Annual Subscrpton $2.00 TYPHOD We have n our fles a very comprehensve survey of the typhod cases n Youngstown for 1932 whch was wrtten at Our request by Dr Lewaaron Moyer and whch unfortunately on account of ts sze we are unable to prnt n full. The substance of the artcle and the conclusons drawn may be brefly summarzed as follows: 1. The number of cases for the past sx years n Youngstown n 1927 '28 '29 '30 '31 and '32 were and 28 cases respectvely thus showng an ncrease n the last year tabulated. 2. Youngstown showed one case per 6071 populaton whch was decdedly hgher than Struthers Campbell or the County. 3. The peak of the number of cases occurred durng July August an September the months durng whch the cty harbored the greatest number of transents also the months durng whch we consume more green vegetables. 4. n 85% of cases the water consumed was from wells whch undoubteelly was of questonable safety. 5. The Cty water supply and the recognzed dares were exonerated as possble sources of nfecton. (Snce the wrtng of the artcle there have been reports of bootleg mlk beng sold n the outskrts of the cty wh would be a potental source of danger.) 6. No drect relatonshp was found between the shuttng off of th ety water for non payment of blls and the ncdence of typhod. 'rne wrt r however ponts out that shuttng off of cty water s not conducve of the best nterests of santaton and nasmuch as those famles have to depend for ther water supply on unproven sources would furnsh a potental sourer of clanger. As the summer months are approachng we wll no doubt see more cases of typhod and some thought on the subject and a few words to th publc are tmely and n ordel'. The ncdence of typhod can be greatly dmnshed by followng a few smple rules of hygene and santaton: 1. Do not drnk water the source of whch s not known or f t must be drunk bol the water. 2. Do not buy mlk from unknown sources. 3. Before gong on a trp nto a locaton where the source of water s not known the best protecton s prophylactc typhod vaccne The lalf war has proven the effcacy of ths measure; and the small nconvenence and cost of prophylaxs fully protect one aganst a very serous protracted and frequently fatal dsease. Any physcan s prepared to gve the prophylactc njectons. 4. Do not bathe n doubtful swmmng places. The ncdence of typhod fever n Youngstown s not greater than a large number of other communtes but the dsease s so serous and the preventve measures are so smple that wth the proper santary precautons and prophylaxs there s no reason why typhod should not be wped out. Unbuckle the flaps and the odor of the harness maker's leather pervades and almost obscures the more delcate and subtle scents of the crude drugs of a past century whch are stll wthn. + + Here was the whole stock and store wth whch Dr. Peter Allen rode out to meet the challenge of vared needs among the lonely log cabn settlers of the Western Reserve. store. But most mportant of all a great physcan studous skllful and nfntely knd brought them along on hs soltary rdes through a fronter wlderness. They are n the Allen Memoral Lbrary today because hs grandson Dr. Dudley Peter Allen whose memoral the lbrary s placed them n the old lbrary together wth a small group of treas ured mementos of early medcne whch formed the nucleus of the present museum collecton. But enrched opportunty came to Dr. Allen for durng the war of 1812 he was surgeon n Colonel Hayes' regment hs appontment beng the frst made to the army on the northern fronter of the state. Near Sandusky he found malara to be a more deadly foe than the Brtsh for ths termnated hs servce prematurely. Though hs volunteer servce was never recompensed he was subse quently enabled because of hs army surgcal experence to do most of the surgery n hs part of the country. Fractures of lmbs and cranum and severe axe njures were frequent n clearng forests. He performed amputatons of the leg and the arm even at the shoulder jont lgaton of the femoral artery for aneursm hernotomy tracheotomy and removal of tumors. Wthout the use of anesthetcs or antseptcs surgery was ndeed a test of skll and courage. We note also that durng an epdemc' of smallpox among the ndans he treated them by noculaton wth vrus taken from other smallpox patents the procedure then n vogue and not a case was lost. As for hs prvate lfe n 1813 after fve years of practce Dr. Allen marred Charty DUdley. who was born n Bethlehem Conn. on hs own brthdate. They settled on the farm where he spent hs lfe. n 1821 he bult a house whch s stll standng and whch was very elegant for ts tme. Mrs. Allen ded n 1840 and a year later he marred Fanne Brewster Starr who lved only fve years. n 1825 hs youngest brother Dr. Francs T. Allen entered practce wth hm remanng four years. Ths gave hm lesure for medcal conventons and even for some publc servce. He often attended meetngs of the phy scans of Trumbull and Portage countes and later those or the state as socaton. n 1827 he rode to Columbus on horseback to ad n the organza ton of the state medcal socety the journey takng an entre week each way. He even served one term n the Oho House of Representatves but deplored ther dlatory tactcs and declned re-electon. n 1837 hs son Dr. Dudley Allen. had just graduated from Western Reserve College and Jefferson Medcal College and entered hs father's practce Havng relnqushed actve practce n 1832 Dr. Peter Allen contnue(l to work n behalf of the professon. He attended as censor the medcal college at Wlloughby and later at Cleveland takng an actve part n the examnaton of students. Dr DaCosta was born n Phladelpl{a November He receved hs prelmnary educaton n the Frends Central SChOol later attendng the Unversty of Pennsylvana where he was a specal student n the Towne Scentfc School n the class of 1882 He receved hs degree n medcne from Jefferson n He began hs professonal career as resdent physcan at the Phladelpha General Hosptal (01' Blockley) n 1885 and the followng yeal' was assstant physcan n the nsane department. of that hosptal. n 1887 he became assstant demonstrator n Anatomy at Jefferson Medcal COllege and assstant surgeon at Jefferson Hosptal. n 1898 he became Professor of Clncal Surgery and two years later acqured the ttle of Professor of Surgery. Perhaps hs greatest honor came to hm n 1901 when he was apponted Samuel D. Gross Professor of Surgery at hs Alma Mater. He was consultng surgeon to many Phladelpha hosptals and at one tme was Commander Medcal Dept. U S. Navy R. F. He was a Fellow of the Amercan Surgcal Assocaton Fellow of the Amercan College of Surgeons Member of the College Physcans of Phladelpha Assocate Member of the Socety of Gynecology and Surgery of Buchal est. An ncapactatng and panful arthrts compelled hm durng the last decade of hs lfe to conduct hs clnc and delver hs lectures from a wheel char. He was unable to resume hs college and hosptjl.1 work at the begnnng of the present academc year yet he managed wth the utmost dffculty to complete the revson of the tenth edton of hs most famous publcaton "A Manual of Modern Surgery". He has publshed many lterary contrbutons to surgery. Early n hs career he ntated a medcal authorshp whch brought hm nternatonal recognton. n 1895 he publshed the frst edton of hs "Manual of Modern Surgery". n 1899 he became edtor of the Englsh edton of "Zuckerkandl's Operatve Surgery" and n 1905 edtr;d the Amercan edton of "Gray's Anatomy". As a clncan and teacher Dr. DaCosta was surpassed by none. By reason of the fact that a large number of personal njury c'ases arsng out of automoble accdents are beng constantly tred n ths localty t becomes mportant for both the legal and medcal professons to have a proper frendly understandng of ther respectve rghts dutes and oblgatons one toward another. We apprecate that n our respectve professons there are always certan ndvduals who entrely dsregard any dea of frendly co-operaton between the professons. n other words they are actuated by purely personal selfsh motves However t s hoped that some means or method wll be found where there can be a frendly frank dscusson of the many questons nvolvng the relatons between the lawyer and the physcan and f ths artcle can be but a start towards a more frendly and co-operatve understandng between those practcng ther professons much wl! have been accomplshed. n a dscusson of medcal testmony or medcal wtnesses we necessarly have to consder t from two standponts frst the physcan or surgeon who appears n court to testfy as an "attendng physcan" and sec'ondly the medcal wtness who appears for the purpose of testfyng as an "expert". The general legal rule s that where a physcan has been n regular attendance upon a ltgant and s called upon to testfy as to the njures to or physcal condton of the ltgant the medcal wtness s then permtted to take nto consderaton all of the statements declaratons etc. of the patent to the physcan. The reason for the rule s that the law presumes that a patent beng attended by hs regu'ar physcan wll naturally state the truth to hs attendng physcan n the hope of thus assstng n a recovery and therefore the law attaches to the statements made by the patent to hs regular attendng physcan a certan degree of verty. The expert should always remember that although hs opnons may be perfectly correct the statement of facts n the hypothetcal queston propounded to hm by counsel may have been proven not to exst. For ths he s not at all responsble. To take hgh rank as a medcolegal expert requres a thorough practcal knowledge of the professon keen eyes to observe and an mpartal mnd to reflect and decde upon the facts n each case. A man may be a most capable and profcent physcan or surgeon and yet make a very poor medcal wtness. The lawyers on both sdes of the case have been for weeks and t may be months delvng nto the best medcal and surgcal books treatng of the subject under nvestg-aton whether t be nsanty d-sease wounds or posons for the purpose of obtanng all possble lght thereon; besdes they have consulted wth ther frends among the physcans as to the relatve value of ths or that medcal authorty; how ths theory has been exploded and that one verfed; of smlar cases met wth n practce etc. All the nformaton thus obtaned they have at ther tongues' ends. The medc"al wtness very naturally adopts terms phrases and a language whch usually s entrely "over the heads" of the jury and we may say "over the head" of the attorney. The language of the medcal wtness should be smplfed as much as possble. Hs worth as a wtness n the case s dependent upon not the use of techncal terms but upon hs portrayng by smple every day language hs deas and convctons. The deas set out above are but an attempt to brng to our mutual attenton questons of nterest to both of our professons and are for the purpose of promptng an nqury as to what can better our mutual relatons. f the wrter through hs lmted experence has been of any assstance n the furtherance of a better understand.ng he s amply repad and would take t as an expresson of confdence to assst n a more C'omplete understandng. W. P. Barnum. '1 Medcal wtnesses as other wtnesses must solemnly swear to tell the truth before testfyng. Solemnly swearng s a custom. of the court system but the sweanng that occur's after the testmony s a matter of one's own busness. Physcans as a rule are qute profcent n swearng. as everyone knows and t s seldom that one comes from the wtness char wthout havng the desre to swear a lttle more and n a dfferent manner. Ths no doubt s due to the SOLEMNLY SWEAR atttude of the legal professon toward medcal experts or other wtnesses. They seem to have a great desre to ntmdate and terrfy the wtness. Sometmes he comes from the wtness char n such a state of confuson that he s not normal for the balance of the day. One medcal wtness recently came here from Cleveland and after beng quzzed and cross-questoned by one of our attorneys was so confused that he left the courthouse wth another man's hat and

Agan we come n contact wth a.ttorneys who are very gentle and.tll thorough n ther questonng and t would seem that they gan more from the wtness than the attorney who bellows loudly and almost threatens and attempts to ntmdnte the doctor. Attorneys are not the only ones at fault. \Ve have n the medcal professon members who possbly may not be entrely accurate n ther statements n court unntentonally of course. Solemnly swearng recalls a stunton whch daly occurred n the r<>urt of one of our large ctes. The Balff swore n the wtness as folows: He would say: ''Rasarahanyousolsweartelltruwholetruannuthnelsbuttru. Swelp you God." He ran the words together so that U!' last part was the only part the tue'-.s5 understood. :'orany physcans seem to feel that n beng medcal wtnesses they must know the answers to any and all questons propounded and they try to answer whether they know he answer or not. A physcan was once testfyng ('T(' n a damage sut n whch the llm was that the old fashoned a':ro llac njury had been sustaned by the plantff. The physl'fn mentoned sad that there was no evdence whatsoever of a sacra-lac dsturbance; whereupon h.' plantff's attorney proceeded as follows: Q. "Doctor you have many books on sacro-lac dsturbance have you not? A. Yes. Q. Have you read "Jones"? A. Yes. Q. Have you read "Albee"? A. Yes. Q. And you subscrbe to what ('y say? A. Yes. And he went on to menton many Jl)'" orthopedsts and to each nqury the doctor agreed that he had n'ad the books. Fnally the attorny sad: Q. Have you read "Van Duesen" '? A. Yes. Q. And you subscrbe to what he sad? A. Yes. Then the attorney grnned broadly and sad " am very glad you subscrbe to what Van Duesen says. also agree wth hm. The book s here f you wsh to see t. t s a fsherman's manual." The doctor of course looked very foolsh and hs testmony was com_pletely lost because the jury could not beleve hm. t would seem that our system s bad as far as expert testmony s concerned and a system whereby a group of four or fve physcans apponted jontly by the judges the defendant and plantff's attorneys and the Medcal Socety would gve more satsfactory results. t.would elmnate the brow-beatng and ntmdaton of the physcans n court and would help much n arrvng at a correct dagnoss and prognoss. magne a physcan gong nto court and swearng that a broken leg f t healed was stronger and better than one not broken Most anyone would doubt that but f he beleved t he mght thnk that f we had all our bones broken. as a health m.easure t would be advantageous. On the whole ths busness of beng a medcal wtness s not so "hot" and even after solemnly swearng to tell the truth the mpresson the doctor gans or has s that even f he s tellng the absolute truth as best he can everyone seems to thnk he s lyng lke the devl. Probably the jury judge and attorneys don't thnk ths at all but that s the mpresson the medcal wtness carres away. To show how some attorneys doubt the veracty of medcal wtnesses partcularly f he be on the opposte sde of the case the followng ncdent s apropos: An attorney n an outer room of one of our courts saw a doctor there Who usually was on the defense sde of the case and was seen frequently n court. The doctor was lmpng around the room and ths partcular attorney sad "\ hat s

The attorney asked f Jl was panful and was answered n the affrmatve; whereupon the quck-wtted attorney sad: "Why doctor ddn't know you even beleved n pan". wsh we could all get together and work for a change n our methods; the change t seems mght be made and the results mght be better. All n all justce usually prevals. The attorneys are mostly good fellows and the doctors are mostly a pretty far lot but ths beng "razzed" n a court room s a source of terror to most physcans and the poor physcan has no recourse unless perchance he s fortunate enough to have the prvlege of removng adhesve plaster from the attorney's hary chest at some future tme. No doubt at hundreds of meetngs of medcal socetes durng the past few months there has been dscussed the pressng problem of how the prvate pracltoner may contnue to gve a good qualty of sckness servce to those unable to pay. Not only have we heard of no selfsh destructve plans recommended or adopted but on the contrary we have heard of scores of plans whose adopton would ad n solvng the dffcultes of the present emergency as well as eventually result n great mprovement n the means for dstrbutng good medcal servce to the famles of the ndgent and those who constantly border on ndgency. n Battle Creek Mchgan a plan was adopted under a recent enactment of the legslature makng all forms of relef to the ndgent a problem for each cty and townshp nstead of the county as a whole. As a means of attemptng to mnmze chronc ndgency..the Battle Creek plan ncludes the sgnng by each patent of a note and agreement to pay back to the cty any money expended n behalf of fuel and medcal care. The note also ncludes an agreement wth the ndvdual permttng hs future employer to deduct ten per cent from earnngs to repay such expendtures. Ths plan nvolvng an unsecured loan should protect the dgnty of the worthy seeker of relef and at the same tme dscourage unnecessary requests. n Oakland County Mchgan where n the cty of Pontac alone there were 2400 famles on the welfare lst the medcal relef problem was met by a contract plan drawn between the organzaton of physcans and the muncpal corporaton of Pontac.
