1 FAFEN ELECTION 1.67 Million Ballots Excluded from the Count 169 NA and PA constituencies with less than potentially Ballots August 3, 2018 The number of ballot papers excluded from the count in General Elections 2018 surpassed the number of ballots rejected in General Elections Nearly 1.67 million ballots were excluded from the count in GE This number may slightly vary after the final consolidated result is released by the Election Commission of (ECP) as the ballots excluded from the count at the polling station level by Presiding Officers are to be reviewed by the Returning Officers during the consolidation proceedings, who can either reject them or count them in favor of a candidate if excluded wrongly. The increase in the number of ballots excluded from the count was a ubiquitous phenomenon observed in all provinces and Islamabad Capital Territory with nearly 11.7% overall increase. In Islamabad Capital Territory, the number of ballots excluded from the count are more than double the rejected ballots in the region in GE Around 40% increase in the number of ballots excluded from the count was observed in Balochistan, 30.6 % increase in Khyber Pakhtunkhwa including Federally Administered Tribal Areas (FATA), 7% increase in Sindh and 6.6% increase in Punjab. The following table provides a comparison of the number of rejected National Assembly ballot papers in each province/region during each of the past four General Elections in 2002, 2008, 2013 and Although the rejected ballots have consistently increase over the past four general elections, the increase was significantly higher in 2013 than 2008 (54.3%). The RO examination of the ballots excluded from the count by the Presiding Officer is also pertinent in wake of the fact that there are 169 National and Provincial Constituencies where the margin of victory, according to the provisional results, is less than the number of ballot papers excluded from the count. (Refer to Annexure-1 for the list of these constituencies) The Returning Officers decision to reject or count these ballots may materially affect the result of the polls in these constituencies. Excerpt from Final Report of the General Elections-2013 Inquiry Commission 2015 (p 218) ROPA has many legal aspects which need to be complied with and it is doubtful whether the POs had the necessary training or ability to ensure that they were complied with especially during the hectic and stressful situation on polling day. There were instances where ROs who were fairly senior judicial officers did not comply with the mandatory provisions of ROPA; For example, on their own admittance failing to open and consider rejected ballots. (PML (Q) CW 2, 3 and 6) The margin of victory may have been high and no party may have requested the consideration of these ballots but this was still a legal requirement under S.39 (3) ROPA 2

3 Under Section 95(5) of the Elections Act, 2017, the Returning Officer shall recount the ballot papers at one or more polling stations in a constituency if a contesting candidate requests so in writing and the margin of victory is less than five percent of the total votes polled in the constituency or 10,000, whichever is less. According to provisional results of GE- 2018, there are as many as 79 National and 169 Provincial Assemblies constituencies, where the margin of victory is less than five percent of the total polled votes or ten thousand. Figure 1 shows region-wise and assembly-wise distribution of these 248 constituencies. Among these NA constituencies, 26 are in Punjab, 11 in Sindh, six each in Balochistan and Khyber Pakhtunkhwa. Similarly, the number of ballots excluded from the count exceeded the margin of victory in 120 (21%) of 570 Provincial Assembly (PA) constituencies where elections were held. Of these 120 PA constituencies, 58 are in Punjab, 24 in Khyber Pakhtunkhwa, 22 in Sindh and 16 in Balochistan Assembly. Figure 2 shows the region-wise and assembly-wise distribution of these 169 constituencies. 3

Two independent candidates were also returned in such constituencies. The remaining six constituencies were won by independents. In KP Assembly s 24 constituencies with the number of excluded ballots greater than the margin of victory, 11 were bagged by PTI, seven by MMA, two each by PMLN and PPPP and one by ANP. An independent candidate also claimed one such seat. Similarly, in Sindh Assembly s 22 constituencies with a similar situation, nine have been claimed by PPPP, six by GDA, four by PTI, two by MQM and one by MMA. In Balochistan s 16 such constituencies, six were won by BAP, followed by three constituencies each won by PTI and MMA and one each by PMLN and Pashtoonkhwa Milli Awami Party (PkMAP). Two independent candidates in Balochistan won such seats. 6 Unofficial information suggests that the ECP has allowed recounting on National Assembly s and 33 Provincial Assemblies constituencies. Unlike the pre-election period, the availability of critical election information on the ECP website has reduced in post-election phase and no official notification of such count is available on the website. FAFEN observation reveals that the recount of votes was done or is under-way on 12 such constituencies where the number of ballots excluded from the count is greater than the margin of victory. Free and Fair Election Network (FAFEN) has contacted the second-place candidates in the relevant 50 NA constituencies, and eight of those candidates provided information about vote recounting. Recounting of votes was underway or complete in four of the constituencies (NA-74 Sialkot-III, NA-100 Chiniot-II, NA-230 Badin-II and NA-248 Karachi West-I), including three constituencies in which the secondplace candidates are from PTI and one constituency where a PPPP candidate is in second-place. The second-place candidate (GDA) in NA-215 Sanghar-I did not request a recounting of votes. The RO has declined candidates requests to recount votes in three constituencies (NA-114 Jhang-I, NA-140 Kasur-IV and NA-204 Ghotki-I). In the first of these constituencies, the RO originally agreed to recount and later rescinded the decision, according to the interviewed candidate. In the second listed constituency the RO stated that the candidate failed to provide in his recount application the names and numbers of the relevant polling stations. The RO in the third constituency did not give a reason for refusing to conduct a recount. 6 The Elections Act, 2017 provides for utmost care in dealing with the result of constituencies where a close contest takes place. The law also provides additional powers to ECP to deal with ballots excluded from the count. Section 95(2) of the Elections Act, 2017 states: Before consolidating the Results of the Count, the Returning Officer shall examine the ballot papers excluded from the count by the Presiding Officer and, if he/she finds that any such ballot paper should not have been so excluded, count it as a ballot paper cast in favour of the contesting candidate for whom the vote has been cast. In addition, Section 95(5) of the Elections Act, 2017 reads: Before commencement of the consolidation proceedings, the Returning Officer shall recount the ballot papers of one or more polling stations if a request or challenge in writing is made by a contesting candidate or his election agent and the margin of victory is less than five percent of the total votes polled in the constituency or ten thousand votes, whichever is less, or the Returning Officer considers such request as not unreasonable. Section 8 (b) of the Act relates to the Power of Commission to ensure fair election specifically mentions the issue of rejected votes in describing the absolute power of ECP to intervene in cases of controversy. This section of the law states that the Commission may review an order passed by an officer under this Act or the Rules, including rejection of a ballot paper. Section 8(c) reinforces the general authority of the Commission to issue such instructions, exercise such powers and make such consequential orders as may in its opinion, be necessary for ensuring that an election is conducted honestly, justly, fairly and in accordance with the provisions of this Act and the Rules. 6
