MEMORANDUM TO THE CONFERENCEl: This is a supplement to Bill Brennans bulletin this morning on Thurgood: I saw him at Bethesda Hospital at about 9:00a.m., after having cleared with Dr. Brown, Commanding Officer of the Hospital, that the visit would be appropriate. Thurgood was in good spirits, sitting up, and obviously optimistic. He stated that he had a good night, felt much better than he did on yesterday, and said he planned to send his votes for the Conference tomorrow. Dr. Brown confirmed that Thurgood has improved significantly since yesterday, and describes his present condition as satisfactory. June 23, 1975 Dear Judge Green: I write to bring "to your attention the following story which illustrates one of the reasons why justice is so often frustrated. The story concerns a case in the Family Division-Juvenile Branch of your Court, styled as follows: In the Matter of Angelo Boone - Jacket No. J I,. During the Christmas season (about six months ago) one of our employees here at the Court, Mr. Spencer Campbell, was mugged and robbed at the entrance to his apartment at 1507 Fourth Street, N.W., Washington, D.C., He subsequently identified, from police photographs, a picture that he assumes was that of Angelo Boone. The police advised Mr. Campbell that Boone was a convicted juvenile who had been released from detention for the holiday season. Mr. Campbell was requested to testify on behalf of the prosecution, which he was willing to do - although, as you know, many victims of this type of crime are afraid to testify for fear of recrimination. I come now to the essence of the story: Mr. Campbell has now responded to subpoenas from your Court on three occasions, spaced over the past several months. The most recent of these was Thursday, June 19, when - in response to a subpoena - Mr. Campbell reported to Room 107 at 8:30 a.m. He remained there until about 1:00 p.m., and was <

27 finally infonned (he thinks by an Assist:ant Prosecutor) that Boone was in jail and that there would be no trial. Mr. Campbells experience on Thursday was not unlike that of his two prior appearances in response to subpoenas. He sat around for the better part of a day on each occasion, being given little or no information as to the delay. Thus, to date he has wasted three days, we have been deprived of his services here at the ~ourt for three days, and still there has been no trial. When he returned late last Thursday after a wholly exasperating experience in Court, Mr. Campbell remarked to me that there is "No wonder that citizens refuse to testify, and that few persons accused of crime are ever brought to trial and convicted." I may add that Mrs. Rehnquist, the wife of Justice Rehnquist, had a somewhat similar experience in your Court last year when she appeared several times as a witness, and wasted many long hours awaiting a trial that did not materialize. As one who recently came to the Bench from the practicing Bar, I am familiar with the dilatory practices of defense counsel - often facilitated by the consent of over-worked prosecution officers. It is standard procedure to delay trial as long as judges tolerate it, with the reasonable expectation that witnesses will fade away. The result is failure of the judicial system to discharge its necessary function effectively. The delay in our system conveys a clear message to those attracted to crime that the likelihood of punishment is indeed remote. * I make no comment, of course, on the merits of the case. My sole concern is the type of delay, with resulting frustration of the system, which occurred in this case. too... t,

28 3. I have no doubt that you and your brothers on the Superior Court fully share my concern over this problem. Solutions, I am sure, are difficult - if not impossible - as long as you are handicapped by lack of personnel and facilities at the same time that crime continues to spiral upward. In view of the concern of Attorney General Levi for expediting the trial of cases, I am sending him a copy of this letter. He has the opportunity, better than any of us on the Bench, to bring these conditions to the attention both of the public and the appropriate committees of the Congress.., 1!{, With my best wishes. 30 Byron: The Chiefs memo of August 18th has just reached here in Richmond. I note that a "Search Committee" is presumably "searching" for a new Chief of our Security Force. In my own view, the search should end with Jim Zagami, who has impressed me as one of the ablest, and most dedicated, members of the entire staff at the Court. Moreover, I believe in promoting -.rom within unless there is no qualified employee available. I. mention this to you, as I recall a conversation in which you shared fully my high opinion of Lt. Zagami and his qualifications. I wrote the Chief a note before leaving in July, commending Zagami. I note from the Chiefs memorandum that the position will be filled "sometime before the opening of the Term." If you have not already done so, it occurs to me that possibly you may wish to get in touch with the Chief. He greatly respects your views. Jo and I have had a fairly quiet summer in Richmond. Jo and I returned from "your country" Sunday afternoon, forgoing our planned two days of sightseeing because of Jos latjulgitis. We had a most pleasant visit at Brigham Young University. The bench of the Tenth Circuit was there in force, and many of your friends inquired about you and Marien. I was glad to have this opportunity to meet Tenth Circuit Judges. I particularly liked Bob McWilliams, perhaps because he admires you so greatly. The Chief Justice, as you would expect, was in tiptop form: He never missed a reception; added additional meetings to an already crowded calendar; received a standing ovation from 15,000 spectators at the convocation; and ended up Saturday evening s~ing with the choir fa the Mormon Tabernacle! You were kind and generous and made every hour, including the last one on our arduous journey, happy and relaxed. I am reminded of many canoe trips I have taken in my lifetime. Those who start down a water course may be strangers at the beginning but almost invariably are close friends at the end. There were strong headwinds to overcome and there were rainy as well as sun drenched days to travel. The portages were long and many and some were very strenuous. But there were always a pleasant camp in a stand of white bark birch and water concerts held at night to the music of the loons; and inevitably there came the last camp fire, the last breakfast cooked over last nights fire, and the parting was always sad. ~~ And yet, in fact, there was no parting because each happy memory of the choice parts of the journey--and of the whole journey- was of a harmonious united effor.t filled with fulfilling and beautiful hours as well as dul~ and dreary ones. The greatest such journey Ive made ha~ been with you, my Brethren, who were strangers at the start but warm and fast friends at the end The value of. our achievements will be for others to appraise.
