1 Held: September 18, 2012 Page 1 of 4 The Commission for the Village of South Charleston convened in regular session from 5:00 P.M. to 5:56 P.M. at 35 South Chillicothe Street South Charleston, OH President Larry Tillman called the meeting to order with the following members and visitors present: Vice President Greg Rice, Commissioner Russ White, and President Larry Tillman E MPLOYE ES: Village Manager, Josh Rice, Clerk, Cheryl Spears, Chief Derek Smith and Solicitor Jim Peifer VISITORS: Scott Jones, Rick Lohnes, Jackie Gray, John Gray, Linda Hitt and Dian Montgomery I Call the meeting to order and Pledge of Allegiance II Additions and Corrections to the minutes Commissioner White called for a motion to approve the minutes. With a second by Greg Rice and a vote of 3/0 the minutes were approved. III Discussion of the Bills with a motion to pay The Sunbelt Rental bill was explained. It was noted that the repair bill to the mower was the mower that was traded in but the trade in value did address the cost of the repair. With a motion by Greg Rice and a second by Larry Tillman the bills were approved to pay. I V Guest Speaker Scott Jones from the Clark County Developmental Disabilities Scott Jones spoke about the upcoming levy for Clark County Developmental Disabilities. Mr. Jones passed out information and calendars to the Commission and attendees. He discussed the cost of the levy and discussed the levy fact sheet. V A service line leak was repaired on John Street. Mr. Rice talked about the bill on the new mower. He has contacted DP&L again concerning the street lighting. The contract is up at the end of this year. DP& L will contact Mr. Rice again and set up a meeting. With a vote of 3/0 the resolution passed. O RDIN A N C E A N O RDIN A N C E E N T E RIN G IN T O A C O N T R A C T W I T H JE F F V A L L E R Y F O R T H E R E N T A L O F T H E A G RI C U L T UR A L PR OPE R T Y A T T H E W A T E R PL A N T A ND D E C L A RIN G A N E M E R G E N C Y was read by President Tillman. President Tillman called for a motion to accept the contract. With a second by Greg Rice and a vote of 3/0 the contract was accepted. R EPO R T The clerk gave Commissioners a schedule for Public Records Training and President Tillman stated that he would attend. The clerk will register him for the training. The clerk and Mr. Josh Rice met with FEMA on that day. The meeting kicks off the 60 day period in which all facts and figures have to be submitted to FEMA for remimbursement expenses due to the storm at the end of June. The Village will submit around $ in expenses. V Vice President Rice stated the the contract with the Opera House Lease to the Heritage Commission expired on January 2011 and needs to be revisited. He feels the village should receive

2 Held: September 18, 2012 Page 2 of 4 compensation in the way of expenses for toiletries and the cleaning of the bathrooms for Opera House events. Clark County Commissionr Rick Lohnes stated that ClarkCounty Developmental Dissabilities service is a great asset to the community and that the TAC Industries Awards Dinner and Tac choir is outstanding. John Gray stated that he and his wife were present to check on the status of the Commissioners decision on his driveway project. Jim Peifer stated that the review has been done and and the alternate route discussed. Greg Rice stated that the answer has been given that the driveway is to be 25 feet from the wellheads and placed south of the pumphouse. Mr. Gray stated that if that was a verbal answer and agreement of all three commissioners then that is all he wanted to hear. Mr. Gray thought there would be a commission vote. Josh Rice stated that Steve Canter has stated the drive had to be 25 feet from the wellheads. Mrs Gray stated that they had then contacted EPA and EPA requested 10 ft. Mr. Josh Rice stated that was a mute point. Mrs Gray stated that is was not a mute point. She stated that Mr. Canter misquoted something. She stated that Clark County Engineers had not seen the plans. Mr. Josh Rice stated that there had been discussion to let the county see the plans for review but not for Clark County s approval. Mr. White stated the the village controls that area and that Clark County approval is not needed. He went on to state that the EPA has minimum standards and that village controls what goes near the wellhead. Mr. White further stated that if the village staff engineer recommends 25 feet distance he will agree with the engineer and not vote against what a paid professional is recommending the village do. Mr. White stated that before any work was to be done the Commission was to approve plans.the work was done prior to plan approval and now we are talking about something that should have taken place 6 months ago had the commission gotten the plan before anything was ever done. If the engineer states to go around the south side of the building then the drive goes around the south side of the building and it does not need to go into any further discussion. Josh Rice stated that he concurred. Mr. Gray stated that if that was the decision that was the first he had heard of it. It was the first he heard of an alternate route. Jim Peifer stated that the surveyor had been out. Mr. Josh Rice stated the alternate route had been disucssed since the Grays first submittal. President Tillman stated that he rememberd the Grays stating that it would be too expensive for them to use the alternate route. Mrs. Gray stated that it would be a financial burden. Mr. Tillman stated then that means we discussed it. Mr. Gray stated the problems disussed were drainage, radius and having to write the easement paperwork. Mr. Tillman stated that the village had given them a gift and now it sounds like an obligation. Mrs. Gray went onto explain how many times the bridge has flooded. She stated that they had tried not to step on toes. Neighbors behind could not help them. Mr. Tillman stated that the Loveless option may have changed. Greg Rice stated that he felt things have taken so long because the commission has tried to accommodate the Grays. The only way the commission can meet the requirements is to put the drive 25 ft distance from the wellheads and place it on south side of the pumphouse. The commission is waiting on the surveyor to plot everything out. Mrs. Gray wanted permission to move the barricades to get fuel oil delivered. She stated that the fuel oil has always been delivered across the front. Mrs. Gray stated that they have been wrongly judged and never had a chance. Mr Greg Rice asked if all they wanted was 2 trucks one time each to enter onto the property.the answer was yes. Greg Rice was okay to let the Grays do that as long as the Grays call the town hall when the trucks are coming and one time each for each truck would be allowed Larry Tillman stated that it was okay with him as long as the Grays would be responsible if something happened to the wellheads when the delivery was being made.

3 Held: September 18, 2012 Page 3 of 4 Linda Hitt spoke to commission about the weeds and foreclosed properties around the village. She noted that she had moved here three years ago and loves the town. She does not want to see the town go the way of South Solon. She stated she has not seen the street sweeper being used for awhile. Larry Tillman stated that it had not rained in awhile and that is when the street sweeper is used. Mrs. Hitt stated that in Springfield people have to maintain their sidewalks and wondered if people in South Charleston had to be responsible. She mentioned weeds in the gutters in front of properties. She stated a horse had made a mess on a sidewalk and wondered who was responsible for cleaning up the droppings. She stated houses in foreclosure that are falling apart. Mr. Tillman stated the commission was aware of the houses in disrepair. She commented that maybe a community day could be started to help persons who could not take care of their yards. Dian Montgomery reported on weeds along the street at the football field and reported on other streets and weeds. She stated where a person has removed a sidewalk and placed gravel approach to their drive. Josh Rice stated that he has addressed that situation. Greg Rice stated that the issue has been discussed many times and there is a balance between property rights and property values. The grass isssues can be addressed but the foreclosed properties are the banks responsibilites. Russ White stated that it is unfortunate that people have to be told to take care of the weeds in front of their house. He stated that if a village tree was in front of his house he would trim around it, but some people don t. Larry Tillman thanked the ladies for coming and bringing attention to the problems and maybe they could form a group to do something once a year. Scott Jones stated this would be an opportunity for a group participation with his group. X M O T I O N T O A DJO URN Russ White called for a motion to adjourn. Larry Tillman seconded the motion.
