1 GARLAND COUNTY QUORUM COURT SPECIAL MEETING AGENDA June 25, 2018 A special meeting of the Garland County Quorum Court will be held in the County Courtroom June 25, 2018 at 6:00 p.m., 501 Ouachita Ave, Hot Springs, Arkansas, with County Judge Rick Davis presiding. Opening Prayer Pledge of Allegiance Roll Call Reading of Proposed Ordinances: O O AN ORDINANCE TO AMEND ORDINANCE O MANDATING DIRECT DEPOSIT OF GARLAND COUNTY EMPLOYEE PAYROLL; AND TO PROVIDE FOR AN ELECTRONIC WARRANT TRANSFER SYSTEM FOR OTHER APPROVED WARRANTS DEEMED NECESSARY; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. AN ORDINANCE AUTHORIZING THE FILING OF A LIEN FOR THE COSTS OF EMERGENCY ABATEMENT AND CLEAN UP OF OFFENSIVE, HAZARDOUS AND UNSANITARY CONDITIONS AT 117/126 ARCADE STREET, HOT SPRINGS, ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. 2 ORDINANCE NO. O BE IT ENACTED BY THE QUORUM COURT OF GARLAND COUNTY, STATE OF ARKANSAS; AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO AMEND ORDINANCE O MANDATING DIRECT DEPOSIT OF GARLAND COUNTY EMPLOYEE PAYROLL; AND TO PROVIDE FOR AN ELECTRONIC WARRANT TRANSFER SYSTEM FOR OTHER APPROVED WARRANTS DEEMED NECESSARY; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, Arkansas Code Annotated (a) allows for the Quorum Court of each county to establish an electronic warrants transfer system in payment of any account allowed against the county; and, WHEREAS, Arkansas Code Annotated (c) further stated that a single electronic warrants transfer may contain payments to multiple payees, appropriations, characters, and funds; and, WHEREAS, the County Treasurer would like to make electronic warrants for not only payroll direct deposits but also, for payroll taxes, APERS, employee benefits, voluntary payroll products, Department of Finance and Administration Sales and Use Tax, distributions to local schools, distributions to Voluntary Fire Departments, and any approved warrants deemed necessary; and, NOW, THEREFORE, BE IT ENACTED BY THE QUORUM COURT OF GARLAND COUNTY, STATE OF ARKANSAS: SECTION 1. That an electronic warrants transfer system is hereby amended for Garland County. SECTION 2. That the county established an electronic payment method on March 14, 2011 that provides for internal accounting controls and documentation for audit and accounting purposes. SECTION 3. That the county has received approval by the Arkansas Legislative Audit Committee to amend the warrant transfer system. SECTION 4. That this Ordinance shall be codified in the Garland County Code of Ordinances and the Sections may be re-numbered and re-lettered to accomplish such intention. SECTION 5. As time is of the essence in getting the warrant transfer system established an emergency is hereby declared to exist, and this ordinance shall be in full force and effect from and after its passage and approval. 2

O BE IT ENACTED BY THE QUORUM COURT OF GARLAND COUNTY, STATE OF ARKANSAS; AN ORDINANCE TO BE ENTITLED: AN ORDINANCE AUTHORIZING THE FILING OF A LIEN FOR THE COSTS OF EMERGENCY ABATEMENT AND CLEAN UP OF OFFENSIVE, HAZARDOUS AND UNSANITARY CONDITIONS AT 117/126 ARCADE STREET, HOT SPRINGS, ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, Mrs. M. Garfield Hutchinson is the owner of record of certain real property situated in Hot Springs, Garland County, Arkansas, more particularly described as follows: LAYMAN'S DESCRIPTION: 117/126 Arcade Street GARLAND COUNTY PARCEL: WHEREAS, offensive, hazardous and unsanitary conditions existed on the property to such degree as to constitute a public health hazard and an imminent safety hazard to life or property, creating a need for emergency abatement by Garland County pursuant to Garland County Ordinances and , as authorized by Arkansas Code Annotated ; WHEREAS, Garland County performed emergency abatement and clean up on said property and expended $17, in equipment use, man hours, and disposal costs, pursuant to the Affidavit of Expenses attached hereto and incorporated herein as Exhibit 1. WHEREAS, Garland County is authorized by Ordinances and , as authorized by Arkansas Code Annotated to assert a lien for the costs of abatement and clean up, WHEREAS, notice of intent to assert a lien and notice of the date and time of the public hearing in this matter has been provided by certified mail and regular mail to the owner of record, to any other persons listed for notice purposes regarding this parcel in the Garland County assessor s records, and such notice has been posted on the property, NOW THEREFORE, BE IT ENACTED BY THE QUORUM COURT OF GARLAND COUNTY, STATE OF ARKANSAS: SECTION 1. That Garland County, by its appropriate official or designee, is hereby authorized to file and record a lien against the above property in the amount of $17,022.55, plus costs, together with the costs of collection. SECTION 2. That the Quorum Court hereby certifies $17,022.55, plus costs, together with the costs of collection to the Garland County Tax Collector to be placed on the tax books as a lien on the above described property and collected accordingly. 4

5 SECTION 3. That this ordinance shall be codified in the Garland County Code of Ordinances and the Sections may be re-numbered and re-lettered to accomplish such intention. SECTION 4. That time is of the essence and an emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the health, safety and welfare of the citizens of Garland County, Arkansas, shall be in effect immediately upon its passage and approval.
