7 Terms & Conditions ANNEXURE-IV 1. General terms and conditions:- (1.1) Empanelled center will provide all the facilities as per the package rates agreed to for various procedures, investigations, etc. on the CGHS/ESIC/Hospital rates, which ever is less, and at the terms and conditions of CGHS/ESIC to ESIC beneficiaries. Package rate shall mean and include lump sum cost of investigation for which a ESI beneficiary/esi staff (serving or retired) has been permitted by the competent authority for investigation. (1.2) Empanelled center will provide all the services on cashless basis to ESI beneficiaries. Appropriate action, including removing from ESIC empanelment and / or termination of this Agreement, may be initiated on the basis of a complaint, medical audit or inspections carried out by ESI team. (1.3) The empanelled center will perform investigation / X-ray only to referred beneficiaries by the competent authority as defined. (1.4) The Empanelled Centre shall provide services only for which it has been empanelled by ESIC at rates fixed by CGHS/ESIC from time to time and shall be binding. (1.5) Certain discount on investigation / X-ray will be given as under: (i) 15 % discount on Empanelled Centre rates if there is no package/procedure under CGHS/ESIC. (1.6) If any procedure/package/investigation does not exist in the Present Rate list of CGHS but present in Previous List of CGHS, then rates as per Previous List will be admitted. (1.7) The Empanelled Centre agrees that any liability arising due to any default or negligence in providing or performance of the medical services shall be borne exclusively by the Empanelled Centre that shall alone be responsible for the effect and/or deficiencies in rendering such services. (1.8) The Empanelled Centre will investigate the ESIC beneficiary patient only for the condition for which they are referred. (1.9) The Empanelled Centre will not refer the patient to other specialist/other hospital / Institute without prior permission of ESIC authorities. (1.10) Referral Letter once issued will be valid only for one week and after that it has to be renewed/reissued. 7 P a g e

8 2. The Empanelled Centre /Diagnostic centers shall honor permission letter issued by the Competent Authority of the ESIC Model Hospital Jaipur /ESIC Hospital Bhiwadi/ ESI Hospital Jodhpur/Pali/Bhilwara & Kota and ESIS Dispensaries whose list will be provided separately and provide investigation, facilities as prescribed in permission/referral letter. Bills in respect of referrals issued by these authorities will be submitted as under:- (A) To the Medical Superintendent ESIC Model Hospital, Jaipur in cases where referrals are issued by them. (B) To the Medical Superintendent ESIC Hospital Bhiwadi in cases where referrals are issued by them. (C) To the State Medical Commissioner ESIC Rajasthan Jaipur in cases where referrals are issued by the Superintendent of ESIS Hospital Jodhpur/Pali/Bhilwara & Kota and authorized IMO I/c ESIS Dispensaries including referrals issued by the State Medical Commissioner ESIC Jaipur. 3. Empanelled Centre tie-up will also honor the referrals/permission letters issued from State Medical Commissioner, Rajasthan and the bills will be submitted to SMC Office for payment. 4. Any legal liability arising out of such services shall be the sole responsibility of the Empanelled Centre and shall be dealt with by the concerned Empanelled Centre /diagnostic center. Services will be provided by the Empanelled Centre / diagnostic center as per the terms of agreement. 5. In case of any natural disaster / epidemic, the hospital/diagnostic hospital shall have to fully cooperate with the ESIC and will convey / reveal all the required information, apart from providing treatment. 6. Special terms and condition: (6.1) The representative of the Empanelled Centre should be available / approachable over phone and Otherwise on all the days. (6.2) In emergencies, the Empanelled Centre should be prepared to inform Reports over the telephone/ . (6.3) The Empanelled Centre must be standard one (and if NABL accreditation submit such proof), with Standard equipment, re-agents etc, and trained manpower. (6.4) Bills should be sent monthly in triplicate, and should be accompanied by a copy of each of requisition form. The Empanelled Centre shall deliver reports in duplicate to the Hospital / Dispensary in person. (6.5) The Empanelled Centre in tie-up shall collect samples daily from the Hospital / Dispensary or as requested by the competent authority from time to time and if necessary, shall be prepared to draw the sample from the patients in certain cases, like blood culture. 8 P a g e

9 (6.6) Empanelled Centre may be visited at any time during the period of contract and if any irregularity noticed then necessary action may be initiated as deemed fit. (6.7) Medical Vigilance Officer or any Officer/Officers authorized by the State Medical Commissioner may visit the Empanelled Centre at any time and if any irregularity noticed then necessary action may be initiated as deemed fit. (6.8) The services should be made available round the clock on all days. 7. Directions/Instructions for Empanelled Centre & Payment schedule: (7.1) Bills to be submitted as per the Performa provided by the ESIC. (7.2) The bills must be submitted to this office within 15 days of investigation for payment. The bills received after that period shall not be entertained. (7.3) The Empanelled Centre /diagnostic centre will send bills along with necessary supportive documents to the Medical Superintendent ESIC Model Hospital, Laxmi Nagar, Ajmer Road, Jaipur/MS ESIC Hospital Bhiwadi/State Medical Commissioner ESIC Jaipur as the case may be as soon as bills are generated for further necessary action. (7.4) Feedback form duly signed by referred patient must be attached while preparing the bills, failing which bill will not be processed and will be returned back for needful. 8. Duties and responsibilities of Empanelled Centre /diagnostic centers: It shall be the duty and responsibility of the Empanelled Centre at all times, to obtain, maintain and sustain the valid registration and high quality and standard of its services and healthcare and to have all statutory/mandatory licenses, permits or approvals of the concerned authorities as per the existing laws. Display board regarding cashless facility for ESI beneficiary will be required. The documents like referral from ESI Hospital; eligibility etc. must be mentioned on the board. The ESI patient must be entertained without any queue/wait. 9. Empanelled Centre /diagnostic centre s integrity and obligations during agreement period: The Empanelled Centre is responsible for and obliged to conduct all contracted activities in accordance with the Agreement, using state-of-the-art methods and economic principles and exercising all means available to achieve the performance specified in the Agreement. The Empanelled Centre is obliged to act within its own authority and abide by the directives issued by the ESIC. The Empanelled Centre is responsible for managing the activities of its personnel and will hold itself responsible for their misdemeanors, negligence, misconduct or deficiency in services, if any. 10. Performance bank guarantee: 9 P a g e

10 The Empanelled Centre shall furnish in the prescribed format a performance Bank Guarantee of Rupees One Lakhs, valid for a period of one year to ensure efficient service and to safeguard against any default. 11. Forfeiture of performance bank guarantee and removal from list of empanelled institutions: In case of any violation of the provisions of this Agreement by the Empanelled Centre as listed below, the State Medical Commissioner ESIC Jaipur will have the power to forfeit the Performance bank guarantee as well as removal from list of empanelled institution based on the report on the committee member constituted by the State Medical Commissioner ESIC Jaipur. (11.1) Refusal of service, (11.2) Undertaking unnecessary procedures, Investigations, (11.3) Prescribing unnecessary drugs/tests, (11.4) Over billing, (11.5) Reduction in staff/ infrastructure/ equipment etc. after the hospital/ has been empanelled. (11.6) Non submission of the report, habitual late submission or submission incorrect data in the report (11.7) Refusal of credit to eligible beneficiaries and direct charging from them (11.8) Discrimination against ESIC beneficiaries vis-à-vis general patients 12. Liquidated damages: (12.1) The Empanelled Centre shall provide the services as per the requirements specified by the ESIC in terms of the provisions of this Agreement. In case of initial violation of the provisions of the Agreement by the recognized private Hospital, the amount equivalent to 15% of the amount of security deposit will be charged as agreed Liquidated Damages by the ESIC, however the total amount of the security deposit will be maintained intact being a revolving Guarantee. (12.2) For over-billing and unnecessary procedures, the extra amount so charged will be deducted from the pending / future bills of the Hospital and the ESIC shall have the right to issue a written warning to the Hospital not to do so in future. The recurrence, if any, will lead to the stoppage of referral to that Empanelled Centre. (12.3) Before initiating action under sub clause (23.1) (23.2) above, ESIC shall serve a show cause notice to the Hospital for which the Empanelled Centre shall have to respond within ten days of its receipt. 13. Termination for default: The State Medical Commissioner ESIC Jaipur may without prejudice to any other remedy for breach of Agreement, in whole or part, may terminate the contract in following circumstances. 10 P a g e

11 (13.1) If the Empanelled Centre fails to provide any or all of the services for which it has been empanelled within the period(s) specified in the Agreement, or within any extension period thereof if granted by the ESIC pursuant to condition of Agreement or (13.2) If the Empanelled Centre fails to perform any other obligation(s) under the Agreement or (13.3) If the Empanelled Centre, in the judgment of the ESIC is engaged in corrupt or fraudulent practices in competing for or in executing the Agreement. (13.4) If the Empanelled Centre fails to follow instruction & guidelines and there is repeated submission of bills as per its own way with repeated deficiencies etc. (13.5) If the Empanelled Centre is found to be involved in or associated with any unethical illegal or unlawful activities, the Agreement will be summarily suspended by ESIC without any notice and thereafter may terminate the Agreement, after giving a show cause notice and considering its reply, if any, received within 10 days of the receipt of show cause notice. Terms and conditions can be modified on sole discretion of the First Party only. 14. The Second Party will not terminate the agreement without giving notice of three (3) months. 15.
