CHARLES, State of Louisiana, dated: THURSDAY, AU- GUST 10, 2017, in the above entitled and numbered cause, I shall proceed to sell at public auction at the principal front door of the Courthouse of which the Civil District Court of the Parish of St. Charles is held on WEDNESDAY, NOVEMBER 29, 2017, at 10:00 A.M., to the last and highest bidder for cash, the following described property, to wit: A certain portion of property, together with all buildings and improvements thereon and all the rights, ways, privileges, appurtenances, servitudes, advantages, batture and batture rights, riparian rights, prescriptions, and rights or prescriptions both liberative and acquisitive, thereunto belonging or in anywise appertaining, situated in the Parish of St. Charles, State of Louisiana, on the east or left descending bank of the Mississippi River, at or near Montz, Louisiana, which said portion of ground is located in section 7, T12S, R7E, Southeastern District of Louisiana, east of the Mississippi River, and is a portion of lots 7, 8, and 9 of the plan J.A, D Hemecourt, dated February 26,1839, and is also a portion of the same tract of ground designated by the letter B on a plan by Arthur De Arman, Surveyor, in November, 1877, annexed to the original Act of Sale by Charles T. Dugazon to Frank Harvey, recorded at COB E, folio 470, of the records of the Parish of St. Charles, Louisiana, and further as shown on a plan of survey of four lots of the Etienne Property by Harold J. Flynn, Surveyor, dated June 19, 1973, and revised June 24, 1973, a copy of which is attached to an Act of Sale by the Etienne heirs to Herbert Royal passed before Steven F. Griffith Notary Public, dated July 6,1973, And according to said plan the said lot is described and measures as follows: Commencing at a distance of feet from the point of the intersection of the easterly boundary line of the Etienne property with the Louisiana Jefferson Highway as shown on plan of Harold J. Flynn, referred to hereinabove to point of beginning. Said property measures thence from said point of beginning north 5 degrees 26 minutes 20 seconds east along the northerly boundary of Jefferson Highway marker feet to the Louisiana Highway department concrete marker, thence from said marker north 8 degrees 31 minutes 40 seconds west a distance of feet to a point, thence from said point north 39 degrees 28 minutes 20 seconds east a distance of 120 feet to a point, thence from said point south 50 degrees 31 minutes 40 seconds east a distance of 100 feet to a point, thence from said point south 39 degrees 28 minutes 20 seconds west a distance of feet to the point of beginning. Being the same property conveyed to Raymond Etienn, Jr. and Terrance Shawn Etienne from Succession of Janice Etienne by deed dated 12/30/2002 and recorded 01/03/2003 in book 613, page 588, Saint Charles Parish records, State of Louisiana. The said Raymond Etienne, Jr., married but one and then to Roxanne Smith having conveyed his interest to the said Terrance Shawn Etienne by deed dated 02/26/2001. And from the proceeds of said sale to pay petitioner by preference over all other claims, the sum of: SEVENTY- ONE THOUSAND FOUR HUN- DRED SIXTY-SEVEN AND 74/100 ($71,467.74) DOLLARS, along with interest and attorney s fees and all other costs including my own costs and charges.
