With reference to above subject, we will like to draw your kind attention towards the biased approach of your office in dealing with cases and complaints about grant of immunity as office bearers of the association. Till now we have updated your good self on such issues in meetings and also by what s app and hope your good self is kind aware about all these issues. But we are surprised to see that request of SNEA through proper channel is kept pending and the District Body of SNEA is de-recognized and when it is request of AIBSNLEA that to be without proper channel then same is given special and out of treatment and same is given consideration by illegal adopting illegal actions. Being HR Head, the approach should be equal for all and not as seen biased towards any individual or any association, but unfortunately we see such treatment and details are as follows. In first instance some unanimous complaint has received by your office and it is definitely not coincidence that the complaint came when the request of Com. B. R. Kamble, DS SNEA Nanded was under process in your office for grant of immunity. You may remember that complaint was brought by Shri. B P Tambat AGM Staff Mumbai by hand when same was addressed to GMT Nanded and its copy was marked to you but not given in your office. But same unanimous compliant was taken as notice by court and your good self has kept on hold the request of Com. B. R. Kamble for grant of immunity and clarification was called from GMT Nanded. 2 We will like to put on record that this complaint on name of DS BEA Nanded is without any letter head, name of the person, and it is old matter dated i.e. 05/03/2017 and also this complaint is not addressed/marked to you or any other officers in your office. Your officers in staff section have misguided you that it is recent complaint and you can find that copy of complaint available in your files is not copy marked to GM HR Admn Mumbai but is it is marked to CS BEA which was not in existence in MH Circle as on the date on which complaint was processed in your office file. Further there was need on your part to see that where this complaint marked to CS of the association not in existence is endorsed by said CS or someone without any name and just designation can make such complaint. Further till today Shri. B P Tambat AGM Staff Mumbai has not disclosed from where he has received complaint and when complaint was not marked to Shri. Tambat why he has accepted it and under what authority he has rushed to you to keep on hold the request of Com. B. R. Kamble, needs to be confirmed. What is role of DS BEA Nanded in activities of SNEA Nanded and how he can decide activities of SNEA legal or illegal and how your office not only entertains such unanimous complaint and how the request for grant of immunity duly recommended by GMT Nanded is kept on hold and matter is given turn to the extent of de-recognition of the District Body of SNEA Nanded. Hope you will go to the depth of the issue and will find out malafide intention of the officers who have called for this copy of the complaint of 05/03/2017 i.e. more than one and half year old matter and processed in file in Month of May 2018 with malafide intention of not granting immunity to Com. B. R. Kamble DS SNEA Nanded. We are confident that you have high moral to accept the truth and spirit to take action against the culprit officers who have deliberately invited unwanted and very old complaint and processed it in file with totally malafide intention of rejecting immunity to the duly elected DS SNEA Nanded. We put on records that due to your free hand, these officers have got so much confidence that finally they have taken matter to such worst level that the democratically elected district branch of recognized association SNEA Nanded is de-recognized by GMT Nanded without giving any reason. Hope, you as GM HR/Admn Mumbai, the HR Head of Maharashtra Circle take the responsibility of malafide actions of certain officers in staff section and take suitable action so that no one dares to play such dirty games with anyone in future. You may take or may not take, the responsibility comes to you as CGMT MH will definitely not take its responsibility as he will say that he has not gone to the depth and has approved whatever you have processed in file. 3 Further, after blind approach game plan of your office, in totally strange action Shri. Nitin Rokade, newly posted GMT Nanded on his first day of joining as GMT Nanded, instead of replying to query raised by your office, has taken extreme illegal action to de-recognize the entire SNEA Body that to be without assigning any reason. GMT Nanded has taken adamant stand and has deliberately kept this matter pending for last two months and he does not bother about any rules and regulations of BSNL. Shri. Rokade has not revoked his wrong decision even after DS SNEA Nanded has submitted facts in writing to him, we have brought the wrong doings to notice Shri. Rokade in this case, then we have updated you and CGMT MH but all in vain as it seems everybody was playing part of game. Unfortunately on intervention of CGMT MH also Shri. Nitin Rokade GMT Nanded continues with his stand of de-recognition of District Body of SNEA Nanded and it seems that Shri. Nitin Rokade is either not aware about the responsibilities of SSA Head post or he has some malafide intention in taking such illegal action without even any inquiry with any office Bearer of SNEA Nanded as with utter adamancy he has not given reason for de-recognition even though we have requested him repeatedly. Now, fact is that this complaint against DS SNEA Nanded was unanimous, of old period of more than one and half year and as per guidelines on dealing such complaints, no action is taken on such unanimous complaints, but your office has illegally acted on such unanimous and one and half year old complaint and related and misused it for denying immunity to DS SNEA Nanded as matter recommended by GMT Nanded was unnecessarily referred back to GMT Nanded. Thereafter GMT Nanded took it as your directions to de-recognize SNEA Nanded and entire District Body is de-recognized may be due fact that Shri. Nitin Rokade who is under influence of Shri. R B Madle earlier GMT Nanded. Com. R. B. Madle who is now working as DGM Nanded, is of the opinion that SNEA has demanded for posting of GM level BA Head Nanded and hence Shri. Nitin Rokade is posted as GMT Nanded and the business of Shri, R. B. Madle, as GMT Nanded has been stopped. Further Shri. R.B. Madle has done some malpractices and DS SNEA has opposed it and hence may be in revengeful attitude he has misguided newly joined GMT Nanded Shri. Nitin Rokade and grabbed opportunity to act not only against DS SNEA Nanded but he has acted against entire District Body of SNEA Nanded and is successful in his dirty game plan. Thereafter also action from your office did not stopped and Shri. B. A. Patil DGM HR Admn Mumbai continued his efforts and has called Com. B R Kamble and threatened him for issuing charge sheet as he has done for many of the other Page 3 of 9

4 officers who have not joined new place of posting and under fear of issuing charge sheet for not following transfer orders, Com. B R Kamble is compelled to join at Buldhana on DE Regular promotion when the case of Com B R Kamble was different from others. On telephonic queries Shri. Nitin Rokade GMT Nanded expresses his innocence and says that he has derecognized the District Body of SNEA Nanded under pressure from Circle office but he is not giving names who have pressurized him but he is pointing out fingers towards you and DGM HR Mumbai and letter/s written by your office. This is how the dirty game started by some officers in your office by collecting copy of one and half year old unanimous complaint has resulted in de-recognition of duly approved SNEA Nanded District Body and we are sorry to say that said culprits have been successfully implemented their game plan under your so called vigilant administration. But your so called intelligent office and officers did not show any such intelligence in another similar complaint against grant of immunity to DS/ADS AIBSNLEA Amravati. Your good self also have not taken any action even though the said case is of similar in nature and on same grounds and complaint was current and was given by name against grant of immunity along with all supporting documents. This is how your office is working as Supari Killers in underworld and dare to derecognize democratic body of SNEA Nanded and makes efforts to recognize illegal District body of AIBSNLEA Amravati and successfully complete the tasks without any fear in mind. In earlier case of compliant against DS SNEA Nanded was unanimous but till you have acted by crossing rules and in case of compliant against DS AIBSNLEA Amravati when the complaint was by name by Com. S. H. Gandhi, DS SNEA Amravati (Copy attached) and every fact has been brought to your notice about violation of the rules for elections, but no action has been taken on such complaint rather attempts are made in supporting bogus claims of immunity without recommendations of GMT Amravati and now pressure is being created on GMT Amravati to recommend the case. In over actions to support grant of illegal immunity, in back door attempts your office has changed posting of Com P.G. Wankhade Ex DS AIBSNLEA Amravati from Yavatmal to Amravati by creating false picture as SDE Yavatmal at Amravati. Your office continues to favor Com P.G. Wankhade even though he was relieved by GMT Amravati in May 2018 and Shri. B. A. Patil, DGM HR Mumbai do not threaten him for joining at Yavatmal by issuing charge sheet rather Shri. Patil continues to discuss with him, his illegal, unofficial immunity case Page 4 of 9

5 and helps in getting immunity granted. It is well known that request of Com Wankhade cannot be recommended by GMT Amravati for grant of immunity and case do not fit in criteria of the your office letter issued for grant of immunity. Further your office not accepting any letter for grant of immunity without recommendations of SSA Head but case of Com P.G. Wankhade is not only accepted without recommendations of GMT Amravati but same has been processed and he is indirectly retained in Amravati by modification of his posting as SDE Yavatmal at Amravati. Further in reverse action, on the basis of direct request received from Com P.G. Wankhade by your office has called information from GMT Amravati and as there was no genuineness in case GMT Amravati has also not clarified the fact, but given general letter and now you calls for reasons from GMT Amravati for delay in responding. But you have not bothered on issuing reminder to GMT Nanded when your office has called report from GMT Nanded in period of three days from 21/06/2018 and till today no report has submitted by GMT Nanded and you have not called for any explanation for delay from GMT Nanded, but same has been called from GMT Amravati as if GMT Nanded s working as per your wish and will and GMT Amravati is not working as per your wish and will. We should be thankful to you as you have not taken disciplinary action against GMT Amravati and not awarded GMT Nanded for delaying reply. Normally in processing any request for immunity as per your office guidelines, such request needs to come through proper channel and with recommendations from SSA Head, along with list of the office Bearers elected, approved list and recommendations for grant of immunity, but same has not been followed in case of Com P. G. Wankhade and when all such procedures were followed in case of Com. B. R. Kamble, DS SNEA Amravati, his request is not given consideration and he was not given such option to joining on promotion as DE Buldhana at Nanded. We are sorry to put on records, that your staff section has not acted properly on request and complaints of and against Ex DS AIBSNLEA as Com P.G. Wankhade along with other 2-3 office bearers of AIBSNLEA Mumbai were seating in your office for continuously last one week. Finally you have bowed to their pleading may be as planned earlier and officer who has been relieved from Amravati to Yavatmal in May 2018 is unofficially retained at Amravati as SDE Yavatmal at Amravati in month of July Now you only can better know how this SDE can give output as desired by CGMT MH, how he can perform his duties from Amravati at Yavatmal, what will be his role in Amravati and under which rule GMT Amravati will accept his joining report at Amravati for assignments of Yavatmal SSA. 6 Earlier also we have seen such favoritism in case of Com Sayyad DGM Mobile Nanded and Com. G.K. Patil DGM EB Mumbai and such actions on part of staff section cannot be justified in larger interest of BSNL, but you have informed us that these are cases done as per directions of CGMT MH and you have no role on it, but here we do not find any such direct involvement of CGMT MH rather CGMT MH has spared time and taken up matter with Shri. Nitin Rokade GMT Nanded thereby giving directives for corrective action, it is different matter that GMT Nanded has shown dust bin to instructions of so called strict CGMT MH. One side under tremendous pressure from Shri. Peeyush Khare CGMT MH, you and Shri. B. A. Patil DGM HR Mumbai are continuously busy in issuing charge sheets to the officers who are not relieved by SSA Heads and here you have started acting on pick and choose manner and illegally allowed to join SDE Yavatmal at Amravati as if some special deal has been taken place for settlement of grievances of only Com P.G. Wankhade and at other side and same time all other officers are threatened and compelled for getting relieved by issuing charge sheet and only mistake on their part is that they have not came to Mumbai for settlement of their grievances and cases. This dual stand is and was never expected from sincere and very transparent officer like you and this happened when Shri. Peeyush Khare CGMT MH was on China tour. On our query on granting of such retention as SDE Yavatmal at Nanded, you have informed that this special order was issued so that Com P.G. Wankhade should not miss his promotion as he was completing 40 days from his promotion orders. But we have brought to your kind notice that whoever has given information about completion of 40 days on 07/07/2018 are wrong and 40 days period completes on 16/07/2018 as your office itself has issued posting order on 06/06/2018. You have assured to take the concerned officers to task for wrong information to you on date of completion of 40 days, but we find nothing on that angel also. We are also surprised to see that you are so keen on checking all such points from your own computer, even then also you have missed it and believed on such wrong data and we are compelled to conclude that pressure created on these leaders was much more strong even to confuse you which is difficult for us to believe, but outcome compel us to believe. We also do not believe on your blind approach that confirmation of eligibility condition for becoming office Bearers of AIBSNLEA is their internal matter and you as GM HR Admn Mumbai and your office has nothing to do with it. We agree with it up to certain extent till it s internal matter. But when complaint is received against such internal issues that to be from the DS of recognized and majority association Page 6 of 9

7 then it do not remain internal matter and it is matter of investigation and finding facts. You have forgotten that same was case with the DS SNEA Nanded and matter should have been decided by DS SNEA Nanded and there was no need of any action on your part on unanimous complaint of one and half year old which was addressed to GMT Nanded and when even copy also is not marked to you and received by you. We have confirmed from said file of your office from AGM Staff Mumbai who has informed you and us about such complaint and has called for copy of complaint from somebody and he can better explain facts from whom he has collected the sad copy. Sir, we would like to know from you why your HR did not give similar treatment to Com. A. H. Waghmare by posting him as DE Ratnagiri at Pune, Com. A. M. Kulkarni by posting him as SDE Ratnagiri at Beed, Com. Mrs. M. J. Kulkarni by posting her as SDE Circle Office Mumbai at Ahmednagar, Com. L. S. Basinge by posting him as DGM/DE Sindhudurg at Sangli & Com Shrikant Mumbrakhane by posting him as DGM Ratnagiri at Solapur and also withdraw the charge sheet and unfortunately these officers are not only charge sheeted but they are reverted in lower cadre and this is really extreme limit of biased approach as your office has failed to meet requests even on medical grounds and definitely it is good HR. Till now we not only believe but we advocate for your transparent and unbiased working as GM HR Admn Mumbai but biased approach/actions seen in issuing charge sheet to selected comrades and favoritism to certain comrades, derecognizing the duly approved District Body of SNEA Nanded and attempts being made on part of your office to recognize the District Body of AIBSNLEA Nanded even after genuine complaints have compelled us to review on such belief. We never expected such biased treatment from you and we request your good self to take review of the actions may be taken under misleading information from anybody and take corrective action thereby giving equal treatment to all. Hope you take our this letter in correct perspective and understand our request for natural justice and equal treatment for all and please avoid giving special treatment for someone who comes to your office try to manage officers in your office by creating pressure may it be any type and neglects voice of common executives who did not tent in your office and makes attempt to influence the officers. We also put on records that you are real human being at least to better extent, but as days are passing we are finding some change in you, may be due to influence of working style of CGMT MH, but we will like to see your good self as transparent GM HR/Admn who has real human approach. 8 you will collect update information on all such cases regardless of his/her approach and reach to you and your office and will continue to be unbiased as we have seen in past. Hope all above facts will make it crystal clear the real issues on different stand taken by your office on similar complaints and it fully justifies our stand of equal treatment to all regardless of his way and method of approach as per guidelines of BSNL and no favoritism to anybody will be done in due course of time. In view for of above we request your good self: A. Please issue directions to GMT Nanded to restore District Body of SNEA Nanded without any further delay and also direct him to give us reasons for de-recogniation of District Body of SNEA Nanded. B. It is requested to take action against Shri. Nitin Rokade GMT Nanded and Shri. R. B. Madle DGM Nanded for their illegal and malafide action to derecognize duly approved the District Body of SNEA Nanded. C. Fix the responsibility against officers who have called for copy of one and half year unanimous complaint, processed it in file and have become part of dirty game of not granting immunity to Com B R Kamble and who have accepted direct request of Com. P. G. Wankahde and issued him illegal retention as SDE Yavatmal at Amravati. D. Take firm stand on dealing with such unanimous complaints and fix stand for action to be taken on such unanimous complaints and whatever decision is being taken by your good self then same may be please intimated to us and implemented equally for all such unanimous complaints. E. Take due note of the complaint made by Com. S H Gandhi DS SNEA and issues raised thereof and take corrective action and final decision on grant of immunity may be taken after taking note of the issues raised by DS of recognized association and till you think that immunity can be granted even after two months of relieving of officer, then please make it as rule and apply equally for all. F. Revise posting order of Com. B. R. Kamble DS SNEA Nanded as DE Buldhana at Nanded. G. Make detail investigation of the matter how the request for grant of immunity by Com P.G. Wankhade was directly accepted by Staff section without recommendations of GMT Amravati and why the case duly recommended by GMT Nanded was diverted and driven to the de-recognition of District Body of SNEA Nanded. To stop extra ordinary initiatives taken by your office in month of July 2018 to grant immunity to the officer relieved in month of May 2018 and give full stop to politics being played by certain officers, and stop utter misuse of the facility of immunity from transfers and abide to the guidelines issued by your own office on acceptance of request for immunity. I. In the manner Com P.G. Wankhade is given retention as SDE Yavatmal at Amravati, please issue revised posting orders for Com. A. H. Waghmare as DE Ratnagiri at Pune, Com. A. M. Kulkarni as SDE Ratnagiri at Beed, Com. Mrs. M. J. Kulkarni as SDE Circle Office Mumbai at Ahmednagar and Com. L. S. Basinge as DGM Sindhudurg at Sangli and Com Shrikant Mumbrakhane as DGM Ratnagiri at Solapur and unconditionally withdraw the charge sheets issued to these officers at par with Com P.G. Wankhade and in such conditions we will not have any objection for illegal retention of Com Wankhade at Amravati. OR J. Cancel the illegal retention order issued as SDE Yavatmal at Amravati to Com. P. G. Wankhade DS AIBSNLEA and he also should be directed to join at Yavatmal and you may decide on issuing charge sheet to him or withdraw charge sheet of all, others, but whatever action is taken it should be taken equally for all.
