1 Descendants of Jacob Dively Generation No JACOB 1 DIVELY was born 1734 in Wuertemberg, Germany, and died 1783 in Hagerstown (Washington County) Maryland. He married ANNA MARIA UNKNOWN. She was born 1736 in Germany. Notes for JACOB DIVELY: I believe that I wrote some time ago that I had opened up a correspondence with a second cousin of ours at Kansas City in this state by name of Michael Diveley. Have just read a letter from him. He visited the old Diveley in Salisbury, Pa. last summer and learned from the records in the family of one of his brothers there that our greatgrandfather first name was Jacob, that he came from Wurtemburg, Germany married in Switzerland, and located in Baltimore County, Maryland in 1770 Letter from Frederick D. Snyder about 1873 More About JACOB DIVELY: Record Change: 11 Jan 2001 Notes for ANNA MARIA UNKNOWN: At the request of Ann Dively was the following deed recorded October 22, 1783 (to wit) This indenture made the ninth day of October in the year of our Lord one thousand seven hundred and eighty three between Jonathan Hager of Washington County and State of Maryland on the one part and Ann Dively of the county and state aforesaid on the other part witnesseth that the said Jonathan Hager for and in consideration of the sum of one shilling current money of Maryland in hand paid by the said Ann Dively, the receipt whereof the said Jonathan Hager doth hearby acknowledge granted bargained and sold and doth by these presents grant bargain and sell and confirm unto the said Ann Dively and her heirs and assigns the one half lot or portion of ground in Elizabeth Town in Washington County aforesaid the said half a lot or portion of ground number one hundred and fifteen containing forty-one feet in breadth fronting on the public street another hundred and forty feet in length more or less lying and being alongside of the lot or portion of ground number one hundred and seventeen with all profits advantages and appurtenances to the said half lot or portion of ground belonging or appertaining to have and to hold to her the said Ann Dively her heirs and assigns forever to her or their own use and to us other use intent or purpose whatsoever who said Anna Dively her heirs and assigns and then paying therefore yearly and every year forever on the twelfth day every March yearly and every year unto the said Jonathan Hager his heirs and assigns the annual rent of two shillings and three pence sterling. The first payment to be given commence the twelfth day of March ensuing the date hereof and the said Jonathan Hager for himself and his heirs doth covenant and agree to and with the said Ann Dively her heirs and assigns that her and they shall and hold peacefully enjoy and possess the said half lot or portion of ground. 5 Dear Uncle I take this present opportunity of informing you and your family, of the death of your father, this xxxxxx xx xxx xxxxx xxx to you and your family never the less it is thru the great destroyer death the common enemy of man, that hath the power to destroy the body, but hath no power over the soul laid its claim upon him without giving him much of a warning in the way of sickness xxxx and he calmly submitted to the summons of death which xxxxx xxxx a way from earth to slumber in the silent tomb, but the apostle says that xx xxxx of this one thing or those which do not xxxx xx xxx for if we believe that Jesus died and rose again will God bring with him, so her commands us "Therefore comfort one another with these word, for some months past his hearing and eyesight began to fail him very fast so much so that it was hard to make him understand xxx when they would speak to him and his eyesight before he died was so that it was most impossible to distinguish one person from another across the room, but he was still able to go about as spry as when you were here and wood work or chop wood xxxxxxx xxx a long xxxxx he was always out to work and it was impossible to keep him from it, on Monday or Tuesday before his death he had been out in the woods chopping wood and on Tuesday or Wednesday he began to complain with a pain in the breast but not very much at that time, until on Friday that day he kept in bed most of the time but they thought not xxxx xxx very strange of that for he has often had such spells and complained a good deal more than he did this time for he had been troubled with a pain in the breast for about 10 or 15 years more or less, but on Saturday morning (I had came there the evening before) being the day of his death July 11, 1857, he seemed to be very restless he would go to awhile and then would get up and walk around out of doors and seemed to be in more misery than he had been before and he said that he would like to have the doctor brought if he thought that he could do him any good so I went down to uncle Georges and told him for he did not know that he was ailing. So he went up to see him but grandfather was out of doors and he with the rest of us he did not think he was any was dangerous, and I went up to his house at noon and he got up out of bed and ate quite a hearty dinner then I left to go where I am boarding and teaching school about 2 miles from grandmothers and uncle went to town, so about 4 in the afternoon he stepped out of doors and Mary Snyder went out pretty soon afterwards and found him lying dead by the end of the house. He had just stepped out and dropped down dead. So they sent to town for George and he came home immediately and sent for xxx xxxx that live in xxxx xxxx He was buried Sunday the 12th uncle George (your brother) had him buried in a plain decent and respectful manner the funeral sermon was delivered by minister McConal of xxxxx with a minister of the Christian church the text on that occasion is found in the 17th Psalm and last verse, there were quite a number at the funeral your father has lived to see quite a number of days come to end but he has now gone to his reward and his body is lying in the valley of the shadow of death awaiting till its xxxxx when it shall be fashioned like unto the xxxx of our Lord and Savior xxxxx xxxxx xxxxx our mind the longing of the poet which xxxxxx xx winging us a way to our eternal home, life is but a winters day a journey to the tomb! But the Christian will enjoy health and beauty soon a xxxx xxx far beyond this world xxxx xxxx xxxxx I had made out grandfathers age as xxxxxx as it can be come at and the place of his birth, he was born in Hagerstown, Maryland on March 9, 1772 and came to Ohio in the year 1805, he has been a member of the Christian Church about 22 years, he died July 11, 1857 which makes him 85 years, 4 months and 2 days when he died. 6 Greenville, Ohio March 31st, 1863 My dear uncle and cousins, I now seat myself to relate to you the sorrowful news of your dear olde mother. Yes, grandmother is dead! She departed this life Saturday evening March the 21st about half past 9 o'clock. She was taken from us very sudden. She was only complaing about three days, through the day she was as common, but could not swallow well and complained of not sleeping the night before, after supper she was taken with shortness of breath, and expired in about an hour. She had been bedfast three years and two months, in which time we waited on her just as a child, but I did it with all the patience a human could. According to my notes she married KERTZ and had a daughter who married a Gebhart or Gephart, a wealthy merchant of Dayton, Ohio. I wonder if you know anything of these Gebharts? 7 Record Change: 11 Jan 2001 Notes for JOHN KURTZ: The first record we have is of John Kurtz, who settled at an early day in Somerset county, Pennsylvania, where he was an honored and influential citizen. He served as associate judge of that county, and as a representative to the state assembly in He was a strong Democrat and a firm believer in the greatness of President Jackson, but when "Old Hickory" vetoed the United States Bank charter, he lost the friendship of John Kurtz, who ever afterward voted the Whig ticket. Diveley was born in Berlin, April 4, 1840 and was the last surviving member of the pioneer resident of Berlin, Martin Diveley. With his elder brother Charles A. Diveley he enlisted in Co. C the 54th Pennsylvania volunteer infantry as a musician and served throughout the war, being taken prisoner with the rest of the regiment at High Bridge, Va. four days before Lee's surrender at Appomattox. He was mustered out with his surviving comrades at the close of the war, and with his brother, Charles, located in Meyerdale and made his home with his brother and wife, remaining single all his life. He was known to the entire population as "Professor" Diveley, many years of his life having been devoted to school teaching. He was a man of good education and kept abreast of the times intellectually by varied and constant reading. He as exceedingly conscientious in his work and all of his dealings. As a teacher he ranked among the best of his time in the local educational field, having taught a number of terms in Meyersdale and surrounding townships. He also taught in Frostburg and Cumberland, Maryland and for several years was an instructor in the Civil War soldiers' orphan school at Jumonville, Fayette County, near Uniontown. After retiring from the teaching profession, he served as Borough Assessor for a number of years and was 17

16 noted for his good judgement in fixing real estate values and his justness in equalizing assessments. He traded some in real estate and was a good business administrator. Professor Diveley had all the instints of a gentleman and was courteous and kind in his contact with his fellow citizens. He was highly respected and esteemed by all who knew him, and his advice and counsel were sought by many people in trouble or distress. He was generous and sympathic and helped many a needy person or worthy cause, but was never prodigal or wasteful of his substance. Although an ex-soldier and patriotic to a high degree, he did not parade his patriotism and never joined the Grand Army organization, although he was usually regarded as a member of the G.A.R. He was a member of the Zion Evangelical Lutheran Church. Funeral services will be conducted by his pastor Rev. J. Luther Frantz at the Diveley homestead on Main Street, at 2 o'clock Friday afternoon and will be buried with military honors. He was aged 83 years, 11 months and 26 days. Since the death of the Diveley brothers, there are only four Civil War veterans left in Meyersdale. They are Dr. H.C. McKinley, M.A. Rutter, Peter Albright and John Stacer.
