1 Bill No. 13 of 2011 THE RAJASTHAN AGRICULTURAL PRODUCE MARKETS (AMENDMENT) BILL, 2011 (To be Introduced in the Rajasthan Legislative Assembly) A Bill further to amend the Rajasthan Agricultural Produce Markets Act, Be it enacted by the Rajasthan State Legislature in the Sixty-second Year of the Republic of India, as follows:- 1. Short title and commencement. (1) This Act may be called the Rajasthan Agricultural Produce Markets (Amendment) Act, (2) It shall be deemed to have come into force on and from 30 th December, Amendment of section 14, Rajasthan Act No. 38 of In clause (a) of sub-section (2) of section 14 of the Rajasthan Agricultural Produce Markets Act, 1961 (Act No. 38 of 1961), the existing proviso shall be substituted, namely:- Provided that no sale or purchase shall be permitted under this clause within the market proper except for the purposes specified in sub-clauses (i) and (iv) ;. 3. Repeal and savings. (1) The Rajasthan Agricultural Produce Markets (Amendment) Ordinance, 2010 (Ordinance No. 05 of 2010) is hereby repealed. (2) Notwithstanding such repeal, all actions taken or orders made under the principal Act as amended by the said Ordinance shall be deemed to have been taken or made under the principal Act as amended by this Act.

2 2 STATEMENT OF OBJECTS AND REASONS Amendment was proposed in clause (a) of sub-section (2) of section 14 of the Rajasthan Agricultural Produce Markets Act, 1961 with a view to ensure better prices to the farmers for their produce. All restrictions on direct purchase of agriculture produce are proposed to be removed in order to promote Agriculture Processing and value addition activities. It will encourage setting up Agro Processing Enterprises. Since the Rajasthan Legislative Assembly was not in session and circumstances existed which rendered it necessary for the Governor of Rajasthan to take immediate action, he, therefore, promulgated the Rajasthan Agricultural Produce Markets (Amendment) Ordinance, 2010 (Ordinance No. 05 of 2010), on 30 th December, 2010 which has published in Rajasthan Gazette, Part IV (B), Extraordinary, dated 31 st December, This Bill seeks to replace the aforesaid Ordinance.
