sxteen-pag- e opnon The court orders Sumners money pad to hm declarng the trust deed under whch the cash was held to have been revocable The syllabus s as follows: "A trust cannot be termnated by the consent of nterested partes unless all consent ncludng possble benefcares not yet n beng or su jurs Nearest blood relatves aro not the same as hers and do not a wfe t "In the absence of exceptonal crcumstances a voluntary deed of trust contanng no power of revocaton reservng a lfe nterest n the grantor and wth remanders to relatves s rrevocable "But under the exceptonal crcumstances of ths case the deed s held to be revocable t havng been executed by a weak-mnde- d and easly nfluenced aged man for hs own convenence as he supposed and n consequence of pressure brought to bear upon hm by hs relatve and there beng evdence tendng to show that the trustee and other benefcares as well as the grantor consdered t revocable t The burden s on the trustee seekng to recover a porton of an alleged trust fund to see that all necessary partes are brought n and to show that the sum clamed s subject to the trust "A trustee of an acton may sue for the recovery of trust funds wthout makng the cestus qu trust partes when s relatons wth them are not nvolved "In suts by trustees clamants of very remote and uncertan nterests under the trusts need not be made partes "A bequest to each of them for the of past ltgaton Some rather uncomplmentary language s used n comment upon the actons of those who sought to contnue the trust the court remarkng that whle they were contendng that t was an rrevocable trust they were "wllng enough to partcpate n ts spolaton to the extent of $62000" Ths money should have been pad back f the trust was not termnated says the court The court says : "It doubtless would have been much better for Sumner consderng hs nfrmtes and the actvty and avarce of hs relatves f the trust could have been kept ntact for he would then have been assured a good ncome for the rest of hs lfe but now that the greater porton of the fund s gone and the rest would soon go to others under the trust t may be a queston whether t would be better for hm to keep the balance ted up gvng hm the ncome only or to let hm have t and get what enjoyment he can out of what he s not cheated out of durng the bref remander of hs lfe" The court says that all the crcumstances show that Sumner regarded the trust as revocable and dd not ntend to fnally gve up the management of hs own affars "If there s one thng that he has dreaded t has been the mputaton of nsanty" says the decson and tadds that the late Bshop Gulstan and all others concerned n the case held that the trust was revocable at the tme when the $62000 of the money was dstrbuted by Sumner among hs relatves Says the decson: "The sx attorneys who represented the varous partes at the tme of the dstrbuton were of the same opnon or else they were gulty of delberately jonng n the spolaton of the trust for a share of the booty The Davses were of that opnon as they say themselves and they receved $0000 of the fund besdes $5000 for ther attorneys One thng however does appear that Sumner then from 82 to 84 years of age wth all hs nfrmtes and burdened wth hs trals was then wrestlng practcally alone wth hs relentless relatves and ther attorneys" The charges made aganst one another by attorneys are not dscussed by the court In hs dssentng opnon Perry remarks that they are not a part of the ssue Perry holds that the trust was an rrevocable nstrument and that t should therefore be kept n force a new trustee apponted and the when the S S Korea was dockng In naval slp No The bg vessel gave them good reason for she bumped aganst the wharf so hard as to buckle the floorng and do an ex tensve amount of damage The bow of the vessel was alongsde the wharf and about 80 yards from the head of the slp The bow of the ves sel was close to the wharf but tho after part of the vessel wus slantng out In an Ewa drecton from the sea end of the wharf there beng about thrty feet of space from the vessel and the end ot the wharf The order was gven to send the ves sel ahead and at the same tme she began to slew around toward the wharf In order to He alongsde The double movement forward and to starboard gave the bg craft double momentum The result was that when she dd brush aganst the sea end of the wharf she dd It wth a momentum that wns practcally Irreslstable As the sde of the bg craft swerved aganst the wharf there was a loud crunchng then a louder groanng and crackng of tmbers The people at that part of the wharf felt the asphalt floorng movng up under ther feet For an Instant the crowd thought some submarne earthquake was at work There was no partcular damage done the plng but the vessel swerved aganst the top cappng The floorng was lfted off the ples and buckled The asphalt was cracked In many places and In several spots was shoved up n pyramd form to a heght of two or three feet A wld scramble
