members and specifies 25 th October, 2004 as the date on or after which the proposals will be further considered by it. 2. Any objections or suggestions in regard to these proposals should reach the Secretary, Delimitation Commission, Nirvachan Sadan, Ashoka Road, New Delhi , on or before the said date. (i) (ii) (iii) PROPOSALS The territorial constituencies into which the UT of Pondicherry shall be divided for the purpose of elections to (a) the Legislative Assembly of the UT, and (b) the House of the People, the extent of each such constituency and the constituencies in which the seats are reserved for the Scheduled Caste and Scheduled Tribes shall be as shown in the Table-A and Table-B respectively. Where the name of a constituency as shown in Table A or Table B is distinguished by the brackets and letters (SC), the seat in that constituency is reserved for the Scheduled Castes; and Where the name of a constituency as shown in Table-A or Table-B is distinguished by the brackets and letters (ST), the seat in that constituency is reserved for the Scheduled Tribes. Whereas, Sh. R. Nalamaharajan, MLA and Associate Member of the Delimitation Commission from the UT of Pondicherry, has, vide his letter dated 18/10/2004, stated that he could not submit his note of dissent in time as he was out of India due to an official engagement; and 3. Whereas, the Commission after considering all relevant factors, decided to give another opportunity to Sh. R. Nalamaharajan and asked him to filed his note of dissent, if any, latest by 30th November, 2004, for publication in the Gazette vide Commission s letter no. 282/POND/2004, dated 24 th November, 2004; and 4. Whereas, Sh. R. Nalamaharajan has submitted his note of dissent dated 29 th November, 2004 to the Commission for publication in the Gazette; /- Notification(Pond.) 2

3 Now, therefore, In pursuance of sub-section (2) of Section 9 of the Delimitation Act, 2002 (33 of 2002), the Commission hereby publishes the note of dissent of Sh. R. Nalamaharajan 6. No (O) SECRETARY Fax No No. 282/POND/2004 Dated: 8 th October, Ashvina, 1926(Saka) ORDER NO. 1 In pursuance of Sections 8, 4 and 2(f) of the Delimitation Act, 2002 (33 of 2002), and having regard to all other enabling statutory provisions in this respect, the Delimitation Commission hereby determines a) the total number of seats to be allocated to the UT of Pondicherry in the House of the People as One (1); b) of the total number of One (1) seats so allocated to the UT of Pondicherry in the House of the People, the number of seats to be reserved for the Scheduled Castes and Scheduled Tribes as Nil; c) the total number of seats to be assigned to the Legislative Assembly of the UT of Pondicherry, as thirty(30); d) of the total number of thirty(30) seats so assigned to the Legislative Assembly of the UT of Pondicherry, the number of seats to be reserved for the Scheduled Castes and the Scheduled Tribes as five(5) and Zero(0) respectively. Delimitation of Parliamentary and Assembly Constituencies in the UT of Pondicherry publication of Commission s notification. I am directed to state that the Commission, after discussion held with the Associate Members for UT of Pondicherry, at New Delhi on 23/8/2004, 8/9/2004 has drawn up its proposals for the delimitation of Assembly and Parliamentary Constituencies in the UT of Pondicherry, in accordance with the provisions contained in Sections 8 and 9 of the Delimitation Act, 2002 as amended. 2. An advance copy each of the following are forwarded herewith: (i) Order No. 282/POND/2004 dated 8 th October, 2004 issued under Section 8 of the Delimitation Act, 2002; (ii) Notification No. 282/POND/2004 dated 8 th October, 2004 containing the proposals of delimitation of Parliamentary and Assembly Constituencies in the UT and the dissenting proposals of the Associate Members. I am to request that the above may kindly be got published in an extraordinary issue of the UT Gazette on 8 th October, 2004 in the serial order mentioned above. Fifty copies of the said gazette may be forwarded to the Commission immediately after the publication /-

6 Before, however, the Commission s proposals are set in print for publication, I am to request that the descriptions of the extent of the constituencies and spellings of names of places may kindly be checked at your level. If there are any corrections required in the notification, the same should be intimated immediately. 4. I am also to enclose an advance copy of the NOTICE to be issued in connection with the publication of the Commission s proposals, for your information. With a view to giving widest publicity to its proposals and to ensure that copies of the same are made easily available to the public for their reference, the Commission desires that copies of Order and Notification mentioned above and the NOTICE may be got published in two vernacular Newspapers in the State. The matter should also be given publicity on radio, television and through other media of mass communication. You are also requested to supply: (i) (ii) (iii) Two copies each of the Commission s Order, Notification and the Notice to each of the recognised political parties (National and State parties); Sufficient number of copies of the same to each of the District Election Officers and the Electoral Registration Officers for displaying the gazette version of the same relating to the area under their jurisdiction, on a conspicuous part of his office for public notice, and One copy each of the same to each of the sitting MLAs and MPs 5.
