2 IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 37/2016-Va.Aa /Dus /2013 dated 26 July GOVERNMENT OF UTTAR PRADESH FINANCE DEPARTMENT (NIYAMAWALI AND VIDHI PRAKOSTH) NOTIFICATION Miscellaneous No.37/2016-Va.Aa /Dus /2013 Dated Lucknow, 26 July, 2016 IN exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Government Department Subordinate Accounts Cadre (Non-Gazetted) Service Rules,2014 : THE UTTAR PRADESH GOVERNMENT DEPARTMENT SUBORDINATE ACCOUNTS CADRE (NON-GAZETTED) SERVICE (FIRST AMENDMENT) RULES, 2016 Short title and commencement 1. (1) These rules may be called The Uttar Pradesh Government Department Subordinate Accounts Cadre (Non-Gazetted) Service (First Amendment) Rules, (2)(i) Rule 2 of these rules shall be deemed to have come into force with effect from November 07, (ii) Rules 3, 4 and 5 of these rules shall come into force at once. Substitution of rule 2 2. In the Uttar Pradesh Government Department Subordinate Accounts Cadre (Non Gazetted) Service Rules, 2014, hereinafter referred to as the said rules, for existing rule 2 set out in column 1 below, the rule as set out in column 2 shall be substituted, namely:- COLUMN 1 COLUMN 2 Existing rule Application of these rules 2.These rules shall apply to the posts of the Combined Rule as hereby substituted Application 2.These rules shall of these apply to the posts of rules the Combined

Amendment of rule 5 Substitution of rule In the said rules, in rule 5, for existing clause (d) set out in column 1 below, the clause as set out in Column 2 shall be substituted, namely :-- COLUMN 1 COLUMN 2 Existing clause Clause as hereby substituted (d) "Commission" (d) "Commission" means the Uttar means the Uttar Pradesh Public Pradesh Subordinate Service Services Selection Commission; Commission; 4. (4) The Commission shall prepare a list of candidates in order of their proficiency as disclosed by the marks obtained by each candidate at the written examination and recommend such number of candidates as they consider fit for appointment. If two or more candidates obtain equal marks, the Commission shall arrange their names in order of

6 merit on the basis of their general suitability for the service. The Commission shall forward the list to the appointing authority. Substitution of rule In the said rules, for existing rule 27 set out in column 1 below, the rule as set out in column 2 shall be substituted, namely :-- COLUMN 1 COLUMN 2 Existing rule Relaxation from the conditions of service 27. Where the State Government is satisfied that the operation of any rule regulating the conditions of service of persons appointed to the service causes undue hardship in any particular case, it may, notwithstanding anything contained in the rules applicable to the case, by order, dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable manner: Provided Rule as hereby substituted Relaxation 27.
