2 Fireworks Display Request April 4, 2017 Honorable Mayor and City Council RE: Fireworks Display Permit Request Dear Honorable Mayor and City Council, Bridgette Kelch, Executive Director of Downtown Washington is requesting a permit for a fireworks display on the evening of Friday, May 26, 2017 at Rennick Riverfront Park boat parking lot. This event is a fund raiser for the Franklin County Humane Society hosted by John G s Bier Deck. The issuance of this permit is contingent upon all paperwork and approvals are met by all departments and weather conditions are favorable. PRIORITY ITEMS Mural Placement Recommendation April 11, 2017 Honorable Mayor and City Council City of Washington RE: Mural Placement Recommendation Honorable Mayor and City Council, At the April 6, 2017, meeting of the Parks & Recreation Commission, the Commission voted in favor to support the recommendation of the Arts Council to place a mural on the East and North walls of Main & Elm parking lot. The Arts Council has solicited and called out local artist for qualification and proposals for the mural, which included the history of Washington as a guiding theme. The Arts Council has reviewed all submittals and is recommending their selection. The Arts Council would cover all costs associated with the mural and plan on beginning the work in May. Accordingly, the Parks & Recreation Commission, Washington Arts Council and the Parks & Recreation Department are asking for the City Council s consideration and subsequent approval for the placement of the mural to be placed on the East and North walls of the Main & Elm parking lot. Completion of the mural is for the middle of June, weather permitting. After a brief discussion, a motion to accept the mural placement recommendation and art work was made by Councilmember Sullentrup, seconded by Councilmember Holtmeier, passed without dissent. Farmers Market Art Placement Recommendation April 11, 2017 Honorable Mayor and City Council City of Washington RE: Farmers Market Art Placement Recommendation Honorable Mayor and City Council, At the April 6, 2017, meeting of the Parks & Recreation Commission, the Commission voted in favor to support the recommendation of the Parks & Recreation Department and the Arts Council to hang and display two pieces of art work donated by local artist Larry Pogue at the Farmers Market. This motion was made on the condition that the two pieces would only be hanged, as long as the placement didn t interfere with activities associated with the Farmers Market and the Parks & Recreation Department would work with all parties associated with the Farmers Market on the proper placement. Accordingly, the Parks & Recreation Commission, Washington Arts Council and the Parks & Recreation Department are asking the City Council s consideration and subsequent approval for the placement of the two pieces of art work at the Farmers Market. City Council Elections Election of Mayor Pro Tem Councilmember Sullentrup nominated Councilmember Patke, seconded by Holtmeier. A motion to cease the nominations was made by Councilmember Mohesky, seconded by Councilmember Brinker, passed without dissent. The nomination of Jeff Patke passed without dissent. Election of Council Member to P&Z Commission Councilmember Patke nominated Councilmember Skornia, seconded by Councilmember Mohesky. A motion to cease the nominations was made by Councilmember Mohesky, seconded by Councilmember Brinker, passed without dissent. Page 3

4 The nomination of Greg Skornia passed without dissent. Election of Council Member to 353 Corporation Councilmember Brinker nominated Councilmember Sullentrup, seconded by Councilmember Mohesky. A motion to cease the nominations was made by Councilmember Brinker, seconded by Councilmember Patke, passed without dissent. The nomination of Steve Sullentrup passed without dissent. Election of Board of Health Councilmember Patke nominated Councilmember Hidritch, Councilmember Skornia, Councilmember Sullentrup, and Councilmember Brinker, seconded by Councilmember Mohesky. A motion to cease the nominations was made by Councilmember Mohesky, seconded by Councilmember Patke. The nominations of Mark Hidritch, Greg Skornia, Steve Sullentrup, and Josh Brinker passed with Greg Skornia and Steve Sullentrup voting nay. Mayor s Presentations, Appointments & Re-Appointments: Resolution Thank you Walt Meyer WHEREAS, WALTER MEYER was City Councilman for the City of Washington, Missouri from April 2009 through April 2017; and WHEREAS, during his term of office he has given his time and effort to serve the citizens of the City of Washington, Missouri; and WHEREAS, he has served faithfully in many capacities as Councilman and has played a vital role in the important work in the community; and WHEREAS, he has been an influence for good in the growth and progress of our community; and WHEREAS, WALTER MEYER is entitled to just recognition for these efforts. Sterling Morton proposed to the Nebraska Board of Agriculture that a special day be set aside for the planting of trees; and WHEREAS, This holiday called Arbor Day was first observed with the planting of more than a million trees in Nebraska; and WHEREAS, Arbor Day is now observed throughout the nation and the word; and Page 4

5 WHEREAS, The Tree City USA program, sponsored by The National Arbor Day Foundation, provides direction, technical assistance, public attention and national recognition for urban and community forestry programs in thousands of towns and cities that more than 93 million Americans call homes; and WHEREAS, The City of Washington has been a Tree City for the past 12 years; and WHEREAS, Trees can reduce the erosion of our precious topsoil by wind and water, cut heating and cooling costs, moderate the temperature, clean the air, produce oxygen and provide habitat for wildlife; and WHEREAS, Trees are a renewable resource giving us paper, wood for our homes, fuel for our fires and countless other wood products; and WHEREAS, Trees in our City increase property values, enhance the economic vitality of business areas, and beautify our community; and WHEREAS, Trees, wherever they are planted, are a source of joy and spiritual renewal. NOW, THEREFORE, I, Sandy Lucy, Mayor of the City of Washington do hereby proclaim April 22, 2017 as Arbor Day in the City of Washington and urge all our citizens to support efforts to protect our trees and woodlands, and to support our City s Urban Forestry Program by planting trees to gladden the heart and promote the wellbeing of present and future generations. He then stated there is an Earth Day/Arbor Day Celebration this Saturday from 10 a.m. to 1 p.m. at Hillermann s Nursery. 6 April 11, 2017 Honorable Mayor & City Council Re: File No Special Use Permit-6355 Bluff Road Dear Mayor and City Council Members: At the regular meeting of the Planning & Zoning Commission, held on Monday, April 10, 2017, the Commission reviewed and recommends approval of the above mentioned Special Use Permit with the following conditions: 1. A six foot sight-proof fence must be placed around the perimeter of the storage area. The use of tarps to screen materials is strictly prohibited. 2. The asphalt parking lot must be used for customers and employees only and must be striped to meet the minimum parking requirements. 3. The improvements to the property are accordance with the submitted sit plan must be completed within 60 days of the approval of the ordinance. Sincerely, Tom Holdmeier Chairman Planning & Zoning Commission Maniaci: This is located right at the intersection of Bluff Road and Lange Drive. The recycling center is to the northwest here, there is actually two businesses. It s is one parcel, but there is a businesses at this address and the Franklin County Recycling. I believe they got their occupancy about a year ago for this business, on the southern portion of the property. About two months ago, we did receive some complaints about some open storage and some derelict vehicles, out in not only in the front of the building, but also along the side, visible along Lange Drive. So, we sat down with both business owners and kinda explained the rules to them, and realized with the type of open storage that was going to be happening on sight especially with this newer tenant, we thought to bring them into full conformance we should require them to request a Special Use Permit under the zoning code in the M-2 Zoning. Which you can see here, it s everything out there is zoned M-2 Industrial. To have open storage overnight and out in the open, you have to have a Special Use Permit approved by Council. So that is why they are here tonight, they did submit a sight plan, just showing this is the portion that s going to be re-graveled. Basically the storage area, they do show a landscape area along Lange Drive. And then this red line is the proposed sight for a fence, that we, the staff, told the applicant that would have to have to show for the storage to have all storage in the rear. They did mention as part of their insurance, they would have to have all their vehicles being worked on everything being stored behind a, not only a site-proof fence but also a security gate as well. So that will help them out in a couple different ways. As for the use, staff, as long as they follow the, they follow through with the improvements they said they would on the sight plans, the staff sees no detriment in approving the Special Use Page 6

7 Permit. Obviously everything out there is industrial; there are some businesses that do have open storage. Obviously the Recycling Center has been grandfathered in for quite some time, but there are other businesses that do store some material outside but they do, they have to either have it behind a site-proof fence or behind their building out of public view. This did go to P&Z last week, they did add some conditions of approval specified really on their. First of which, the six foot site proof fence must be placed around the perimeter of the storage area, not just on two sides so that it is closed in and then the use of tarps to screen the materials is strictly prohibited. So they won t be able to place a tarp on a chain-link fence, which we have seen in the past. The asphalt parking lot in the front, which is this area, must be used for customers and employees only. Can t be used for any storage of materials or any, I think there was a complaint that there was some advertisement up there of a Show Truck or something, but it must be striped to meet the minimum parking requirements. The improvements to the property in accordance with the submitted site plan must be completed within 60 days of the approval of the ordinance. Patke: What are the minimum parking requirements? Maniaci: They have the amount of spaces Patke: They do Maniaci: Because of the amount of room. Yeah, because if the overflow can go on the rear but they do have to strip them on the hard surface and they have to be 9 x 19 and at least one handicap stall. Mayor: Any questions? 8 RE: File No Northern Star Homes-Rezoning-The Overlook at Weber Farms-Vic Hoerstkamp Dear Mayor and City Council Members: At the regular meeting of the Planning & Zoning Commission, held on Monday, April 10, 2017 the Commission reviewed and recommends approval of the above mentioned rezoning request. Sincerely, Tom Holdmeier Chairman Planning & Zoning Commission Maniaci: This, I have one presentation for three different requests tonight; they are on different parts of the agenda. But if you remember about a month ago, or I guess it was in February. We looked at the Overlook at Weber Farms; it was an annexation, a rezoning, and a preliminary plat, they have come back with a revision to that plat. There were some grading issues that they guess that they didn t anticipate at the time, and so what they re doing is moving a little bit further toward the north and to the east and shifting that main road up, and adding one lot. But for this, the Public Hearing, this is just the rezoning because of the extension since it s moving a little bit further north and east. This portion that was not previously included and the plat that you see in purple is what s on the agenda a little bit later to be annexed. But this really tiny piece, it s.08 acres has to be rezoned from R-1D to R-1A. This proposed subdivision, The Overlook, is the R-1A for Single Family of 10,000 square feet. This redline is the boundaries of the Malvern Hill Subdivision that comes off of Rabbit Trail and that is R-1D, which has the smaller lots. And since it s overlapping here, it s the same owner Vic Hoerstkamp same developer but, this lot was overlapping into what was originally zoned for Malvern. And so to clean up that split zone, they needed to rezone that portion. Mayor: Any questions or comments? Maniaci: Alright, thank you. 9 RE: Nomination of Local Historic Landmark Wildey Odd Fellows Cemetery Dear Mayor and City Council Members: At the regular meeting of the Planning & Zoning Commission, held on Monday, April 10, 2017 the Commission reviewed and recommends approval of the nomination to designate the Wildey Odd Fellows Cemetery as a Local Historic Landmark. Sincerely, Tom Holdmeier Chairman Planning & Zoning Commission Maniaci: Okay, I am not sure if anyone from the Odd Fellows is here tonight but I will just give a quick kind of Bridgette Kelch: (inaudible) is in the back Maniaci: Ok, great. Yeah, I ll give a quick overview of why we re here because this is our first nomination. But a couple of months ago, I know we talked about that the Preservation Commission was looking at following through with their first local historic landmark nomination. The Wildey or The Odd Fellows Organization decided that they would like to kinda be the guinea pig but also wanted to have their Cemetery be the designated as a local landmark. This is the intersection, this is Westridge Drive and this is Wildey Way, the KC Hall is just to the north there. And if you look in your packet you should see the application for this, it s pretty extensive they did do a lot of research and homework as to not only the history of the Odd Fellows but the history of the architecture of the gondola there, and not the crematorium, the columbarium, and sorry about that. It so, and so they had a list of residents who were buried there who have contributed a lot to the community so, the two contributing structures were those two and then the ordinance does designate that you know if someone were to come in with a demolition permit, that it would have to be approved by the Washington Historic Preservation Commission before that could go through. This was nominated by the Odd Fellows; this went to the Preservation Commission. They passed a Resolution in favor of moving forward with the nomination and then it went to Planning & Zoning Commission last week, and they also voted to move the nomination forward as well. So, and if you have any questions on the process I would be happy to answer; otherwise they re here to talk about the actual nomination. Mayor: Any questions or comments? Okay. Carolyn Witt: I am Carolyn Witt and I m the Chair of the Historic Preservation Commission Mayor: Pull your microphone Carolyn Witt: And as mentioned, this is our first endeavor in this. It had been an ordinance, it had been available to the Historic Preservation, or to a land property owner, or the City Council can choose to present something as a local landmark, but we were encouraged to look into this after the loss of Fifth Street School. The idea that this might not have any effect on that but the idea is that if we have more input into a decision by a property owner or by someone to demolish Page 9

10 the structure something that has historic significance that gives us an opportunity to state our case. So we hope you will follow through on this and let us have a successful first endeavor. Mayor: Marc Marc Houseman: Hi, Marc Houseman and I m the Noble Grand of the Odd Fellows Lodge here in Washington. We re proud to be at this stage, and it s true that I wanted to be the first one to slide into home plate with something that might actually protect a local historical resource, and of course, cemeteries are protected by state law, but the structures within the cemetery not necessarily. The pagoda dates to 1912 and our columbarium actually only dates to 2013 but it is unique in the entire world, not just this nation that the columbarium is there only to receive the cremated remains of people s whose ashes are unclaimed. One of the commandments of being an Odd Fellow is to bury the dead, that s why a lot of Odd Fellows have cemeteries but we ve taken that now to the next level providing a place where unclaimed human cremated remains can rest permanently, if need be; 7,000 Missourians a year are cremated, only to have their ashes remained unclaimed forever and after 60 days it is legal to throw them in the Landfill and we don t think that that s right. And so, that is one of the reasons why the Odd Fellows have taken the steps to build this columbarium, so even though it s not old we feel that it is extremely significant structure. Mayor: Do you make an effort to connect to family members? Marc Houseman: We do. Every remains that goes into the columbarium is put on the website, find a grave, which is an extremely useful resource for Genealogists and we have reconnected about a dozen families with cremated remains. We also research each one to see if they re a Veteran, and if they are an honorably discharged Veteran, we actually make arrangements with Jefferson Barracks and we transfer them there where they receive full military honors and are permanently put to rest their at Jefferson Barracks. We have done that for about 20 so far. Mayor: Very good, thank you. Marc Houseman: Thank you. Mayor: Okay, any questions of Marc or Carolyn? Sullentrup: Marc, not only just this Wildey Way, but would you have an ordinance every time you wanna do this? Marc Houseman: As far as a local landmark? This is the first Sullentrup: Every time we wanna do a historic landmark, would we have to have a new ordinance? Marc Houseman: Yes. Carolyn Witt: But I can assure you, we would not, we are not looking to willy-nilly encourage, we are going to, if you saw the application form, it s not something that somebody to xerox off and turns in. And this will come through the Historic Preservation Commission and we take this very seriously, and it s just not gee it s a nice old house, or I was born there it should be a memorial, it should be a landmark. This is serious, we take this very seriously, but it is an opportunity for something that might otherwise slip through the cracks can be recognized. So please don t think that you re gonna see us on a monthly basis or anything, but you will probably see us again. Sullentrup: Thank you. Page 10

Voluntary Annexation acres of Weber Farm April 11, 2017 Honorable Mayor & City Council RE: Annexation of.053 acres of the Weber Farm Dear Mayor and City Council Members: At the regular meeting of the Planning & Zoning Commission, held on Monday, April 10, 2017 the Commission reviewed and recommends approval of the request to annex 0.53 acres of the Weber Farm with a zoning designation of R-1A. Attached to this letter is the exhibit referencing the area to be annexed. It s that, second one, same one, yep, so like I said, since this is a revision and they re moving to the northeast, they have to, they re proposing to annex this small portion here in purple, just.53 acres. It encompasses the right of way they re proposing as well as those lots that are now moving they are still same as last time; create an island that will be un-annexed. We have pursued contacting the sole property owner in the middle. Hopefully, we can make some contact with them in the next few weeks before this ordinance actually passes at the second meeting in May. Mayor: Any questions? Development Code Revisions Honorable Mayor & City Council RE: April 2017 Development Code Revisions Dear Mayor and City Council Members: At the regular meeting of the Planning & Zoning Commission, held on Monday, April 10, 2017 the Commission reviewed and recommends approval of the proposed amendments to the City s Development Code. Sincerely, Tom Holdmeier Chairman Planning & Zoning Commission Maniaci: I brought this up at the last Admin and Op Meeting. We had, before the codes were in effect, we had a group come in and pick up an application for special use permit self-storage units. They came back in, after the code came into effect, and we realized that we had that ordinance, I m sorry, the matrix created showing all those uses. We had hundreds of uses listed that we didn t have previously. Self-storage units had been taken out, as a specified use and grouped together with just warehousing. Which the new code specifies warehousing as industrial use only. So when they came back in to turn in their application, they asked if they should now request to rezoning to industrial for the same location. We did not think that it was a good zoning for that location, nor did we think that self-storage units should be in industrial zoning. Actually, in the new code, if you look at our parking matrix, it still has self-storage units so it s just a mistake that those were grouped together in the zoning matrix. And rather than have them wait, our whole plan was wait, six months to a year, I mean this was a big over haul of codes. Figure out what needed to be adjusted and do an amendment then. But since they were looking to turn in a application, we thought we should do this now. So that s the main reason why we re here tonight. And then thought well, there are some other items that came up in the past six months that we knew we wanted to change and the work may be controversial, So, we may as well change them now. Page 12

13 So the first of which is the consolidation of the bed and breakfast, tourist home and vacation by rental, owner definitions. This is actually, not in the new code that was in the old code as well, we didn t realize that they were really contradicting each other until we saw the new building code that we re going to be adopting, the 2015 building code and so we re just getting rid of all those definitions. There was five of them, we re going to have a bed and breakfast which is when it s a vacation rental, where it s owner occupied, and we re going to have a vacation rental by owner, where it s not occupied. They are still allowed in the same districts as they were before, and they still have to go through the same approval process. It s just that that way no one can come in and say, well I m not this or this; I m something in the middle. This is just, black and white. That is why we re changing that. Scroll down, so let s just cross out those definitions, we will no longer have tourist home, bed and breakfast residents. Keeping what s highlighted, nope, you can go to the next page actually. Alright, so here s what we re updating to the matrix, we are adding restaurants, including microbreweries, micro-breweries and distilleries, because the code had breweries and distilleries as industrial use as well, because it was pulled out of that matrix, the NEICS for the large scale. So we wanted to fit it back into smaller commercial districts, it s something smaller with a restaurant, that s why we paired it with the restaurant category, it s permitted in C-2, C-3, and in all the industrial districts and planned districts as well. Obviously, the only brewery we have in town fits into that C-3 so we wanted to make sure were weren t making that business noncompliant. And then the on right below that, the storage units, and mini warehousing, to put it back into a special use permit C-2, and then permit it again in industrial districts as it was previous to the new code. This next one, it was just something I noticed. We may never get a request for it, but boat docks and ferries landings were only allowed, in industrial districts, or in agricultural, so I put them in our C-3, because obviously, that s the only landing we have is in our downtown, C-3 zoning. The last one is our camp ground an R-V park; this is the last change to the matrix. We re adding R-V Park as part of our definition for our campground and its special use permit across the board. So if someone would come in with a plan, they would have to submit a plan, bring it to P&Z and Council. Scroll down, alright; the last change is just a real simple, type-o you can see, at the bottom last paragraph. Originally when we were first looking at this this, we were going to have our minimum width be 22 feet, we upped it to 25, and someone called and said they noticed that our number was 25 but the words were still 22. So, just fixing that. That s all we have now, I m sure we ll be back in six months to a year with other things people have pointed out, but it was a 400 page document, so I m sure, some of that, have any questions? Construction plans must show hydrants located at every intersection. The number of hydrants and their locations must meet minimum standard set forth in the Development Code. 2. Temporary turn-arounds must be provided at the end of any stub street longer than 150 feet. This includes Kuenzel Drive, Shirley Close Road, Grahm Road, and Mason Close Road. 3.
