1 August 23, 2018 The regular meeting of the County Commissioners of Allegany County was held in the Commissioners Meeting Room, Allegany Room 100, 701 Kelly Road, Cumberland, at 5:00 p.m. on the above date. The following were present: Commissioner Jacob C. Shade; Commissioner Creade V. Brodie, Jr.; County Administrator Brandon S. Butler; and County Attorney William M. Rudd. Commissioner William R. Valentine was not present because he was attending an out of town meeting of the Kirwan Commission. The following business was transacted: The Pledge of Allegiance was led by Danny Williams. MOTION There were no additions or deletions to the Agenda. MOTION Upon Motion by Commissioner Brodie, seconded by Commissioner Shade, and Motion carried, the Commissioners approved the Minutes of the August 9, 2018, public business meeting. PRESENTATION Item 1 Allegany County Economic Development Strategic Plan Amanda Straight, Senior Project Consultant, and Dustin Lester, Assistant Director of Economic Development, Thomas P. Miller and Associates, Indianapolis, Indiana. A copy of the power point presentation given by Amanda Straight and Dustin Lester of Thomas P. Miller and Associates regarding the new Allegany County Economic Development Strategic Plan is attached to and made a part of these Minutes. Following the presentation, County Administrator Brandon Butler pointed out the Economic Development Steering Committee consists of not just County staff, but also includes representatives from County stakeholders such as the Chamber of Commerce, Allegany College of Maryland, Frostburg State University, and the Cumberland Economic Development Corporation. In response to a citizen comment from the audience, Ms. Straight explained that there will an industry analysis included in the Plan, and that effort will be made to identify the best target industries across the board. PUBLIC HEARING Item 2 Road Opening Petition Christopher L. Owens, Teresa M. Owens, Frances Ann Hixon, Kathy L. Robinette, Genevieve Yonker, and Magnolia Greene Limited Partnership The road opening petition is with the intent of closing a certain portion of an unnamed public alley shown on the plat of Lands of Lewis Heirs and Lewis First Addition and intersecting the easterly side of Winchester Road in Election District 29, Allegany County, Maryland Stephen C. Wilkinson, LLC, and Saad & Saad, LLP, Star Title Agency, LLC. Attorney Stephen C. Wilkinson appeared in representation of the Petitioners. Attorney Wilkinson presented documentation, including courtesy copies for the Commissioners. He invited the Commissioners to ask any questions they would like. Commissioner Shade then opened the Public Hearing on the Road Opening Petition of Christopher L. Owens, Teresa M. Owens, Frances Ann Hixon, Kathy L. Robinette, Genevieve Yonker, and Magnolia Greene Limited Partnership for the intent of closing a certain portion of an unnamed public alley shown on the plat of Lands of Lewis Heirs and Lewis First Addition and intersecting the easterly side of Winchester Road in Election District 29, Allegany County, Maryland. He asked if anyone had any public input regarding the Petition. No one came forward to speak. Hearing closed. Item 3 Code Home Rule Bill 3-18 Public Hearing Residential Development Incentive Program Brandon S. Butler, Esq., County Administrator, reminded the Commissioners that Code Home Rule Bill 3-18 Residential Development Incentive Program was introduced at the previous Commissioners public business meeting held on August 9, Mr. Butler remarked on housing being a very key component to economic development and said that he believed the Code Home Rule Bill before the Commissioners, making some modifications to the County s current public local law regarding residential development would be part of the key. Mr. Butler pointed out that there are currently a number of projects just waiting for the modifications to be made by Code Home Rule Bill He asked the Commissioners if they would take action on the Code Home Rule Bill at this meeting. Commissioner Shade opened the Public Hearing and asked for any public comment. Upon Motion made by Commissioner Shade, seconded by Commissioner Brodie, and duly carried,
2 the Board of County Commissioners adopted Code Home Rule Bill 3-18 Residential Development Incentive Program. ACTION AGENDA Item 4 Code Home Rule Bill 4-18 Introduction All Terrain Vehicles on Public Roads in Allegany County William M. Rudd, County Attorney, explained that Senate Bill 644 passed the General Assembly, basically giving Allegany County the same opportunity, that Garrett County has to allow the use of ATV vehicles and snowmobiles on County roads, if the County exercises that authority and dedicates the roads that can be used. Attorney Rudd added that he prepared legislation similar to that of Garrett County, to allow people, under the State law, to operate All- Terrain Vehicles on County roads, if they get a permit, and meet certain requirements, for up to two miles at a speed of no more than 25 miles per hour. He further explained that the purpose of both State and County law is not to allow for an ATV to be driven up and down the road, but from point A to point B. Commissioner Brodie moved that the Board of County Commissioners agree to the Introduction of Code Home Rule Bill 4-18 All-Terrain Vehicles on Public Roads in Allegany County. Commissioner Shade seconded the Motion. Motion carried to introduce Code Home Rule Bill Item 5 Memorandum of Understanding between the Allegany County Board of County Commissioners and Maryland Department of State Police Board of County Commissioners to approve the MOU between the County and the Maryland Department of State Police relating to the use of facilities and property located at PPG Road, SE, Cumberland, Maryland Richard L. DeVore, Director of Emergency Services, and Lieutenant H.B. Martz, Commander, Maryland State Police Cumberland Barrack C. Richard L. DeVore, Director of Emergency Services for Allegany County, explained to the Commissioners that before them this evening was a request for consideration of an MOU that would exist between Allegany County and the Maryland State Police. He provided some brief details regarding the MOU, as set forth in his Staff Report dated August 17, 2018, a copy of which is attached to and made a part of these Minutes. Lieutenant H. B. Martz, Commander of the Maryland State Police Cumberland Barrack C, also made brief comments regarding the proposed MOU. Upon Motion by Commissioner Brodie, seconded by Commissioner Shade, and duly carried, the Board of County Commissioners approved the MOU between the County and the Maryland Department of State Police relating to the use of facilities and property located at PPG Road, SE, Cumberland, Maryland. CONSENT AGENDA As recommended by the County Administrator Upon Motion by Commissioner Brodie, seconded by Commissioner Shade, and Motion carried, the Consent Agenda as recommended by the County Administrator is adopted. Item 6 City of Frostburg Raw Water Transmission Main Easement Agreements Board of County Commissioners approved easement agreements to construct and maintain a waterline and appurtenances across properties within the City of Frostburg, and authorized the President to sign all documents. Item 7 Declaration of Surplus Vehicle Board of County Commissioners authorized the Department of Emergency Services to declare a 2006 Chevy Impala, VIN #2G1WS , and a 2001 Ford Expedition, VIN #1FMPU16596LA19645, as surplus to be sold at public auction. Item 8 Department of Emergency Services Vehicle Purchase Board of County Commissioners authorized the purchase of two 2019 Ford Police Interceptor Utility SUV s for the Department of Emergency Services from Hertrich Fleet Services, Milford, Delaware, with said vehicles being purchased off the State of Maryland contract list in the amount of $75,166. Item 9 Upper Potomac Industrial Park Boat Ramp Board of County Commissioners approved all required applications and funding documents for the Upper Potomac Industrial Park Boat Ramp, for Department of Public Works to design and construct the ramp, and authorized the President to sign any and all necessary documents. Item 10 Allegany Museum Permanent Transportation Exhibit Request to Advertise Board of County Commissioners authorized the Department of Public Works to advertise for bids for the Allegany Museum Permanent Transportation Exhibit Project.
3 Item 11 Allegany County Board of Zoning Appeals Appointments Board of County Commissioners approved the appointments of Bernard C. Wolters and Mark A. Farris, Cumberland, Maryland, as members of the Allegany County Board of Zoning Appeals, with their terms to expire on September 25, Commissioners statements, comments, recognition Commissioner Creade V. Brodie, Jr. relayed regards from Commissioner William R. Valentine, in Annapolis this evening attending a Kirwan Commission meeting. Commissioner Brodie commented that Commissioner Valentine keeps everyone informed about the Kirwan Commission meetings. Commissioner Brodie then remarked that County staff has been dealing lately with a lot of issues, and he expressed thanks to Adam Patterson and Dan DeWitt of the Department of Public Works for their efforts. He explained that the unusually large amount of rain this year has caused additional issues and responses to those issues. Commissioner Brodie encouraged patience as issues are being resolved. Commissioner Jacob C. Shade remarked on the productive MACo Summer Conference this year, which included a meeting with the Maryland Secretary of Transportation. Commissioner Shade reported that the Governor s Office is committed to helping counties and towns as much as they can with infrastructure, and that Allegany County has received $513,000 in funding from a one-time grant. He added that the municipalities received $1,099,000 in funding from this grant, to be divided among them. Commissioner Shade then reported on the recent ribbon-cutting at the new Allegany High School. He commented on the team effort it took to accomplish the new school, which included the local Delegation, Board of County Commissioners, Board of Education, as well as the Governor s Office, the State Comptroller, and the Board of Public Works. He encouraged those present to go check out the new school. Commissioner Brodie asked about any open houses at the new school and also encouraged anyone who wished to go see it to do so. Constituents In order of sign-up sheet Mr. Kenneth Wilmont, of 513 Fort Avenue, Cumberland, stated that he was one hundred percent against four-wheelers on public roads. Mr. Wilmont then expressed his views again on the feral cat situation in Allegany County.
