3 Let me turn your attention to the early evening of Friday, November rd,. You remember that evening? Yes, sir. Did you go out to dinner that evening? Yes, sir, I did. Where? To the Loop. Which Loop location? The one on Southside and Baymeadows. Had you ever been to that plaza where the Loop is before? evening? I had. nd did you go to dinner with anyone that Yes, sir. Who was that? To my left which would have been towards the Gate. nd you're familiar with the fact that there was a Gate Gas Station turning to your left?

Okay. nd can you describe the sequence as far as the pause? Was there -- just describe for the jury what you heard. You said you heard two sets. Describe for them what you heard. I heard a round of a few shots and then there was a slight pause and then there was another round of a few shots. nd do you recall whether there were more shots in the first sequence or the second sequence? I do not recall. nd what were you doing when those shots were being fired? Were you at the car? Were you walking to the car or what? We were walking towards the car. t some point did you see any vehicles in the parking lot that caught your attention? Yes, sir. nd what kind of car was that?

I heard the tires squealing and he pulled in and just stopped. ll right. nd where was the car coming from, from what direction? From the left which would have been from the area of the Gate. ll right. nd when you say the car stopped, did it pull into a parking space or did it stop straight? middle. Could you tell if they appeared to be white, black, Hispanic, sian or what? They appeared to be two black individuals. ll right. nd the person who got out of the front passenger seat, where did that person go? He stood at his door for a second. He was on a cell phone and then he went to the back door, opened it and was looking inside. Do you know what he was looking at? No, I do not.

Did you ever see the front passenger with anything in his hands other than a cell phone? No, sir. Did you see anything on the person of the front passenger at any time other than his cell phone? No, sir. Did you see the front passenger throw or take anything out of the car? No, sir. Want to turn your attention to the driver now. What did that person do when they got out? He went immediately to the back door, opened it and leaned inside. Do you know what the driver was looking at when he looked in the back door? No, I do not. Do you know what the driver was doing, if anything, within the car? No, I do not.

What did you mean by that? I -- I did not know at the time what was going on. I heard gunshots. I saw the SUV pull in. The driver was leaning in. I figured maybe he was trying to either hide something in the car or -- or something of that nature. Did you ever see anything come out of the car? No, sir. I did not. So is what you were trying to convey to that you thought he was putting something within the

Did you ever see anything that looked like a shotgun anywhere in the vicinity of that car? Not at all. Did you ever see anything that looked like a pipe or a bat or a tire iron in the vicinity of that car? Not at all. Let me show you a couple of photographs. 16 by Baymeadows. We heard what sounded to be like some really weak gunshots. UNIDENTIFIED VOICE: Okay. Baymeadows Loop you said? THE WITNESS: I'm sorry? UNIDENTIFIED VOICE: The Loop on Baymeadows? THE WITNESS: Yes, the Loop over by Bonos. UNIDENTIFIED VOICE: Okay. (Unintelligible.) -- I don't have a Baymeadows. THE WITNESS: Okay. What road is -- (Unintelligible.) Southside? It's Southside and Baymeadows. UNIDENTIFIED VOICE: Okay. THE WITNESS: It was coming from over by the gas station and then a red -- it looked like a Dodge Durango but I couldn't be sure. It was a red SUV came hauling ass around the corner. Two black males stepped out and I'm not sure -- (Unintelligible.) There's a cop sitting across the street -- (Unintelligible.) UNIDENTIFIED VOICE: Okay. They pulled up from the red -- the two black males came from the red SUV? THE WITNESS: UNIDENTIFIED VOICE: Okay. So the red SUV

17 pulled up and two black males got out? THE WITNESS: Right. They pulled up. They didn't even pull into a parking spot. They just pulled into the lot and like the driver stepped out. It looked like a black male with -- with kind of like longer hair. I couldn't really tell if he had dreads or not. It's kind of dark. UNIDENTIFIED VOICE: What color shirt? THE WITNESS: (Unintelligible.) One of them had a camouflage shirt on. UNIDENTIFIED VOICE: The one with the long hair? THE WITNESS: nd a hat. No. The passenger had the camo on. (Unintelligible.) -- on the driver's shirt. UNIDENTIFIED VOICE: Okay. THE WITNESS: I was kind of preoccupied because I've got my two-year-old son with me and we literally -- me and my sister we just got to her car when we heard it and then like I said they pulled up right there by us so -- UNIDENTIFIED VOICE: Did they get out or what did they do? THE WITNESS: Yeah. They stepped out of the vehicle. It looked like they were either looking

18 -- yeah. One was like -- one was on his cell phone looking back and it looked like they were pretty much -- I don't know if they were trying to stash something in the car or look for something or what, but looked like they got out, kind of brushed themselves off and then they got back in and I -- they took off. I don't know which way they went because I was putting my son in the car when they did that. I was trying to get out of there as fast as I could because the last thing I need is for him to get shot over something stupid. UNIDENTIFIED VOICE: Did you get a tag number? THE WITNESS: No. Did you get a tag number? (Unintelligible.) Yeah. We were in -- we were in the front. Like they stopped right before they got up to us. UNIDENTIFIED VOICE: Okay. Which way did they leave when they -- when they left? THE WITNESS: (Unintelligible.) Back -- yeah. Back towards the gas station. UNIDENTIFIED VOICE: I don't know where the gas station is. THE WITNESS: There's -- there's a gas station right there. It's a Gate where the shots were -- it sounded like the shots were fired from and they

19 just threw it in reverse because this is all kind of like one parking lot. There's a Gate and then, you know, there's like a shopping center with the Loop -- (Unintelligible.) UNIDENTIFIED VOICE: Sir, how many shots did you hear? THE WITNESS: Oh, shoot. Like -- how many shots do you think it was? (Unintelligible.) It was more than six because they -- you know, it was like pop, pop, pop, pop, pop and then it stopped for a second and then you heard pop, pop, pop, pop, pop, pop, pop. UNIDENTIFIED VOICE: Okay. So would you say close to ten? THE WITNESS: bout, yeah. It very well could have been. UNIDENTIFIED VOICE: Okay. What's your last name? THE WITNESS: LeBlanc, L-E-B as in Boy, L--N-C. UNIDENTIFIED VOICE: You want to see the officer when he comes or you left the area? THE WITNESS: We're actually headed back to the apartment -- (Unintelligible.) Yeah. If you want to send an officer over to my sister's

20 apartment that's where we're right by now. It's not far. It's -- hang on a second. I'll let you speak with her because she knows this area better than I do. Hang on a second. THE WITNESS: Hi. My address is -- (Stopped call.) BY MR. GUY: ll right. Mr. LeBlanc, was that portion of the call to the Sheriff's Office? Yes, it was. ll right. During that call it sounds as though you were asking questions or talking to a female. Who was that? have. That was lyssa. MR. GUY: Thank you, sir. Judge, that's all I THE COURT: ll right. Mr. Strolla. MR. STROLL: Thank you, Your Honor. If it pleases the Court? THE COURT: Yes, sir. CROSS EXMINTION BY MR. STROLL: Mr. LeBlanc, that was you on the, correct?

21 nd you would say the memory was fresh in your mind when you gave that call and what you said on that call, correct? bsolutely. Human nature your mind is not going to be as clear today as it was months ago? ll right. So that call was about as accurate as it could get, isn't that true? Yes, sir. nd isn't it true you told that you were preoccupied with putting your son in the car and that's why you didn't see much, true? s they were backing up, yes. ll right. But that's not what you said on the call. Did you just hear your call? I did. Did you miss any of it? No, I did not. Would you say it's truthful and accurate? Yes, sir. I would. ll right. Now you said that prior to them getting back in and take off, isn't that true? Isn't it true -- I'm sorry. I'm sorry. Go ahead.

22 Isn't it true you made the comment I was preoccupied because I had my two-year-old son with me prior to you telling them they got back in the car and took off? I was in reference to them backing up. So you would say that you were preoccupied but then jump back and say, no, I wasn't preoccupied when they were getting in? No, sir. Not at all. I saw them get in. I did not see them back up. nd my point is you even said on the call I didn't even see where they took off, correct? s a matter of fact, your sister had to say on the phone they backed up? nd that's because you weren't looking? s they backed up. So when Mr. Guy said did you see anything thrown from the vehicle you weren't looking when they were backing up. It's just when they were stopped and out of the vehicle, correct? Now also the doors are open. The driver gets

23 out, opens his door, true? True. Passenger gets out, opens his door, true? re you saying they both opened the back doors as well? Yes. You can't see what's going on inside that vehicle, can you? No, I cannot. nd you tell it looks like they're stashing something and that's based on what you were looking at, correct? I said they were looking as if they stashing something or if they were looking for something. Okay. nd also on that isn't it true that there were cars blocking your view and your line of sight from where you were parked in the parking lot? No, sir. Okay. nd isn't it true that you now can't see through a Dodge Durango? Right? You can't see what's going on on the other side of the Dodge Durango, can you?

24 So when you told the jury the passenger didn't do anything or throw anything you can't see him, can you? Well, the line of sight the way he was facing the car I could see both sides of the car. Okay. I mean -- Was your sister right next to you at the time? I do not recall if she was or not. Okay. So as we sit here today you have no recollection of where your sister was getting in and out of the car? Today I do not, no, sir. So if you can see both sides of the car on your angle would you say your sister could see the same thing? Probably. ll right. So if she can't see the other side of the car is it safe to say you couldn't either? That depends on where she was standing. If she was standing at her driver's -- if she was standing at her driver's door then she would not have been able to. I was standing towards the back.

25 Okay. nd if she's on the passenger side on the other side of the car she'd be able to see that, is that what you're saying? If she was standing right next to me then, yes. ll right. nd isn't it true you went around the car to open the door and unlock it? It's possible. I don't recall. ll right. nd if you went around the car to open it and unlock it to get in you'd have to take your eyes off the Durango, wouldn't you? Yeah, for a split second. nd you'd have to get in -- well, you'd have to lean over and unlock the door, right, because she didn't have power locks, did she? Right. She didn't have a remote control that unlocks it, correct? It's a Saturn. I wouldn't have had to lean. I'd just have to reach back and flip the switch. ll right. nd then you had to take your son and put him in the back seat, correct? Put him safely in his car seat? Uh-huh.

26 Strap him in? Yep. nd then go back around to get in the passenger side, correct? nd all that time there's no way you could have been looking at the Durango? MR. GUY: Judge, I'm going to object to that as being argumentative. THE COURT: Sustained. BY MR. STROLL: Is it true that during that time you were not looking at the Durango? During the time that -- if I -- if I unlocked the doors then I'm sure I probably didn't see it as I was unlocking the door. ll right. nd again you told you were preoccupied because of your son, isn't that true? Those were your words. I'm not putting words in your mouth, am I? Not at all. That tape wasn't altered in any way, was it? No, it was not.

27 correct? No one coerced you to make that phone call, No, sir. Now matter of fact, you said with Mr. Guy that the police contacted you a few days later? I believe it was a few days. I could be wrong about that. Would it refresh your recollection to look at the report? That's fine. I'm sure the date on the report is accurate. Would it refresh your recollection to look at the report? I guess so. MR. STROLL: Your Honor, if I can approach? THE COURT: Yes, sir. MR. STROLL: For the record, Your Honor I'm showing supplemental, page of. BY MR. STROLL: Mr. LeBlanc, this is not in evidence. It's just to refresh your recollection. Please look at it and let me know if looking at that date -- do you see your name there? Yes, sir, I do. Okay. Can you read that top line to

28 yourself, not out loud, and tell me if that refreshes your recollection? Okay. Okay. Your recollection refreshed? Yes, sir. Isn't it true you met with police on December rd,? Do you recall when you gave a sworn statement to Mrs. Wolfson in this case? Yes, I do. What day was that? I don't remember what the date was. Would it refresh your recollection if I showed you? bsolutely. MR. STROLL: Your Honor, if I may approach? MR. GUY: Your Honor, I object to that. It's irrelevant. He's not using it to impeach him. THE COURT: Sustained. MR. STROLL: Judge, if I may, can we approach? THE COURT: Sure. (Sidebar discussion with reporter present.) MR. STROLL: Judge, I believe his testimony

29 was a couple days later. It was almost two weeks later and then even after that he gave another statement and this is why it's going to be relevant, Judge. He gave his statement at the State ttorney's Office. This witness received a direct benefit from Mr. Guy. He had a warrant for his arrest for failing to appear, missed our depo, told us that he didn't know where the State ttorney's Office was and that's why he missed it, had no idea he had a warrant. Mr. Guy makes a phone call. Warrant goes away, case goes away. Fines and court costs goes away. So I need to be able to show relevancy that he was at the State ttorney's Office on that date back in December and then now when he has a warrant magically for his depo he didn't know where the State ttorney's Office is. That's where I was going with it. MR. GUY: Judge, that aspect would be a collateral matter. The fact that I called and got his capias withdrawn, got him a court date is fair, but the fact that he said he didn't know where the courthouse was or didn't know where my office was would be a collateral matter. THE COURT: When did he say that?

30 MR. STROLL: He said that when we had our depo. He failed to appear twice. I asked him why didn't you come? THE COURT: When? MR. STROLL: When he finally showed up for his depo after the warrant was taken off. Then all of a sudden magically he appears for his deposition, Judge. I think it's relevant to show bias of why he is answering the questions this way. He received a benefit. THE COURT: You can ask him about there being a warrant and he got the warrant recalled and got him a court date. I don't know about fines and court costs going magically away. MR. STROLL: Not that way but that is part of a bias. THE COURT: Sounds like he got him a court date. MR. STROLL: He did but when he walked in the Judge knew and everybody in that courtroom knew who he was, that the warrant went away. THE COURT: How do you know that? MR. STROLL: I think I have -- with all due respect -- THE COURT: Can you prove that?

31 MR. STROLL: I cannot prove it. THE COURT: Then don't do it. MR. STROLL: Judge, on cross examination I am allowed wide latitude. THE COURT: Listen to me, Mr. Strolla, I will give you all the latitude you want, but if you start doing stuff like that and you do not back it up that is going to be a problem. I don't mind you doing anything you want as long as you can back it up and you intend to back it up. MR. STROLL: Can I ask -- THE COURT: So if you get in there and start saying, you know, you went in there and the Judge didn't give you any court costs because he knew you were a hotshot witness in this case and that's not true then we have a problem. MR. STROLL: Yes, Judge. What I was going to say is that he got a benefit from the state. ll the fines and court costs were waived. THE COURT: I don't know about that. MR. STROLL: Well, he can -- if he admits to it and says yes, I still believe with all due respect it's a monetary discretionary bias with a wide latitude on cross. If he says no, then I'm stuck with no.

32 THE COURT: What was his charge? MR. STROLL: Driving while license suspended. MR. GUY: It was a County Court capias. THE COURT: I hope it wasn't me. MR. STROLL: No, sir. THE COURT: We have some Judges here who routinely will waive fines and costs for any number of reasons, so I don't mind you saying did the state get the warrant recalled and didn't they get you a court date? I would be careful about saying did you get your fines and costs waived unless you can prove that the reason they got waived is because of them. MR. STROLL: Well, I wouldn't be able to prove that unless I put in -- I subpoena the Judge or the prosecutors, but I think I am allowed to bring it up and ask him were the fines and court costs waived and if they want to bring something up in rebuttal they are more than welcome to. If they want to bring Judge Ferguson. THE COURT: That's who waives the fines and court costs all day long. MR. STROLL: nd that's who Mr. Guy spoke to. He called the Judge's chambers directly. MR. GUY: I didn't speak to the Judge.

33 MR. STROLL: I said the Judge's chambers. MR. GUY: Judge, just so you will know to complete the picture I got it waived. He went to court. THE COURT: You got what waived? MR. GUY: The warrant. I got the warrant withdrawn. THE COURT: You got the warrant recalled? MR. GUY: He went to court. They said your charge was driving on an invalid license. The Judge said how long is it going to take you to get a license? I've got it right here and Judge Ferguson said hit the road. That's the way it went down. MR. STROLL: It was driving while license suspended which is an enhanced crime so it was a no valid D.L.. It makes a difference, Judge. THE COURT: You've got to know how it works in Duval County. MR. STROLL: In terms of an enhancement I know an invalid D.L. can't get enhanced, but if you get a drivers license suspended it's a major problem if you get three. THE COURT: Let me tell you how it works in Duval for the record. If you get charged with

34 driving on a suspended license and you come to court whenever and you finally got a license in your hand routinely -- so we don't have people getting strikes and getting habitual traffic offender issues routinely, I do this all the time, the state because the person has their license will amend to no valid drivers license. It's a withhold adjudication of guilt and then usually it's court costs. Judge Ferguson routinely waives court costs and fines. That's just the way he does things. gain I don't mind you saying didn't you get your capias recalled and they got you a court date? I don't think it's fair to go the rest of the distance because I don't -- I don't want you to leave the jury with an inference that his court costs and fines got waived because of this because you need proof of it, so you can go the first two steps and if you want to try to prove it later go ahead. Today you can't prove it so don't do it. MR. STROLL: But just to clarify, too, the objection was about the date and where it was. I still think I can ask this witness isn't it true you didn't come to a depo twice? THE COURT: How are you going to prove that he said he didn't know where the State ttorney's

35 Office was? MR. STROLL: I'm going to ask him and if he says no it's no. He can't take the witness stand and testify -- THE COURT: Let me tell you, and again I don't mean to do y'all's business, but the way you people have been trying to impeach witnesses with depositions or prior anything is completely incorrect. Nobody has objected so I haven't said anything, but the way you guys are doing it is in my mind improper. There is a very specific way to impeach somebody with a prior sworn statement or deposition and it hasn't been done but maybe once or twice in this whole trial, so I worry about how you are going to go and do it. MR. GUY: Judge, my initial objection was to the fact that -- the date he gave a sworn statement. If he is not using it to impeach him then it's not proper. It's a prior consistent statement not offered to rebut recent fabrication. THE COURT: So far it's not even funny. MR. STROLL: I can ask for the fact in between that time he did talk to his sister about what happened. His sister did testify that they

Yes, sir. nd again that was even closer in time than your deposition and your testimony today? Now on your taped statement do you recall Ms. Wolfson asking you questions? Yes, sir. nd do you kind of recall asking similar questions with Mr. Guy? Yes, sir. But nobody else was present. It was just you, the prosecutor and detectives, correct? Yes, sir. nd was this before or after your sister gave a sworn statement? Not really sure about that, sir. ll right. nd isn't it true you talked to

38 your sister after the event about what you guys had witnessed and seen? Not really. I mean we like -- were like what was that, what just happened, you know, but nothing in-depth. So even after the night before you talked to police you did talk to your sister about the story, what you guys both saw, correct? Right. nd prior to your sworn statement you and your sister talked about what you both saw, correct? Now, Mr. LeBlanc, at one point in this case you had some depositions scheduled with myself, correct? nd at some point Mr. Guy reached out to you because you had a warrant for your arrest, isn't that true? ll right. nd at that point you hadn't shown up for your depo, is that true? ll right. nd you talked to Mr. Guy about your warrant?

39 court? nd that was for you failing to appear in Yes, sir. nd that was for failing to appear in court in this courthouse, correct? nd then Mr. Guy actually called in for you to get that warrant recalled, isn't that true? Yes, it is. You didn't have to hire an attorney, is that true? No, sir. It's true or it's not? It's true. Right. You didn't have to hire an attorney? You didn't have to turn yourself in at the jail, right? Right. You didn't go to the jail and say I got a warrant and I'm turning myself in? Didn't know I had one. ll right. nd at that point you walk into court because the warrant's gone, isn't that true?

40 I walked into court because they gave me my court date. Well, when you walked in -- recalled? Yes, sir. ll right. Mr. Guy told you the warrant was Yes, sir. He told me that the warrant was recalled and I had a court date. ll right. nd after that is when you appeared for your depo in this case, isn't that correct? I believe so, yes, sir. MR. STROLL: Nothing further, Judge. THE COURT: Mr. Guy. MR. GUY: Thank you, Judge. REDIRECT EXMINTION BY MR. GUY: Mr. LeBlanc, what was that -- what was that capias, that arrest warrant, what was that for? suspended license. Did you -- I called you and told you that you had a warrant for you? Yes, sir. nd I told you I would call the Judge's office and try to get you a court date?

41 Did you get a court date? Yes, sir, I did. When was it? The following week. Did you go to court? bsolutely. Tell the jury what happened in court. I walked into court. The Judge asked me when I could provide a valid drivers license to the Court. I told him I had one. He asked me to hand it to the prosecutor. t that time I handed it to the prosecutor. The prosecution said that I was okay and he told me to have a nice day. nd you had a valid license? Yes, I did. Okay. Was the prosecutor me? No. To your knowledge? No. Did the prosecutor know who you were? Not at all. That you were a witness in this case? No, sir. You were asked about the time that you put

42 your son in his car seat. Your son was two? Yes, sir. He was. Had you ever put him in a car seat before? Yeah, a few thousand times. Okay. Was that complex? I mean you don't have to study what you were doing and take some time? No. I'm a pretty quick learner. Fair to say that your attention was not off the SUV very long while you were putting your son in the car? Not at all. You were asked about talking to your sister before you came and talked to the detectives. Did you and your sister like conspire and say, hey, let's see if we can get our stories straight and try to pin something on somebody? No. MR.
