Varance Between the ndctment and Proof Offered Thompsons CrossExamnato n The takng of testmony n the Lee Let case began yesterday mornng before udge Robnson and the ury whch had been secured the day before The ndctment aganst Lee Let was read and then Deputy Attorney General Larnach brefly outlned what the prosecuton would prove Ths statement was bref and merely that Taylor, at Lee Lets ntatve, had had several ntervews wth Lee Let n whch the latter had proposed that Taylor, for a consderaton of $900 a week, should allow a hul of whch Lee Let clamed to be the spokesman carry on gamblng games, and had pad hm $50 on account of ths purpose A P Taylor was the frst wtness called He testfed that he was a polce offcer and Chef of Detectves He had been commssoned, but the orgnal commsson had been mslad A copy was offered n evdence Thompson narrowly crossexamn ed Taylor as to how the commsson was mslad He then obected to ts ntroducton on two grounds frst, that nonproduct on the of the commsson yhad not been suffcently explaned, land, second, that the commsson created Taylor a polce constable, whle the ndctment charged the defendant wth brbng a polce offcer whch he sad was a totally dfferent thng Deputy Attorney General Larnach repled that the ndctment charged the brbng of an executve offcer, to wt: a polce offcer and that the words polce offcer mght be treated as sur, plusage To ths Thompson repled that n that case the ndctment would have been demurrable as not specfccall y allegng the crme charged for the Attorney General was an executve offcer, and though an Attorney General had been attempted to be reached n ths way, ths was not that case Deputy Attorney General utton produced a decson from the Ffteenth Hawaan Reports n whch the upreme Court had held that the terms polce offcer and polce constable were synonymous A search dsclosed the fact, however, that ths decson was n a cvl case where the queston was the suffcency of servce of cvl process, and that t was at a tme when the statute poke ndscrmnately of polce offcers and constables, whle the county act under whch the present herff was actng seemed to provde onlr for polce offcers udge Robnson examned Taylor further to determne ust what search had been made for the orgnal com f msson t seems that Taylor before v leavng for an Francsco, had gathered up a large number of papers of value to put n a safe place durng hs absence He had ntended to take hs commsson wth hm to an Francesco as a means of hs own dentfcaton there, and whle he had seen t when gatherng up hs papers he postvely that he had could not say actually taken t to an Francsco udge Robnson ruled that the copy could not be ntroduced at ths tme because t had not been shown that suffcent search had been made for the orgnal As to the second pont, whether there was a fatal varance between the ndctment and the commsson, t was not passed on, and seems mportant, as Taylor now not to be wthdrawn and herff aukea was called, and he testfed was temporarly Taylor a polce that he had apponted offcer TAYLOR A POLCEMAN Thompson wanted to crossexam ne at ths pont to fnd out f he had ssued a commsson, but ths was ob ected to by Larnach and the obecton was sustaned, udge Robnson turnng the laugh on Thompson by sayng that whle the orgnal commsson was the best evdence of what the commsson contaned, the testmony of the appontng power that he had made an appontment was qute as good evdence as the commsson ssued to the appontee Taylors status as a polce offcer and an executve offcer havng thus been establshed, he was recalled to tell the story of the alleged brbery TAYLOR MEET LEE LET Taylor testfed that he knew the defendant He frst met hm on Tuesday, February 5, at the store of Yuen Chong He went there n company wth H M Ayres to meet a Chnaman whose name he dd not then know, but whom he has snce learned was Lee Let He went by arrangement made by H M Ayres They entered at the Kng streetdo or and were met by Lee Tong, who conducted them throughth e store to a back room, where the four sat down and refreshments were brought n PRELMNARY MALL TALK The conversaton at frst was on ndfferent subects, the lchee nuts, whch formed part of the refreshments, furnshng one topc, ther orgnal habtat and ther place n the economy of Chnese hosptalty beng spoken of Fnally Lee Let sad he had somethng prvate to say to Taylor The latter asked f Ayres mght not reman, but Lee Let sad not, and Lee Tong and Ayres went out When they were alone Lee Let sad he wanted to speak about somethng whch would be good for both of them that hs cousn, Lee Tong, wanted to start up gamblng games, papaka u and chef a, but that Lee Tong was new to the busness and that he, Lee Let, had better represent hm Lee Let sad Lee Tong had good backng, and that what they wanted was to be allowed to start papaka u games at Chnese New Years tme and that they would pay Taylor $900 a week n addton, Lee Let offered to supply a detectve or nformer, who would supply Taylor wth nformaton as to other games that would start up, so that rads could be made on them There was dscusson as to detals of the plan, and an engagement for the next day was made THE ECOND DAY The next day Taylor went, accompaned by Offcer Leal, to a pont across the street from the Yuen Chong store Taylor went nto the store and went to the back room and found Lee Let alone On ths occason there was further dscusson on the general subect Further detals were gone nto Lee Let sad that the hu whch he represented thought $900 a week too much and that $700 a week was enough that that was the amount they had formerly pad Moreover, n case any of the gamblers at the Lee Let hu gamblng places were arrested Taylor was to furnsh them a lawyer and pay ther fnes, f they were fned, out of the $700 or $900 a week Lee Let read from a paper wrtten n Chnese characters an outlne of the whole plan As he read Taylor took notes and afterwards read hs notes back to Lee Let and asked hm f they were correct Lee Let sad they were Ths was ntroduced n evdence THE THRD VT On the next vst, he agan met Lee Let alone On ths occason Lee Let sad that the hu desred to start other games than those whch had already hoen nronosed and asked how much ths would be, to whch Taylor re pled that t would be the same as the other Taylor nqured how he was to De assured that he would get the money and Lee Let sad that he hmself would (Contnued on Page even) OEPH H KUNEWA FOR TAX AEOR FOR MAU Treasurer Campbell has made hs selecton for Tax Assessor and Collector of Mau t s oseph H Kunewa Campbell wll send Gvng Bryan the strength of hs ssues as they have developed at the hands of poltcal foes, as well as frends, and he s a really formdable leader He may also count on a personal followng whch has grown Tunt be two raost popular Republcan asprants The most effectve and least costly publc work that s beng done for charty n ths town today s that of the alvaton Army There s heart and sympathy n t as was made clear at a recent Con gressonal hearng One of those who appeared n favor of the measure, Rear Admral H X Menney, declared that the Marcon Wreless Company had gven the Nary Department much trouble One of the ncdents, he sad, was that of the steamer t Paul, an Amercan vessel on her way to New York When passng Nantucket she was ealled by the lghtshp, a Unted tates govern ment vessel, and was asked by the lghtshp to communcate to the authortes on shore the fact that she had been damaged and suffered some loss durng a gale The Marcon staton on the sland of Nantucket mmedately nterfered and drummed to prevent the Unted tates vessel (the lghtshp) from com muneatng wth an Amercan merchant vessel The t Paul carred a Marcon telegraph apparatus, and the lghtshp carred nstruments of another system tor whch reason the Marcon shore staton would not allow the government vessel to communcate wth the t Paul That the Navy Department regarded as an outrage n another nstance the Lebanon, a vessel that the Navy De partment desgnated and ftted for the purpose of destroyng derelcts n the tracks of commerce, was out searchng for a derelct whch had been reported, and hearng a vessel sgn
